INSTRUCTIONS:
To address post-development pollutants that may be generated from development projects, the City requires that new development and
significant redevelopment priority projects incorporate Permanent Storm Water Best Management Practices (BMP's) into the project
design per the City's Standard Urban Stormwater Management Plan (SUSMP). To view the SUSMP, refer to the Engineering Standards
(Volume 4, Chapter 2) af mM..:.iMiS!ba;i<:aM?^MW!iMM-
Initially this questionnaire must be completed by the applicant in advance of submitfing for a development application (subdivision,
discretionary permits and/or construction permits). The results of the questionnaire determine the level of stonti water standards that
must be applied to a proposed development or redevelopment project. Depending on the outcome, your project will either be subject to
'Standard Stormwrater Requirements' or be subject to additional criteria called 'Priority Development Project Requirements'. Many
aspects of project site design are dependent upon the storm water standards applied to a project.
Your responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts. City staff has
responsibility for making the final assessment after submission of the development application. If staff detenrtines that the questionnaire
was inconectly filled out and is subject to more stringent storm water standards than initially assessed by you, this vwl! result in the return
of the development application as incomplete. In this case, please make the changes to the questionnaire and resubmit to the City.
If you are unsure about the meaning of a question or need help in determining how to respond to one or more of the questions, please
seek assistance from Land Development Engineering staff.
A separate completed and signed questionnaire must be submitted for each new development application submission. Only one
completed and signed questionnaire is required when multiple development applications for the same project are submitted concurrently.
In addition to this questionnaire, you must also complete, sign and submit a Project Threat Assessment Form vwth construction permits
for the project

If you answered "yes" to one or more of the above questions, then your project is NOT a priority development project and therefore is

from the prefect to the ESA, or conveyed in a pipe or open channel any distance as an Isolated flow from the
project to the ESA (i.e. not commingles with flows from adjacent lands).*

facility that is categorized in any one of ttie following Standard Industrial aass/featfon (SIC) codes: 5013,
5014, 5541, 7532-7534, or 7536-7539.

The engineering department has completed its review of the project. The engineering
department is recommending that the project be approved, subject to the following conditions:
Engineering Conditions
NOTE: Unless specifically stated in the condition, all of the following conditions, upon the
approval of this proposed development, must be met priorto approval of a right-of-way pernnit
or building permit, whichever occurs first.
General
1. The developer shall demonstrate that a minimum sidewall< clearance of 4 feet be
maintained.
35. Developer shall complete and submit to the city engineer a Project Threat Assessment
Form (PTAF) pursuant to City Engineering Standards. Concurrent with the PTAF,
developer shall also submit the appropriate Tier level Storm Water Compliance form
and appropriate Tier level Storm Water Pollution Prevention Plan (SWPPP) as
determined by the completed PTAF all to the satisfaction ofthe city engineer. Developer
shall pay all applicable SWPPP plan review and inspection fees per the city's latest fee
schedule.
2. Developer shall obtain an approved right-of-way permit prior to installation of the
sign. With said application, developer shall submit for review and approval
engineered construction plans, specifications, details and structural calculations for
the proposed sign structure.

I couldn't find a city or state "standard" for this. What I found was a FHWA criteria to provide at least 1-foot clearance
above the highest allowable vehicle, which varies from state to state. The highest allowable vehicle height in California is
14' 3". 14' 3" plus one foot rounded to the nearest foot is 16 feet. I think 16' of vertical clearance is appropriate.

The proposed monument sign looked ok to me. If the sign dimensions change or if the proposed location changes, we
need to make sure that the sign does not block the southbound traffic signal indications from approaching vehicles. The
assumptions I used to check the proposed location/dimension are as follows:
• minimum stopping sight distance for 35 mph is 250 feet
• bottom of signal indication is 17' feet above roadway
• eye height for motorists varies from 3' to 10' high

At its Dec. 5'^ meeting, the Carlsbad Arts Commission considered the Carlsbad sign proposed as
a donation to the city by the Carlsbad Chamber of Commerce and TaylorMade Golf. The
Commission voted unanimously to reject the proposed donation. This action was taken in
accordance with the Arts Commission's established artwork donation policies and procedures.
Background
• The city received a proposal for a Carlsbad sign from the Carlsbad Chamber of
Commerce to be located at the intersection of Carlsbad Blvd. and Carlsbad Village Drive.
• The proposal incorporated artistic and aesthetic elements including an artwork by the
artist Wyland.
• The proposal was forwarded to the Cultural Arts Office for review by the Arts
Commission.
• Under Carlsbad Municipal Code 2.18.100 the Arts Commission's role is to ". . . (8)
Recommend to City Council all works of art to be acquired by the city, either by
purchase, gift or otherwise, and their proposed locations. (9) Recommend to City
Council regarding the conservation, restoration, relocation or disposition of works of art
in the city's possession". (Ord. No. CS-124, § 11,4-5-2011)
Artwork Donation Review and Approval
• The process for the consideration of donated works of art is outlined in the Donation of
Art Policies (rev 7/24/12) as adopted by the Arts Commission.
• The policy outlines the review and approval of donated works of art which include:
establishment of an advisory committee; review of the proposal by the advisory
committee based on criteria including aesthetic quality, professional credentials,
suitability, maintenance, feasibility, appropriateness of site and maintenance; and
referral of the advisory committee findings and recommendations to the Arts
Commission for review and determination.
• In the event the Arts Commission rejects a donation offer, it is returned to the donor
and not recommended to Council for consideration.

Process
• On Nov. 14, 2013, an advisory committee for the Carlsbad sign donation proposal was
convened to review and make recommendations to the Arts Commission.
• The committee was made up of stakeholders, residents, public art professionals. Arts
Commission members and city staff as specified in the Arts Commission's policy.
• The committee voted unanimously to recommend rejection of the proposal to the Arts
Commission.
• A report outlining the committee's findings and recommendations was prepared and
forwarded to the Arts Commission for its review, and is attached.
• The Arts Commission reviewed the findings and voted unanimously to reject the
proposal and return it to the donor.
Under the policies governing donated artworks, there is no process for appeal of the Arts
Commission's action rejecting the current proposal. CMC 1.20.600 does provide an appeals
process as follows: "Where no specific appeals procedure exists for any decision of a
commission, committee or person which substantially affects the rights, duties or privileges of
an aggrieved person, such decision may be appealed to the city council by filing a written notice
of appeal with the city clerk within ten calendar days of the date of the decision."

The Public Art Advisory Committee met on Thursday, November 14, 2013. The committee was made up
of stakeholders, residents, public art professionals, arts commissioners and city staff. The committee
included: Tina Schmidt - Chair,Carlsbad Arts Commission; Sherman DeForest, Carlsbad Arts
Commissioner; Dana Springs, Interim Executive Director San Diego Commission for Arts & Culture;
Michael Stutz, Public Artist; Marty Volla, Village Association Co-chair/ Village Resident; Susan
Gutierrez, Carlsbad Historian. City staff supporting the committee included: Vincent Kitch, Cultural Arts
Manager; Karen McGuire, Cannon Art Gallery Curator; Bryan Jones, Engineering Manager; Peder
Norby, Special Project Consultant; and Pam Drew, City Planner.
The committee was given background on the sign donation proposal and instructions regarding the
artwork donation process and their role. The committee was provided with plans and large scale images
of the proposal. The committee discussion included artistic and aesthetic elements, design of the sign,
construction materials, and historical significance.
They acknowledged the generous donation of funding by TaylorMade Golf and noted the support of
Chamber of Commerce for their pride in the city and their continued efforts to highlight the great aspects
of Carlsbad. The committee appreciated the idea of a sign to highlight the Village and act as a potential
way-fmding for city residents and visitors.
Recommendation: The Public Art Advisory Committee recommended the city thank the Carlsbad
Chamber of Commerce and TaylorMade Golf, and see if they would consider funding a redesign ofthe
sign and an open call for an artist to create a sign unique to the City of Carlsbad and consider relocating
the sign to a more appropriate location where it could function more as way-fmding for the Village.
Action Taken: The committee voted unanimously not to recommend the sign design proposal as
submitted. In addition, the committee considered a second motion related to the Carlsbad sign proposal
without inclusion of the bronze Wyland dolphin element and that motion was also unanimously rejected.

Below are some of the concerns expressed by the committee:
The dolphin design-
• It is artwork of a commercial corporation.
• This exact dolphin porthole can be purchased on-line. It is part of a series of portholes available.
One committee member reported seeing this design available on the Home Shopping Network.
• The committee is also concerned that Wyland would not be willing to give up copyright to the
work which could cause legal issues in the future should the city want to move or decommission
the sign.
• The dolphin is done in bas-relief or low relief sculpture which is a very difficult process to get a
correct rendering of an animal, face-forward, like this dolphin is depicted.
• The rendering of the dolphin looks incorrect and inaccurate and may not look good from a
distance.
• Other comments regarding the dolphin included: parrot-like, comical, cartoonish, not
sophisticated enough for Carlsbad, not representative of a real dolphin, tacky.
Appropriateness to Carlsbad-
• The work is not specific to Carlsbad. Artwork in the city should be unique to the city.
• Carlsbad has no port or shipyard so a porthole is irrelevant.
• The work is not site specific to Carlsbad or the proposed location.
• Members of committee believe that the city should accept unique works, not reproductions or
works from a series of commercial works.
• This type of sign has a tendency to be photographed extensively and may become iconic for
Carlsbad. They are concemed that the dolphin would become the ad hoc mascot of the city.
• A corporate commercial symbol would not be a good identifier for the City.
Materials-
• Bronze is a poor choice for this application. Bronze in this location may need to be cleaned and
waxed every six months. Access to the bronze elements of the sign would be very difficult and
costly to maintain.
• Bronze leaches as it patinas. The bronze dolphin would bleed onto the other parts of the sign
leaving unsightly streaks and stains.
The design of the sign-
• The design of the overall signs fails on aesthetic quality. It has little or no artistic merit.
• The metal cross bars seem to be out of scale. It is too big and across too large of a roadway.
• The design of the sign is somewhat retro. Members of the committee think of Carlsbad as forward
thinking.
• It is unoriginal; just copying other cities.
• The seals for the chamber and city on the poles are out of scale and much too large.
The appropriateness of the location-
• As proposed the sign does not act as a way-finder into the city or the village.
• Carlsbad Village is moving away from the automotive focus and embracing pedestrians and
bicycles but this sign is more appropriate for motorists.
• Members did not like the visual clutter this sign causes in this intersection.

Dear Pam,
This letter accompanies five full sized copies as well as reduced copies of the revised Carlsbad sign. Also
accompanying this submittal is a photo of a casting of "Darlene the Dolphin". This is photo is provided
so staff and the Arts Commission can get a better understanding of how the casting will appear. The
casting shown in this photo is significantly smaller than five foot in diameter casting that will be located
on top of the sign.
We reviewed the comments in your letter of September 10, 2013 and listened to comments from other
staff members. Based on those comments we have simplified the design ofthe sign and made it similar
to the historic Carlsbad sign.
Exhibit 1 shows the approximate location ofthe sign. We would like to locate it as close to the
intersection of Carlsbad Village Drive and Carisbad Boulevard as possible while still maintaining safe
views ofthe traffic light and minimizing impacts on existing street trees and light posts. We are looking
forward to getting input from Planning and the Engineering Departments as to the optimal location.
Exhibit 2 is a visual simulation of how the sign will appear to motorists driving north on Carisbad
Boulevard.
Exhibit 3 shows the details and dimensions ofthe proposed sign.
Exhibit 4 shows the details ofthe dedication plaque.
Exhibit 5 is a blowup of "Dariene the Dolphin" which will be located on top ofthe sign
Also accompanying this submittal for purposes of scale is a photo of Cariton Lund and the proposed s
Wyland's "Darlene the Dolphin". We are very fortunate that an artist of Wyland's fame is willing to
cooperate on the development of this sign. Once constructed this sign will be a Carisbad landmark for
generations. Motorists will detour through Carisbad to drive under "Dariene the Dolphin". This design
element will barken back to the 1920s-1950s the most prominent era of Highway 101 (now known as
Carisbad Boulevard). This was a time when Americans began to acquire automobiles en-mass and
began exploring our great nation on driving vacations. This era was filled with amazing Art Deco, unique
designs, and what is termed vernacular or iconic architecture with whimsical playful structures such as
tee-pees, dinosaurs and flying saucers. Unfortunately very few of these pieces still exist, the few that do
are greatly treasured such as the Encinitas Boathouses.

The font of the sign ascends to a peak, with a graceful arching at the top of the sign. Both ends of the
sign point inwards towards the porthole framing "Darlene the Dolphin." All of these clues work well
together to lead your eyes towards "Darlene." The Wyland Dolphin element will generate that childlike
whimsy and imagination for future generations of children and will result in a strong memory of their
childhood while driving through Carisbad on the Coast Highway. "OK kids pay attention; here comes the
Carisbad sign with the dolphin."
For older generations, it will serve as a connector to our special place on this earth, next to the sea
where pods of dolphins can be seen playing and surfing our waves almost every day. It will be a
reminder of how important stewardship ofthe ocean is for our future. Families and visitors will walk
under the sign loving the Wyland dolphin on their way to walk on the sea wall and where they will look
for pods of dolphins.
As a part of this proposal at least one kindness meter will be constructed near one ofthe support posts.
Kindness meters similar in design to a parking meter (none of which exist in Carlsbad) will allow people
to make donations to charitable organizations by placing coins or credit cards into the meter. Carisbad
will be known as the City that only has a kindness meter instead of any parking meters. The kindness
meter will be designed to be compatible in appearance to the Carisbad sign.
You and the other staff member's assistance in reviewing this proposal are greatly appreciated. Please
forward this letter along with the exhibits on to the Arts Commission as soon as possible. We are
anxious to get this proposal in front ofthe Commission and City Council as soon as possible with a goal
of erecting this sign as a gift to the City of Carlsbad by the summer of 2014. If you have any questions or

intersection of Carisbad Village Drive and Carisbad Boulevard.
In response to your application, the Planning Division has prepared this comment letter. Please note
that the purpose of a preliminary review is to provide you with direction and comments on the overall
concept of your project. This preliminarv review does not represent an in-depth analvsis of vour
prelect, tt is intended to give vou feedback on critical issues based upon the information provided in
vour submittal. This review is based upon the plans, policies, and standards in effect as ofthe date of
this review. Please be aware that at the time of a formal application submittal, new plans, policies,
and standards mav be In effect and additional issues of concern mav be raised through a more specific
and detailed review.
Planning:
Currently, archway signs within the public rights-of-way are not allowed per the City Council's
Policy No. 65 (Signs on Public Property) and the city's Sign Ordinance (Chapter 21.41 of the
Carisbad Municipal Code). However, an Ordinance (CS-227) for an amendment to Title 11 ofthe
Carisbad Municipal Code is before the City Council now. The amendment will add Chapter 11.44
(Private Party Signs on City Property), which will allow archway signs in the public rights-of-way.
The Ordinance was introduced at the City Council's August 27, 2013 meeting. The Ordinance
adoption is scheduled for the City Council's September 10, 2013 meeting. The Ordinance will go
into effect 30 days after the adoption of the Ordinance.
The city does not have a Corporate Sponsorship policy, which would regulate private entity
logos on city property. Therefore, the Chamber of Commerce logo would not be allowed within
the public right-of-way.
The project requires the following review, approval and permits:
a. Arts Commission: Review and recommendation to the City Council for art elements
proposed forthe sign.

4. Although the sign must be approved by the City Council at a public meeting, staff encourages
you to conduct additional public outreach with the community and downtown merchants.
Further, review of the sign may need to be coordinated with the city's spedal projects
coordinator, Peder Norby. Please contact the Pianning Division for assistance with outreach and
coordination.
5. Prior to the sign permit application submittal; a representative of the city will need to sign the
application as owner of the property. Please contact Skip Hammann, Public Works Director, at
760-602-2751.
6. Please consider a simpler sign design that reflects the character and history of the Village. For
example, a design that more closely resembles the historical sign ofthe 1930's (as shown on the
photo included with your application) would recognize the city's history and could be an iconic
feature in the Village.
The sign's multiple elements give it a "busy" and distracting appearance. The sign could be
simplified by: eliminating extraneous information such as the "Welcome to" and "Village-by-the-
Sea" text; integrating accents and art elements into the sign; and removing the city and chamber
logos from the truss. If the sign Is redesigned please submit a rendering to the Planning Division
for city staff review and comment.
7. Like the sign itself, aesthetic treatment of the supporting structures (truss and poles) is
importiant. The submitted plans lack information as to the pole design (materials, color, etc.).
Please consider design elements for the poles themselves, especially at the pedestrian scale, as
there will be many people walking by the poles on a daily basis. The supporiiing poles present a
great opportunity to incorporate interesting design elements such as commemorative plaques,
historical information, or public art elements. Whatever their treatment, however, the pole
materials must be durable and easily maintainable overtime.
8. Consider installing some type of bird deterrent on the sign, truss and art work to keep birds
from sitting/roosting on the structures.
9. You indicted in your application that once installed, the sign would be donated to the city.
Please provide a construction cost estimate and an itemized cost estimate to maintain the sign,
as its future upkeep will become the city's responsibility.

Commission. The Arts Commission makes recommendations to the City Council for all works of
art to be acquired by the city. The City Council makes the final decision whether to accept a
proposed donation or not.
Transportation;
14. The proposed height and location of the archway sign meets the vertical clearance and visibility
of southbound traffic signal indications from approaching vehicles (see attached traffic signal
visibility analysis dated 8/15/13). However, if there are any modifications of the sign size or
location the minimum vertical clearance and visibility of traffic signal indications would have to
be reviewed again.
15. ADA dearance around the foundation of the poles must be maintained.
Urban Place:
16. While the sign does make a bold statement, we feel the placement of the sign would be more
appropriate at an entry point to the Village, such as at Pine Avenue and Carisbad Boulevard or
on Carlsbad Village Drive near the freeway.
17. We feel the artwork is not representative of Carisbad or the Village.
18. The proposed sign does not reflect the historic character of the original sign, though we feel it
should say "Carlsbad Village."
19. Other gateway signs in the region do not feature advertising of organizations or companies.
