SUBJECT: CARLSBAD PLAZA SOUTH (BOSTON CHICKEN) TENANT
IMPROVEMENT AND SIGN PERMIT
The Planning Department has completed a review of the approved Boston Chicken sign permit
and building permit for tenant improvements to determine if the recently installed signs and
awning are consistent with the approved permits and plans. The approved sign permit allowed
only three fascia signs approximately 20’ in length along the western, eastern, and southern
building elevations. These approved signs are shown attached to an awning which was approved
separately as part of a tenant improvement by Building Permit CB94-1226. Construction of the
signs and awning is nearing completion, however, final inspection of the improvements by the
City has not yet occurred. A site inspection conducted by the Planning Department on December
16, 1994 revealed that the awning, approved by Building Permit CB94-1226, has been painted
with red, black, and white stripes.
This letter is notification that the Planning Department will not approve final inspection of the
tenant improvement until the awning is painted consistent with the existing center or removed.
The Planning Department’s rejection is based on the following:
1. Chapter 21.4 1.050 the City’s Sign Ordinance prohibits attention getting devices. The
awning, approved as an architectural change, became a prohibited sign when it was
painted in an attention getting fashion. The amount of signage represented by the awning
is also inconsistent with the approved Carlsbad Plaza South Sign Program and the
approved Boston Chicken sign permit.
2. The awning was represented on the building plans and approved by building permit as
a minor architectural change to the approved Carlsbad Plaza South architectural design;
therefore, the awning (including color scheme) must be consistent with the existing
project unless an-amendment to the Carlsbad Plaza South Site Development Plan (SDP
77-02A) is approved by the Planning Commission. Since no amendment has been
approved, adherence to the existing color scheme is required.
