SUBJECT: SIGN PERMIT NO. PS 97-97
Dear Mr. Slattery:
The City of Carlsbad is reviewing recent complaints regarding your new signage
which was approved by the Planning Department on November 7, 1997. After
further review of the original Sign Permit No. PS97-97, it has been determined that
the sign permit was issued in error.
The sign permit application and attached site plan that was submitted for review
was not completely accurate. The blue neon lights around the fascia and the blue
neon lights around the south facing sign were not clearly identified and are in
violation of Carlsbad Municipal Code, Section 21.41.050. This section of the
Municipal Code specifies that "lighted signs which by reason of brilliance, reflected
light, or otherwise, are injurious to the health, safety or welfare of the surrounding
neighborhood" are prohibited. Additionally, the total proposed signage area
(including the neon tubing) was not correctly identified on the sign permit
application and exceeds the total sign area allowance for your building.
Compliance can be made by removing the neon tubing from the fascia and sign
cabinet no later than December 1, 1997. If you have any questions regarding these
