SUBJ-ECT:
The City has completed a review of the application for a Planned Industrial Permit for
development located on Dryden Place within the Carlsbad Airport Centre, Specific Plan
18l(A), (Lots 21 and 22 of Carlsbad Tract 81-46 Unit No. 1, according to Map No.
11287).
It is the Planning Director's determination that the project is consistent with the City's
Planned Industrial Zone regulations (Chapter 21.34), Specific Plan 18l(A), and with all
other applicable City ordinances and policies. The Planning Director, therefore, APPROVES
this request based on the following findings and conditions:
1) The site indicated by the Planned Industrial Permit is adequate in size and shape to
accommodate the proposed use, and all yards, spaces, walls, fences, parking,
loading, landscaping, and other features required by this chapter have been
provided.
2) The improvements indicated on the Planned Industrial Permit are located in such
a manner to be related to existing and proposed streets and highways.
3) The improvements as shown on the Planned Industrial Permit are consistent with
the intent and purpose of this zone and all adopted development, design, and
performance standards as set forth in this chapter.
4) Unless otherwise stated, this industrial project shall comply with all applicable City
Ordinances and requirements.

5) The uses, improvements, and architecture as shown on the Planned Industrial Permit
are consistent with the intent and purpose of the Planned Industrial Zone and all
adopted development design and performance standards as set forth in the PM zone,
and Specific Plan 181 (A).
6) The project is in prior compliance with Environmental Impact Report 81-06 for
Specific Plan 181, and no additional significant adverse environmental impacts
would occur as a result of implementation of this project.
7) The project is consistent with the Palomar-McClellan Comprehensive Land Use Plan
as determined by the San Diego Association of Governments.
Conditions:
Planning:
1. Approval is granted for PIP 93-02 as shown on Exhibits "A"-"E", dated December 10,
1993, on file in the Planning Department and incorporated herein by reference.
Development shall occur substantially as shown unless otherwise noted in these
conditions.
2. All roof appurtenances, including air conditioners, shall be shielded from view and
architecturally integrated with the building design to the satisfaction of the Planning
Director.
3. Unless otherwise stated, this industrial project shall comply with all applicable City
ordinances and requirements, including the requirements and standards of Specific
Plan 181(A).
4. The developer shall provide the City with a reproducible 24" x 36", mylar copy of
the site plan as approved by the Planning Commission. The site plan shall reflect
the conditions of approval by the City. The plan copy shall be submitted to the City
Engineer and approved prior to building, grading, final map, or improvement plan
submittal, whichever occurs first.
5. This project is approved upon the express condition that building permits will not
be issued for development of the subject property unless the District Engineer
determines that sewer facilities are available at the time of application for such
sewer permits and will continue to be available until time of occupancy.

6. This project is also approved under the express condition that the applicant pay the
public facilities fee adopted by the City Council on July 28, 1987 and as amended
from time to time, and any development fees established by the City Council
pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance
adopted to implement a growth management system or facilities and improvement
plan and to fulfill the subdivider's agreement to pay the public facilities fee dated
November 9, 1993, a copy of which is on file with the City Clerk and is
incorporated by this reference. If the fees are not paid this application will not be
consistent with the General Plan and approval for this project will be void.
7. This project shall comply with all conditions and mitigation measures which may
be required as part of the Zone 5 Local Facilities Management Plan and any
amendments made to that Plan prior to the issuance of building permits.
8. If any condition for construction of any public improvements or facilities, or the
payment of any fees in lieu thereof, imposed by this approval or imposed by law on
this project are challenged this approval shall be suspended as provided in
Government Code Section 66020. If any such condition is determined to be invalid
this approval shall be invalid unless the City Council determines that the project
without the condition complies with all requirements of law.
9. This approval shall become null and void if building permits are not issued for this
project within one year from the date of project approval.
10. Prior to the issuance of the building permit there shall be a Notice of Restriction
placed on the deed to this property subject to the satisfaction of the Planning
Director notifying all interested parties and successors in interest that the City of
Carlsbad has issued a Planned Industrial Permit PIP 93-02, dated December 10,
1993, on the real property owned by the declarant. Said Notice of Restriction shall
note the property description, location of the file containing complete project details
and all conditions of approval as well as any conditions or restrictions specified for
inclusion in the Notice of Restriction. The restrictions referred to in said notice may
be modified or terminated only with the approval of the Planning Director, Planning
Commission or City Council of the City of Carlsbad whichever has final decision
authority for this project.
11. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates
pursuant to City standards. Location of said receptacles shall be approved by the
Planning Director. Enclosure shall be of similar colors and/or materials to the
project to the satisfaction of the Planning Director.

The applicant shall prepare a detailed landscape and irrigation plan which shall be
submitted to and approved by the Planning Director prior to the approval of grading
or building permits, whichever occurs first.
All parking lot trees shall be a minimum of 15 gallons in size.
All landscaped areas shall be maintained in a healthy and thriving condition, free
from weeds, trash, and debris.
All landscape and irrigation plans shall be prepared to conform with the Landscape
Manual and submitted per the landscape plan check procedures on file in the
Planning Department.
The applicant shall pay a landscape plan check and inspection fee as required by
Section 20.08.050 of the Carlsbad Municipal Code.
The first set of landscape and irrigation plans submitted shall include building plans,
improvement plans and grading plans.
Building identification and/or addresses shall be placed on all new and existing
buildings so as to be plainly visible from the street or access road; color of
identification and/or addresses shall contrast to their background color.
Any signs proposed for this development shall at a minimum be designed in
conformance with the City's Sign Ordinance and Specific Plan 181(A) and shall
require review and approval of the Planning Director prior to installation of such
signs.
Prior to approval of a building permit for this project the owner of the subject
property shall execute an agreement holding the City harmless regarding personal
injury' and property damage resulting from the use of the test facility.
The golf test facility shall be restricted to supervised testing by robots and qualified
testers. The facility shall not be available for private or public recreational use.
Prior to approval of a building permit the developer shall mitigate the interior noise
levels of the golf testing facility to 50 CNEL per the requirements of the
Comprehensive Land Use Plan McClellan-Palomar Airport.
Prior to the issuance of building permits the owner of record of the property shall
prepare and record a notice (see Noise, Form #2 on file in the Planning
Department) that this property is subject to overflight, sight, and sound of aircraft
operating from Palomar Airport. The notice shall be prepared in a manner meeting
the approval of the Planning Director and the City Attorney.

Unless a standards variance has been issued, no variance from City Standards is
authorized by virtue of approval of this site plan.
The applicant shall comply with all the rules, regulations and design requirements
of the respective sewer and water agencies regarding services to the project.
The applicant shall be responsible for coordination with S.D.G.&E., Pacific Bell
Telephone, and Cable TV authorities.
Prior to issuance of a building permit for any buildable lot within the subdivision,
the property owner shall pay a one-time special development tax in accordance with
City Council Resolution No. 91-39.
Prior to grading and building permit issuance the applicant shall pay all current fees
and deposits required.
Pretreatment of the sanitary sewer discharge from this project may be required. In
addition to the requirements for a sewer connection permit the applicant shall
conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The
applicant shall apply for an industrial waste water discharge permit concurrently
with the building permit for this project.
Prior to hauling dirt or construction materials to or from any proposed construction
site within this project, the applicant shall submit to and receive approval from the
City Engineer for the proposed haul route. The applicant shall comply with all
conditions and requirements the City Engineer may impose with regards to the
hauling operation.
The developer shall exercise special care during the construction phase of this
project to prevent offsite siltation. Planting and erosion control shall be provided
in accordance with the Carlsbad Municipal Code and the City Engineer. Reference
Chapter 11.06.
The applicant shall comply with the City's requirements of the National Pollutant
Discharge Elimination System (NPDES) permit. The applicant shall provide best
management practices to reduce surface pollutants to an acceptable level prior to
discharge to sensitive areas. Plans for such improvements shall be approved by the
City Engineer prior to issuance of grading or building permit, whichever occurs first.
These plans shall incorporate the following:

k Said plans shall specifically address the use of fertilizers, pesticides,
herbicides, etc. in a manner that reduces their detrimental impact on the
environment.
B. A curb opening shall be provided within the range building driveway as
shown on the site plan to allow surface run-off to drain through the fairway
landing area of the Test Range at a 1% minimum fall to the test range
private drains.
C. The range building parking lot surface run-off shall sheet flow through the
fairway landing area of the Test Range at a 1% minimum fall to the Test
Range private drains.
33. Plans, specifications, and supporting ciocuments for all public improvements shall
be prepared to the satisfaction of the City Engineer. Prior to issuance of building
permits, the applicant shall install, or agree to install and secure with appropriate
security as determined by the City Engineer improvements shown on the site plan.
Said improvement plans with protection of existing improvements as shown on the
site plan may be submitted with the building plans. A plancheck and inspection fee
shall be paid by the developer for the improvements.
34. Prior to the issuance of a right-of-way permit the developer shall agree to restore
any damaged or altered public improvements associated with the project and shall
post a cash deposit for said work.
- Fire:
35. Prior to the issuance of building permits, complete building plans shall be approved
by the Fire Department.
36. Additional on-site public water mains and fire hydrants are required.
37. Applicant shall submit a site plan to the Fire Department for approval, which depicts
location of required, proposed and existing public water mains and fire hydrants.
The plan should include off-site fire hydrants within 200 feet of the project.
38. Applicant shall submit a site plan depicting emergency access routes, driveways and
traffic circulation for Fire Department approval.
39. An all weather, unobstructed access road suitable for emergency service vehicles
shall be provided and maintained during construction. When in the opinion of the
Fire Chief, the access road has become unserviceable due to inclement weather or

other reasons, he may, in the interest of public safety, require that construction
operations cease until the condition is corrected.
All required water mains, fire hydrants and appurtenances shall be operational
before combustible building materials are located on the construction site.
All security gate systems controlling vehicular access shall be equipped with a
"Knox", key-operated emergency entry device. Applicant shall contact the Fire
Prevention Bureau for specifications and approvals prior to installation.
Private roads and driveways which serve as required access for emergency service
vehicles shall be posted as fire lanes in accordance with the requirements of Section
17.04.020 of the Carlsbad Municipal Code.
A monument sign shall be installed at the entrance to the driveway or private street
indicating the addresses of the buildings on site.
44. The entire potable water system, reclaimed water system and sewer system shall be
evaluated in detail to insure that adequate capacity, pressure and flow demands are
met.
45. The Developer shall be responsible for all fees, deposits and charges which will be
collected at the time of issuance of the building permit. The San Diego County
Water Authority capacity charge will be collected at issuance of application for
meter installation.
46. Sequentially, the Developers Engineer shall do the following:
A. Meet with the Fire Marshal and establish the fire protection requirements.
B. Prepare a colored reclaimed water use area map and submit to the Planning
Department for processing and approval.
C. Schedule a meeting with the District Engineer for review, comment and
approval of the preliminary system layout usage (G.P.M. - E.D.U.) plan for
potable, reclaimed and sewer systems prior , to the preparation of
improvement plans.
47. This project is approved upon the expressed condition that building permits will not
be issued for development of the subject property unless the water district serving
the development determines that adequate water service and sewer facilities are

available at the time of application for such water service and sewer permits will
continue to be available until time of occupancy. This not shall be placed on the
final map.
48. The District has water and sewer facilities in Dryden Place. Developer must provide
improvement plans and right-of-way easements as necessary to insure adequate
service.
