Irish Carlsbad Summit, LLC Suite 200 11 260 El Camino Real San Diego CA 921 30-2647 SUBJECT: PIP 99-03 - CARLSBAD AIRPORT CENTER - LOT IO The City has completed a review of the application for a Planned Industrial Permit for development located on the west end of Owens Avenue, adjacent and north of Palomar Airport Road, and within Local Facilities Management Zone 5. Property is also identified as Assessor's Parcel Number 21 1-092-1 5-00. It is the Planning Director's determination that the project is consistent with the City's Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City ordinances and policies. The Planning Director, therefore, approves this request based on the following: Findings: 1. The site indicated by the Planned Industrial Permit is adequate in size and shape to accommodate the proposed use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required by this chapter in that the project meets the development standards of the Carlsbad Airport Centre Specific Plan (SPI 81 (A)) and the P-M zone. 2. The improvements indicated on the Planned Industrial Permit are located in such a manner to be related to existing and proposed streets and highways in that the project takes access from Owens Avenue and the buildings face onto Palomar Airport Road. 1635 Faraday Avenue - Carlsbad, CA 92008-7314 - (760) 602-4600 0 FAX (760) 602-8559 @ I c PIP 99-03 - CARLSBAD AIRPORT CENTRE - LOT 10 . The improvements as shown on the Planned Industrial Permit are consistent with the intent and purpose of this zone and all adopted development, design and performance standards as set forth in this chapter in that the project is an allowed use and complies with the development standards of the Carlsbad Airport Centre Specific Plan (SPI 81 (A)). 4. The Planning Director of the City of Carlsbad does hereby find: A. He has reviewed, analyzed and considered the Negative Declaration and the environmental impacts therein identified for this project and any comments thereon prior to APPROVING the project; and B. The Negative Declaration has been prepared in accordance with requirements of the California Environmental Quality Act, the State Guidelines and the Environmental Protection Procedures of the City of Carlsbad; and C. It reflects the independent judgment of the Planning Director of the City of Carlsbad; and D. Based on the EIA Part I1 and comments thereoh, there is no substantial evidence the project will have a significant effect on the environment. 5. The project is consistent with the City-Wide Facilities and Improvements Plan, the Local Facilities Management Plan for Zone 5 and all City public facility policies and ordinances. The project includes elements or has been conditioned to construct or provide funding to ensure that all facilities and improvements regarding: sewer collection and treatment; water; drainage; circulation; fire; schools; parks and other recreational facilities; libraries; government administrative facilities; and open space, related to the project will be installed to serve new development prior to or concurrent with need. Specifically, A. The project has been conditioned to provide proof from the Carlsbad School District that the project has satisfied its obligation for school facilities. B. The Public Facility fee is required to be paid by Council Policy No. 17 and will be collected prior to the issuance of building permit. C. The Local Facilities Management fee for Zone 5 is required by Carlsbad Municipal Code Section 21.90.050 and will be collected prior to issuance of building permit. That the project is consistent with the City's Landscape Manual (Carlsbad Municipal Code Section 14.28.020 and Landscape Manual Section I B). Conditions: 1. Approval is granted for PIP 99-03 as shown on Exhibits "A" - "T", dated May 3, 2000, on file in the Planning Department and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. All uses established in this structure shall be consistent with Section 21 -34.020 (Permitted Uses). 3. This approval is granted subject to the approval of the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program, CT 99-20, and PUD 99-09 and is subject to all conditions contained in Planning Commission Resolutions No. 4767and 4768 for those other approvals.
