HomeMy WebLinkAboutPIP 93-03; Knorr's Beeswax; Planned Industrial Permit (PIP)4 February 28, 1994 Steve Knorr 14906 Vi de la Valle Del Mar, CA 92014 SUBJECL PIP 9343 - KNORR'S BEESWAX The City has completed a review of the application for a Planned Industrial Permit for development located on Kellogg Street within the Carlsbad Airport Centre, Specific Plan 181(A), (Lot 47 of Carlsbad Tract 81-46 Unit No. 2, according to Map No. 11288). It is the Planning Directois determination that the project is consistent with the City's Planned Industrial Zone regulations (Chapter 21.34), Specific Plan 181(A), and with all other applicable City ordinances and policies. The Planning Director, therefore, APPROVES this request based on the following findings and conditions: 1. 2. 3. 4. 5. 6. The site indicated by the Planned Industrial Pennit is adequate in size and shape to accommodate the proposed use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required by this chapter have been provided. The improvements indicated on the Planned Industrial Permit are located in such a manner to be related to existing and proposed streets and highways. The improvements as shown on the Planned Industrial Permit are consistent with the intent and purpose of this zone and all adopted development, design, and performance standards as set forth in this chapter. Unless otherwise stated, this industrial project shall comply with all applicable City Ordinances and requirements. The uses, improvements, and architecture as shown on the Planned Industrial Permit are consistent with the intent and purpose of the Planned Industrial Zone and all adopted development design and performance standards as set forth in the PM zone, ad specific Plan 181(A). The project is in prior compfiance with Environmental Impact Report 81-06 for Specific Plan 181, and no additional significant adverse environmental impacts would occur as a result of implementation of this project. 2075 Las Palmas Drive - Carlsbad, California 92009-1576 (619) 438-1 161 @ ~- c Page 2 7. Approval is granted for PIP 93-03 as shown on Exhibits "A" - "I", dated February 22, 1994, on file in the Planning Department and incorporated herein by reference. Development shall occur substantially as shown unless orhenvise noted in these conditions. AU roof appurtenances, including air conditioners, shall be shielded from view and architecturally integrated with the building design to the satisfaction of the Planning Director. Unless otherwise stated, this industrial project shall comply with all applicable City ordinances and requirements, including the reqr' randstandatdsofSpecific Ph 181(A). The developer shall provide the City with a reproducible 24" x 36", mylar copy of the site plan as approved by the Planning Commission. The site plan shall reflect the conditions of approval by the City. The plan copy shall be submitted to the City Engineer and approved prior to building, grading, final map, or improvement plan submittal, whichever ocmi fit. This project is approved upon the express condition that building permits will not be issued for development -of the subject property unless the District Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This project is also approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on July 28, 1987 and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or facilities and improvement plan and to fulfill the subdividefs agreement to pay the public facilities fee dated November 12, 1993, a copy of which is on file with the City Clerk and is incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this project will be void. This project shall comply with all conditions and mitigation measures which may be required as part of the Zone 5 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of bdding permits. If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 66020. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. Prior to the issuance of the building permit there shall be a Notice of Restriction placed on the deed to this property subject to the satisfaction of the Planning Director now all interested parties and successors in interest that the City of Carlsbad has issued a Planned tndustrial Permit PIP 93-03, dated February 28,1994, on the real property owned by the declarant. Said Notice of Restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specified for inclusion in the Notice of Restriction. The restrictions referred to in said notice may be modified or tenninated only with the approval of the Planning Director, Planning Commission or City Council of the City of Carlsbad whichever has final decision authority for this project. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. Enclosure shall be of similar colors and/or materials to the project to the satisfaction of the Planning Director. The applicant shall prepare a detailed landscape and higation plan which shall be submitted to and approved by the Planning Director prior to the approval of grading or building permits, whichever occurs first. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. All landscape and irrigation plans shall be prepared to conform with the Landscape Manual and submitted per the landscape plan check procedures on file in the Planning Department. The applicant shall pay a landscape plan check and inspection fee as required by Section 20.08.050 of the Carlsbad Municipal Code. The fitst set of landscape and inigation plans submitted shall include building plans, improvement plans and grading plans. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. The applicant shall comply with all the rules, regulations and design requirements of the respective sewer and water agenaes regarding &ces to the project. 25. The applicant shall be responsible for coordination with S.D.G.& E., Pacific Bell Telephone, and Cable TV authorities. 26. Prior to issuance of a building permit, the property owner shall pay a one-time special development tax in accordance with City Council Resolution No. 91-39. 27. Pretreatment of the sanitary sewer discharge from this project may be required. ~n addition to the requirements for a sewer connection permit the applicant shall conform to the requirement of Chapter 13.16 of the Carlsbad Municipal code. The applicant shall apply for an industrial waste water discharge pexmit concurrently with the building permit for this project. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, the applicant shall submit to and receive approval from the City Engineer for the proposed haul route. The applicant shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. The applicant shall comply with the Citfs requirements of the National Pollutant Discharge Elimination System (NPDES) permit. The applicant shall provide best management practices to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such improvements shall be approved by the City Engineer prior to ismarm! of building permit. Additional on-site public water mains and fire hydrants are required. Applicant shall submit a site plan to the Fire Department for approval, which depicts location of required, proposed and existing public water mains and fire hydrants. The plan should include off-site fire hydrants within 200 feet of the project. Applicant shall submit a site plan depicting emergency access routes, drivewars and traffic circulation for Fire Department approval. Plans 'and/or specifications for fire alarm systems, fire hydrants, automatic fire sprinkler systems and other fire protection systems shall be submitted to the Fire Department for approval prior to construction. An approved automatic fire sprinkler system shall be installed in buildings having an aggregate floor area exceeding 10,oOO square feet. The entire potable water system, reclaimed water system and sewer system shall be evaluated in detail to insure that adequate capacity, pressure and flow demands are met. The developer shall be responsible for all fees, deposits and charges which will be collected at time of issuance of the building permit. The San Diego County Water Authority capacity charge will be collected at issuance of application for meter installation. Sequentially, the Developers Engineer shall do the following: A. Meet with the City Fire Marshal and establish the fire protection requirements. B. Prepare a colored reclaimed water use area map and submit to the Planning Department for processing and approval. C. Schedule a meeting with the District Engineer for review, comment and approval of the preliminary system layout usage (G.P.M. - E.D.U.) plan for potable, reclaimed and sewer systems prior to the preparation of improvement plans. This project is approved upon the expressed condition that building permits will not be issued for development of the subject property unless the water district serving the development determines that adequate water seryices and sewer facilities are available at the time of application for such water service and sewer pennits will continue to be available until time of occupancy.
