Dear Mr. Westerman,
Please find enclosed the revised sign criteria for Los Coches Shopping Center. We
have generally reflected the corrections to the first submittal as suggested.
The monument sign has been reduced to six (6') feet in height and we have complied
with the ordinance limiting the maximum sign area to fifty (50) square feet. The base
and frame of the sign are extensions of the material board and color palette for the
Center and reflect the quality and richness of architecture of this project.
We are requesting approval of the revised sign criteria at this time. It is our
understanding that your approval will not eliminate or diminish a tenant's ability to make
application for an amendment, seek a variance or subsequently appeal their sign
request as provided for in the City ordinance.
Your earliest consideration of this submittal is greatly appreciated. Should you have any

Dear Christer,
This letter is a follow up to our letter of January 12th, 2005. We have reviewed City of Carlsbad
Zoning Ordinance, Chapter 21.41 Sign Ordinance, including the sections specifying
requirements for commercial centers and free standing commercial buildings. Based on our
review, there appears to have been a misunderstanding regarding the ability to appeal a
decision.
Contrary to the understanding expressed in my previous letter, Section 21.41.060 "D" - Method
of Review; states "the decision of the Community Development Director is appealable pursuant
to this chapter". In addition in this same section, Item "F" - Amendments; indicates it is possible
to make application to amend an approved sign program. Section 21 .41.125 "Appeal of denial
or revocation"; defines the process for appeal to the planning commission and city council, if
deemed necessary.
Conditions of Approval relating to Los Coches Village require an approved project sign program
before release of building permits. Due to our need to obtain building permits, CWC will not
delay the processing of the Project Sign Program any further.
We have directed our sign consultant, Stanford Sign and Awning, to revise and resubmit our
application including the exhibits. The revised submittal will incorporate your comments and the
clarifications we discussed during our meeting on January 12th 2005. The revised exhibits will
show the maximum height of the sign letters for the anchor tenants to be 36 inches.
Once approved, the anchor tenants may make application for their individual sign permits. At
their own discretion, the tenant's application may include a request to amend the approved
project sign program for the purposes of seeking larger sign height and or sign area. Their
ability to seek an amendment is described in Section 21.411.060; Item "0" - Method of Review";
Item "F" - Amendments and Section 21 .41.125 Appeal of denial or revocation. In addition, we
are aware that Section 21.51.010 describes the authority of the planning director to grant certain
variances and Section 21.51.020 describes the extent and limitations for such variances if
granted.
It is our understanding that approval of the Project Sign Program at this time will not in any way
eliminate or diminish the tenant's ability to make application for an amendment, seek a variance
or subsequent appeal process described in the ordinance.
Please review our understanding of the ordinance, and contact me immediately if my
understanding requires clarification. I can be reached at my office at (858) 452-7170 x316.
Otherwise, we will proceed as described above.

Dear Christer,
Thank you for meeting with Jeff Rogers and me today to discuss the City of Carlsbad Sign Ordinance and
the proposed Project Sign Criteria dated 10-22-04 for Los Coches Village Shopping Center MS 02-08.
We discussed that portion of the proposed Project Sign Criteria as requested by the anchor tenant,
Henry's Marketplace. Henry's Marketplace requested 72 inch high letters over the main entry and on the
side elevation of their store. Based on your review of the City of Carlsbad Sign Ordinance section
21.41.070.A.2, the maximum height of any sign or individual letter of a sign may not exceed 36 inches.
Further, the total area of an individual tenant signs is limited based on the percentage of the tenant's
frontage.
The Project Sign Criteria submittal referenced above included Henry's request to propose
72 inch high letters. The review of the submittal resulted in comments, including Henry's proposed sign
height, which require corrections and resubmittal before approval may be granted. We will make the
appropriate revisions and submit early next week.
In addition, we discussed if there was any available process which would provide an opportunity to appeal
or request a deviation/variance from the ordinance in order to obtain approval for a taller sign. Based on
our discussion today, it is my understanding the ordinance does not have a provision or process to
consider a request for deviation from the sign height or area limitation.
If my understanding of our discussion is incorrect, please contact me to discuss. Otherwise please sign
the acknowledgement below and return (fax) a copy to my office for our records.
