Bradley Avenue, Suite C El Cajon, CA 92020 Attention: Ken Smith SUBJECT: PIP 9443 - AALm SCIENTIFIC LID. The Cfty has completed a review of the application for a Planned Industrial Permit for development located at 1959 Kellogg Avenue. It is the Planning Director's determination that the project is consistent with the Ci's Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City ordinances and policies. The Planning Director, therefore, recommends APPROVAL of this request based on the following: Findincl8: 4) The site indicated by the Planned Industrial Permit !g adequate in size and shape to accommodate the proposed use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required by this chapter. The improvements indicated on the Planned Industrial Permit - located in such a manner to be related to existing and proposed streets and highways. The improvements as shown on the Planned Industrial Permit consistent with the intent and purpose of this zone and all adopted development, design, and performance standards as set forth in this chapter. The project is consistent with all City public facility policies and ordinances since: a) The Planning Director has, by inclusion of an appropriate condition to this project, ensured building permits will not be issued for the project unless the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer senrice remains available, and the Planning Director is satisfied that the requirements of the Public Facilities Element of the General Plan have been met insofar as they apply to sewer senrice for this project. b) School fees will be paid to ensure the availability of school facilities in the Carlsbad School District. c) Park-in-lieu fees are required as a condition of approval. d) All necessary public improvements have been provided or will be required as conditions of approval. 2075 Las Paimas Drive - Carisbad. California 92009-1 576 - (61 9) 438-1 161 Page 2 e) The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General Plan. 9 Assurances have been given that adequate sewer for the project will be provided by the city of Carlsbad. The proposed project is compatible with the surrounding future land uses since surrounding properties are designated for Planned Industrial development on the General Plan. Staff determined through review and analy48 of the initial 8hrdy that thi8 project will not cause any significant environmenQl impact8 and the Plannlng Director ha8 determlned that the project ha8 already been conddered in conjunction 4th previously certifled environmental documents (EiR 814) and therefore, no additional environmental review i8 required. The applicant is by condition, required to pay any increase in public facility fee, or new construction tax, or development fees, and has agreed to abide by any additional requirements established by a Local Facilities Management Plan prepared pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will ensure continued availability of public facilities and will mitigate any cumulative impacts created by the project. This project is consistent with the CWs Growth Management Ordinance as it has been conditioned to comply with any requirement approved as part of the Local Facilities Management Plan for Zone 5. Condition8: Planninq: Approval is granted for PIP 94-03 as shown on Exhibas 'AT, dated December 6, 1994, on file in the Planning Department and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. All uses established in this structure shall be consistent with Section 21.34.020 (Permitted Uses). Unless otherwise stated, this industrial project shall comply with all applicable City ordinances and requirements. The developer shall provide the City with a reproducible 24' x 36', mylar copy of the Site Plan as approved by the Planning Commission. The Site Plan shall reflect the conditions of approval by the City. The plan copy shall be submitted to the City Engineer and approved prior to building, grading, or improvement plan submittal, whichever occurs first. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the District Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. 7) 9) ,, 10) ~ 11) 13) Page 3 This project is also approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on July 28, 1987 (amended July 2, 1991) and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or facilities and improvement plan and to funill the subdivider‘s agreement to pay the public facilities fee dated September 6,1994, a copy of which is on file with the Ci Clerk and is incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this project will be void. The applicant shall provide school fees to mitigate conditions of overcrowding as part of building permit application. These fees shall be based on the fee schedule in effect at the time of building permit application. This project shall comply with all conditions and mitigation measures which may be required as part of the Zone 5 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. Prior to issuance of a building permit the property owner shall pay a one-time special development tax in accordance with Ci Council Resolution No. 91-39. If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 6591 3.5. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance. Prior to the issuance of the building permit there shall be a Notice of Restriction placed on the Deed to this property subject to the satisfaction of the Planning Director notifying all interested parties and successors in interest that the City of Carlsbad has ‘wed a Planned Industrial Permit on the real property owned by the declarant. Said Notice of Restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specified for inclusion in the Notice of Restriction. The restrictions referred to in said notice may be modified or terminated only with the approval of the Planning Director, Planning Commission or City Council of the City of Cadsbad whichever has final decision authority for this project. Trash receptacle\recycling bln areas shall be enclosed by a &foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. Enclosure shall be of similar colors and/or materials to the project to the satisfadon of the Planning Director. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, in substance as provided in Building Department Poky No. 806, to the satisfaction of the Directors of Planning and Building. Page 4 <& ' An exterior lighting plan including parking areas shall be submitted for Planning Dimor approval. All lighting shall be designed to reflect downward and avoid any impacts on adjacent homes or property. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director. The applicant shall prepare a detailed landscape and irrigation plan which shall be submttted to and approved by the Planning Director prior to the approval of grading or building plans, whichever occurs first. Ail landscape plans shall be prepared to conform with the Landscape Manual and submitted per the landscape plan check procedures on file in the Planning Department. The area between the loading apace and the lunch area 8hall be landataped with planter8 that will adequately screen the loading apace from the employees' vlew when seated at the outdoor eating area. Any signs proposed for this development shall at a minimum be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Planning Director prior to installation of such signs. A uniform sign program for this development shall be submitted to the Planning Director for his review and approval prior to occupancy of any building. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. As part of the plans submttted for building permit plan check, the applicant shall include a reduced version of the approving resoiutiorJresolutions on a 24' x 36' blueline drawing. Said blueline drawing@) shall also include a copy of any applicable Coastal Development Permit and signed approved site plan. The applicant is aware that the City is preparing a non-residential housing impact fee (linkage fee) consistent with Program 4.1 of the Housing Element. The applicant is further aware that the City may determine that certain non-residential projects may have to pay a linkage fee, in order to be found consistent with the Housing Element of the General Plan. If a linkage fee is established by Ci Council ordinance and/or resolution and this project becomes subject to a linkage fee pursuant to said ordinance and/or resolution, then the applicant for this project, or his/her/their successor(s) in interest shall pay the linkage fee. The linkage fee shall be paid at the time of issuance of building permits, except for projects involving a request for a non- residential planned unit development for an existing development, in which case, the fee shall be paid on approval of the final mep, parcel map or certificate of compliance, required to process the non-residential PUD, whichever pertains. If linkage fees am required for this project, and they are not paid, this project will not be consistent with the General Plan and approval for this project will become null and void. The notice rhall be prepared In a manner meeting the approval of the Planning Director and the Clty Attorney. The bulldlng'8 exterior colors and material8 shall match the Color8 and material8 of Exhibit "H.. Endneering: This project is located within the Carlsbad Airport Centre Specific Plan. All development design shall comply with the requirements of that plan. Unless a standards variance has been issued, no variance from Ci Standards is authorized by virtue of approval of this site plan. The applicant shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding senrices to the project. The applicant shall be responsible for coordination with S.D.G.&E., Pacific Bell Telephone, and Cable TV authorities. Prior to grading or building permit issuance, the applicant shall pay all current fees and deposits required. Prior to approval of the grading or buildlng permit, the owner of the subject property shail execute an agreement holding the City harmless regarding drainage across the adjacent Property. Pretreatment of the sanitary sewer discharge from this project may be required. In addition to the requirements for a sewer connection permit the applicant shall conform to the requirements of Chapter 13.1 6 of the carisbad Municipal Code. The applicant shall apply for an industrial waste water discharge permit concurrently with the building permit for this project. Based upon a review of the proposed grading artd the grading quantities shown on the site plan, a grading permit for this project is required. Prior to issuance of a building permit for the project, a grading permit 8hall be obtained and grading work be completed in 8ubrtantial conformance with the approved grading plana. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, the applicant shail submit to and receive approval from the Ci Engineer for the t '1 I 1 Pago 8 proposed haul route. The applicant shall comply with all conditions and requirements the City Engineer my impose with regards to the hauling operation. The developer shall exercise special care during the construction phase of this project to prevent offsite siltation. Planting and erosion control shall be provided in accordance with the Carlsbad Municipal Code and the City Engineer. Reference Chapter 11.06. Additional drainage easements may be required. Drainage structures shall be provided or installed prior to or concurrent with any grading or building permit as may be required by the City Engineer. The applicant shall comply with the City's requirements of the National Pollutant Discharge Elimination System (NPDES) permit. The appli shall provide best management practices to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such improvements shall be approved by the City Engineer prior to issuance of grading or building permit, whichever occurs first.
