Dear Ms. Hysong:
As you are aware, the Newton Business Center was approved by the City's Planning Commission
on 6 May 1998. One of the conditions of approval is:
". . . provide evidence of the purchase for preservation of 0.78 acres of coastal sage scrub
habitat in the Manchester Environmental Land Bank . . . and approval of a 4d Permit from
the City of Carlsbad . . ." [Environmental Mitigation Monitoring and Reporting Program,
page 1 of 2, item l(a)]
The purchase of the requisite coastal sage scrub mitigation area was accomplished in January of this
Year. Please find attached a copy of the receipt issued by Tech-Bilt, Inc. for the purchase.
We would request that the City issue the appropriate 4(d)-permit for the project. As you are aware,
this project has previously been addressed in detail with both the Fish and Wildlife Service and the
California Department of Fish and Game and both agencies have concurred in the treatment of the
Coastal Sage Scrub loss as "de minimus."
If we can provide any additional information please do not hesitate to contact me directly. Thank you
for your time and assistance with this matter.
