HomeMy WebLinkAboutPIP 94-02; Carlsbad Airport Centre Lot 36; Planned Industrial Permit (PIP)PLANNED INDUSTRIAL PERMIT October 25, 1994 Four-Sher Development 990 Highland Drive, Suite 202 Solana Beach, CA 92075 SUBJECT: PIP 94-02 - CARLSBAD AIRPORT' CENTER - LOT 36 The City has completed a* review of the application for a Planned Industrial Permit for development located east of Camino Vida Roble on the north side of Kellogg Avenue in the Carlsbad Airport Center. It is the Planning Director's determination that the project is consistent with the City's Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City ordinances and policies. The Planning Director, therefore, APPROVES of this request based on the following: Findinas: 1. The site indicated by the Planned Industrial Permit is adequate in size and shape to accommodate the proposed use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required by this chapter. 2. The improvements indicated on the Planned Industrial Permit are located in such a manner to be related to existing and proposed streets and highways. 3. The improvements as shown on the Planned Industrial Permit are consistent with the intent and purpose of this zone and all adopted development, design, and performance standards as set forth in this chapter. 4. Unless otherwise stated, this industrial project shall comply with all applicable City Ordinances and requirements. 5. The uses, improvements, and architecture as shown on the Planned Industrial permit are consistent with the intent and purpose of the Planned Industrial Zone and all adopted development design and performance standards aa set forth in the PM zone, and Specific Plan 181 (A). 6. The project is consistent with the McClellan-Palomar Airport Comprehensive Land Use Plan as determined by the San Diego Association of Governments. 7. This project will not cause any significant environmental impacts and a Negative Declaration has been APPROVED by the Planning Director on September 28,1994. In approving this Negative Declaration the Planning Director has considered the initial study, the staff analysis, all required mitigation measures and any written 2075 Las Palmas Drive - Carlsbad, California 92009-1 576 - (61 9) 438-1 161 6B c. PIP 94-02- FOUR-SHER DEVELOPMENT OCTOBER 25,1994 PAGE 2 comments received regarding the significant effects this project could have on the environment. 8. The Planning .Director has, by inclusion of an appropriate condition to this project, ensured building permits will not be issued for the project unless the District Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains available, and the Planning Commission is satisfied that the requirements of the Public Facilities Element of the General Plan have been met insofar as they apply to sewer service for this project. 9. The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public. facilities will be available concurrent with need as required by the General Plan. 10. The applicant is by condition, required to pay any increase in public facility fee, or new construction tax, or development fees, and has agreed to abide by any additional requirements established by a Local Facilities Management Plan prepared pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will ensure continued availability of public facilities and will mitigate any cumulative impacts created by the project. 11, This project is consistent with the City's Growth Management Ordinance as it has been conditioned to comply with any requirement approved as part of the Local Facilities Management Plan for Zone 5. 12. The project is consistent with the C'ity's landscape policies as it has been conditioned to comply with the requirements of the Landscape Manual. Planning Conditions: 1. Approval is granted for PIP 94-02 as shown on Exhibit8 W-T, dated October 25, 1994, on file in the Planning Department and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. The developer shall provide the Ci with a reproducible 24' x W, mylar copy of the site plan as approved by the Planning Director. The site plan shall reflect the conditions of approval by the City. The plan copy shall be submitted to the City Engineer and approved prior to building, grading, final map, or improvement plan submittal, whichever occurs first. 3. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the District Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This project is also approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on July 28, 1987 (amended July 2, 1991) and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system of facilities and improvement plan and to fulfill the subdivider's agreement to pay the public facilities fee dated September 2,1994, a copy of which is on file with the City Clerk and is incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this project will be void. 5. Water shall be provided by the Carlsbad Municipal Water District. 6. This project shall comply with all conditions and mitigation measures which may be required as part of the Zone 5 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. 7. If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 65913.5. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. 8. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable Ci ordinances in effect at time of building permit issuance. 9. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. 10. Prior to the issuance of the building permit there shall be a Notice of Restriction placed on the deed to this property subject to. the satisfaction of the Planning Director notifying all interested partiss and successors in interest that the City of Carlsbad has issued a Planned Industrial Permit on the real property owned by the declarant. Said deed restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specifii for inclusion in the deed restriction. Said deed restriction@) may be modified or terminated only with the approval of the Planning Director, Planning Commission or City Council of the City of Carlsbad whichever has final decision authority for this project. 11. Trash receptacle areas shall be enclosed by a six-foot high masomy wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. Enclosure shall be of similar colon and/or materials to the project to the satisfaction of the Planning Director. 12. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered 'from adjacent properties and 4 PIP 94-02 - FOUR-SHER DEVELOPMENT OCTOBER 25,1994 PAGE 4 streets, in substance as provided in Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building. 13. 1 4. 15. 16. 17. 18. 19. 20. 21. 22. 23. 24. 25. An exterior lighting plan including parking areas shall be submitted for Planning Director approval. All lighting shall be designed to reflect downward and avoid any impacts on adjacent homes or property. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the approval of grading or building plans, whichever occurs first. All landscaped areas shall be maintained in a heatthy and thriving condition, free from weeds, trash, and debris. All landscape and Irrigation plans shall be prepared to conform with the Landscape Manual and submitted per the landscape plan check procedures on file in the Planning Department. The applicant shall pay a landscape plan check and inspection fee as required by Section 20.08.050 of the Carlsbad Municipal Code. The first set of landscape and irrigation plans submitted shall include building plans, improvement plans and grading plans. Any signs proposed for this development shall at a minimum be designed in conformance with the City's Sign Ordinance and Specific Plan 181 (A) and shall require review and approval of the Planning Director prior to installation of such signs. Building identirition and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. All us08 established in this structure shall be consistent with Section 21 34.020 (Permitted Uses) of the Carlsbad Municipal Code. Unlem otherwise stated, this industrial project shall comply with all applicable City ordinance8 and requirements, including the requirement8 and 8tandards of Specific Plan 181 (A). The project shall comply with the latest disabled acces8 requirement8 in effect at the time of building permit application. Prior to the imuance of building permit8 the owner of record of the property shall prepare and record a notice (form on file in the Planning Department) that - PIP 94-02 - FOUR-SHER DEVELOPMENT OCTOBER 25,1994 PAGE 5 this property is subject to overflight, sight, and sound of aircraft operating from Palomar Airport. The notice shall be prepared in a manner meeting the approval of the Plqnning Director and the City Attorney. 26. 27. All tenant improvements and uses for the building shall be constructed per the parking ratio shown on Exhibits "A='lm, dated October 25, 1994 on file in the Planning Department. Land uses requiring a greater amount of parking shall not be permitted. Prior to approval of a building permit the applicant shall record a deed restriction on the grant deed of the property noting that the tenant improvement and land use Is restricted by the parking ratios shown on the project's approved site plan (Exhibits 'A' - "13. Prior to approval of the building permit the applicant shall obtain the approval from the Carlsbad Airport Center Owners Association in regards to project compliance with the Carlsbad Airport Center Architectural Guidelines. Enalneerlna Conditions: 20. 29. 30. 31. 32. 33. 34. 35. 36. This project is located within the Carlsbad Airport Centre Speciflc Plan. All development design shall comply with the requirements of that plan. Unless a standards variance has been issued, no variance from City Standards is authorized by virtue of approval of this site plan. The applicant shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. The applicant shall be responsible for coordination with S.D.G.&E., Pacific Bell Telephone, and Cable TV authorities. Prior to grading or building permit lsaance, the applicant shall pay all current fees and deposits required. Prior to approval of the grading or building permit, the owner of the subject property shall execute an agreement holding the City harmless regarding drainage across the adjacent property. Pretreatment of the sanitary sewer discharge from this project may be required. In addition to the requirements for a sewer connection permit the applicant shall conform to the requirements of Chapter 13.1 6 of the Carisbad Municipal Code. The applicant shall apply for an industrial waste water discharge permit concurrently with the building permit for this project. Prior to the issuance of a grading permit or building permit, whichever occurs first, the developer shall submit proof that a Notice of Intention has been submitted to the State Water Resources Control Board. Based upon a review of the proposed grading and the grading quantities shown on the site plan, a grading permit this project is required. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, the applicant shall submit to receive approval from the City Engineer for the proposed haul route. The applicant shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. The developer shall exercise special care during the construction phase of this project to prevent offsite sittation. Planting and erosion control shall be provided in accordance with the Carlsbad Municipal Code and the City Engineer. Reference Chapter 1 1.06. Additional drainage easements may be required. Drainage structures shall be provided or installed prior to or concurrent with any grading or building permit as may be required by the City Engineer. The applicant shall comply with the City's requirements of the National Pollutant Discharge Elimination System (NPDES) permit. The applicant shall provide best management practices to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such improvements shall be approved by the City Engineer prior to issuance of grading or building permit, whichever occurs first. In accordance with the City standard that parking stalls shall not be located within or served by a driveway queuing area, the three parking stalls located directly across from the driveway apron shall be eliminated on the site pian. Prior to issuance of building permits, complete building plans shall be approved by the Fire Department. Additional On-site public water mains and fire hydrants are required. The applicant shall submit a site plan to the Fire Department for approval, which depicts location of required, proposed and existing public water mains and fire hydrants. The plan should include off-site fire hydrants within 200 feet of the project. Applicant shall subrnii a site plan depicting emergency aoc8ss routes, driveways and traffic circulation for Fire Department approval. An all weather, unobstructed access road suitable for emergency service vehicles shall be provided and maintained during construction. Fire Chief, the access road has become unserviceable due to inclement weather or other reasons, he may, in the interest of public safety, require that construction operations cease until the condition is corrected. All .required fire mains, fire hydrants, and appurtenances shall be operational before combustible building materials are located on the construction site. Plans and/or specifications for fire alarm systems, fire hydrants, automatic fire sprinkler systems and other fire protection systems shall be submitted to the Fire Department for approval prior to construction. An approved automatic fire sprinkler system shall be installed in buildings having an aggregate floor area exceeding 10,OOO square feet. The automatic fire sprinkler system shall be designed to allow the buiiding to accommodate high-piled or high rack storage. Carlsbad Municipal Water District Conditions: 51. 52. 53. 54. The entire potable water system, reclaimed water system and sewer system shall be evaluated in detail to insure that adequate capacity, pressure and flow demands can be met. The Developer shall be responsible for all fees, deposits and charges which will be collected before and/or at the time of issuance of the building permit. The San Diego County Water Authority capacity charge will be collected at issuance for meter installation. Sequentially, the Developer's Engineer shall do the following: A. Meet with the City Fire Marshall and establish the fire protection requirements. Also obtain G.P.M. demand for domestic and irrigational needs from appropriate parties. 6. Prepare a colored reclaimed water use area map and submit to the Planning Department for processing and approval. C. Prior to the preparation of sewer, water and reclaimed water improvement plans, a meeting must be scheduled with the District Engineer for review, comment and approval of the preliminary system layouts. and usages (ie GMP - EDU). This project is approved upon the expressed condition that building permits will not be issued for development of the subject property unless the water district serving the development determines that adequate water service and sewer facilities are available at the tine of application for such water service and sewer permits will continue to be available until time of occupancy. All aisles, passageways, and recesses related to and within the building, all parking areas, the main entry area an the loading dock areas shall be provided with adequate lighting as determined by the Police Department. All exterior lights shall be pr6tected by weather and vandalism covers. 56. All building doors shall be constructed in accordance with Police Department standards.
