Dear Christer:
Once again, thank you for taking time fiom your busy schedule to discuss the above referenced
project with Scott Merry and myself. We are pleased the project has been passed along fiom
Terri to another planner with knowledge of the project’s history. In an attempt to expedite the
balance of the processing issues requiring resolution, I thought it might be helpful to summarize
the pertinent points of our discussion this afternoon. Obviously, we are anxious to commence
the grading of the site as soon as possible, especially considering the potentially wet winter
predicted by most forecasts.
I have broken down our discussions of this afternoon into four categories. These are (i) PIP /
PUD / HDP processing and Negative Declaration processing - Lot 1 1, (ii) Engineering
Department Plan Check of Grading Plan, (iii) processing and approval of landscape plans, and
(iv) Conditional Use Permit requirement for Lot 7.
PIP / PUD / HDP and Negative Declaration - Lot 11
Before leaving your office today, Ken Quon passed along his formal comments on the above
referenced PIP / PUD / HDP submittals. In reviewing both the Planning and Engineering
Department’s comments on these submittals, it appears the information required by both
departments to deem the application complete are minor in nature. We will be prepared to re-
submit the plans with all requested additional information and clarifications on or before
Wednesday, September 10, 1997. As we discussed this afternoon, we would greatly appreciate
your drafting your findings of the Environmental Impact Assessment between now and the time
of our re-submittal so that upon your deeming our application complete, the Negative
Declaration can be noticed immediately. We would also request your expeditious review of our
re-submitted PIP package next week.

Engineering Department Plan Check of Grading Plan
As we discussed this afternoon, the Engineering Department has halted the processing of our
submitted grading plan for Lots 7, 8 and 1 1, as Terri was uncomfortable reviewing the grading
plans until such time as the PIP / PUD / HDP applications were approved by the Planning
Department. While we understand these applications need to be approved prior to issuance of a
grading permit, we respectfully request the Planning Department’s concurrent review of the
grading plan with the above referenced land use applications. As you stated this afternoon, this
would appear feasible, dependent, of course, upon the Engineering Department’s comments on
the PIP / PUD / HDP submittals. I think you would agree that Ken Quon’s response to the
submittals does not require any major re-design of the project. The concurrent processing of the
grading plan, and the above referenced applications, would provide for the issuance of a grading
permit at a much earlier date than if the grading plan had to wait until the PIP / PUD / HDP’s
were finalized.
Landscape Plans
During our conversation, you informed us that it is standard policy that landscape plans must be
approved prior to grading permit issuance. We have submitted a Landscape Plan / Erosion
Control Plan for the slopes in and around Lots 7,8 and 1 1. We are hopeful that upon approval of
these perimeter slope landscape plans, a grading permit can be issued. We would request that the
grading permit issuance be contingent upon approval of these perimeter slope landscape plans,
and that the building permit issuance be contingent upon approval of the on-site landscape plans.
The on-site landscape plan construction documents will be submitted to the City prior to the end
of next week.
Conditional Use Permit Requirement For Lot 9
Lastly, we discussed whether or not the development of an office building on Lot 7 would
require the processing of a Site Development Plan (“SDP”) and a Conditional Use Permit
(“CUP”) through the Planning Commission. It was our understanding from Mr. Holzmiller last
May that the development of a professional office building on Lot 7 would not require an SDP or
CUP. We would ask that you review the Carlsbad Airport Centre’s Specific Plan (SP 181-A)
and provide us written confirmation of whether of not the SDP or CUP will be required for Lot 7.
These are the issues of utmost concern needing resolution so that a grading permit can be issued
in a timely manner. We very much appreciate the cooperation extended to us by Terri Woods
and Gary Wayne over the past several months, and once again request the Planning Department’s
assistance to help facilitate delivery of this office space to our Carlsbad-based tenant. Again,
thank you for taking time to discuss these issues with us and we look forward to working
expeditiously with the City of Carlsbad to conclude these land use applications.
