RE: Boston Chicken at El Camino Real and Mawon
Dear Mr. Wayne:
In response to your letter of December 16, 1994, we have researched the events and conditions that led to
our approval and subsequent installation of the current awnings at our new restaurant. We have also
looked at options that may represent a logical compromise we could offer the city to resolve the current
conflict. Last month I had an opportunity to propose two potential options to Anne Hysong, however,
neither option, in Ann’s opinion, seemed to mitigate the city’s concern.
Given Ann’s comments, and our own research, we would like to pursue all administrative options
available to us, seeking confirmation of our prior approval. Since it is our position that Boston Pacific,
Inc., relied fully on the policies and practices of the City of Carlsbad and further acted at the direction of
the city, our appeal is not for approval, rather an appeal of the city’s current position. We do believe,
whatever administrative process is required, should be a process of confirmation or clarification. Also,
please note the position of Boston Pacific Inc., is one of cooperation and therefore, if you or your M
have any ideas that would propose a solution not already considered, they will get our immediate
consideration.
