EXHIBIT A
THE APPEAL
The appeal is based on two main grounds:
First, that a variance should be granted under Carlsbad Municipal Code 21.35.130 in
that the sign in question is an integral part of the Old World Center and was in the building
design so that a hole was put into the roof design for the pole. The sign was never intended
to necessarily be for one tenant but instead to provide an advertising medium for the Old
World Center.
The second ground is that the Village Master plan as written, is to brand in its scope
and as to its present application violates Mr. Murphy's constitutional rights, and violates
State Laws.
Facts
The Old World Center was built and as part of its various application the design was
approved allowing for a pole sign coming through the roof to advertise the center and its
tenants. The landlord allowed this sign to be used for the restaurant which was an anchor
tenant. The Old World Center is comprised of three buildings, which are connected by
second floor walkup. The sign in question extends onto the roof of a building that has a
restaurant and a number of other businesses on the second floor. The city contends that
adopting a village Master Plan and Design Manual all pole signs are nonconforming and that
pole signs must be removed if a business ceases to exist, the property is abandoned for a
period of six months, there is a change in use. The applicant contends that the business of
the Old World Center never ceased to exist, and that there is not a change in use or business.
The sign in question was originally set in these plans to advertise all of the tenants,
but the original restaurant asked and was granted the right to put its name solely on the sign.
The original restaurant left and more than six months elapsed before a new restaurant
occupied the lower part of the building. The sign was never changed. The new restaurant
owner asked the landlord and was granted the right to change the name on the sign. The sign
was not changed as to its size or height, but only content. The City then notified the landlord

and tenant that a new sign application would have to be filed before they granted the tenant
the right to have music as part of his business license. Application was made and denied by
the housing director. The applicant is now asking for the right to keep the sign, and
secondly, if the sign is removed for compensation for inverse condemnation.
Issues
I. Should a variance be granted including 21.35.130
II. Is the Master Plan overbroad and in violation of state and federal law?
1. The Variance
In order to grant a variance, findings must be made under 21.35:130. The housing
director, in her denial, cited a precedence in which she denied an application for a sidewalk
sign permit for the Sock Hop Yogurt Shoppe in March of 1997, because it had a free standing
pole sign. No attempt was made by the applicant in that case, to have a variance granted. In
the present case, the pole sign is completely different than the Sock Hop Yogurt situation. In
that case, the pole sign was a freestanding pole on the edge of the property. In the instant
case, the sign is on a pole that is an integral part of the building design. In the original plans
the sign in question was designed for part of the Old World Center, and extends on a pole
through the roof. It is part of the building and not standing separately on a comer of the
property.
Therefore, the commission can easily find that the applicant, to remove the sign, will
have to remove the pole and replace the roof opening. It will change the architectural design
planned for the center, and will cause a hardship to patrons, since the sign placement
recommended by the ordinance is against a dormer, which means that potential patrons will
not be able to see it from both directions as they come along Grand Avenue.
It is clearly unique in that other properties were not designed with a pole sign as
integral part of a building and because of the design make the building more aesthetic and
pleasing to the eye.
It would not be materially detrimental to the public welfare but instead by its design
enhances the aesthetic qualities of the downtown village area.
II. The Ordinance is Too Broad
It will not contradict standards to have aesthetically pleasing structures.
The second issue challenges the ordinance as written as being too broad in its scope,
and in direct violation of the owner's constitutional first amendment rights, and the laws of
the State of Califomia.
Specifically, the owner and landlord in his original design approved by the city had a
sign incorporated into the building extending from the ground through the roof, which gives
visibility of its contents to all individuals traveling east or west on Grand Avenue. After
occupancy of the center the landlord, at the request of the anchor tenant in the center, allowed
the anchor tenants Dooley McCluskey Restaurant to use the sign. The restaurant occupies the
first floor of the building in which the sign extends to the roof. The second floor containing
a number of businesses, and in fact, if the sign is moved to a dormer, it could obstmct natural
light that comes to the second floor business. The second floor is coimected to all buildings
in the center with two openings on the first floor in which patrons can walk under the second
floor coimectors. The City seems to contend that since Dooley McCluskey was closed for
more than six months, and in fact, since the new tenant for that space is a restaurant, but a
different owner, the pole sign being declared non-conforming must now be removed. The
owner contends the pole sign is a property right of the center and not of any particular tenant.
The center has never been vacant for any period of time, but only individual spaces. The
building which has the restaurant on the first fioor has been continually occupied on the
second floor and the owner could well have advertised either of these tenants or just "Old
World Center." In fact, the owner contends that no permit is necessary to change the name
on the sign. However, after the repainting of the sign, the City notified the tenants that a
permit must be obtained, and that they would not grant a permit for music on the premises
until the sign question was resolved. The owner in his appeal contends that is in violafion of
state law, and because he and the tenants will suffer an economic loss because of the denial
of a music permit the City is doing an inverse condemnation and demand is made for
compensation.
Law
In reviewing the law one, attention is first drawn to Deimy's Inc., vrs. City of Agoura
Hills, 1997, 56 Cal App 4th 1312. This is a case dealing with pole signs. It raises a question
of what is a pole sign, and leaves open the question that even real estate signs on stakes may
well be pole signs. The Redevelopment Master Plan and Design Manual does not define pole
signs but simply indicates they are prohibited within the Village Redevelopment Area. It then
goes on to indicate that service stations can attach signs for prices on existing pole signs
giving service stations additional rights not offered to other businesses with pole signs. We
could spend a great deal of time examining the principles set out in the City of Agoura Hills
case, supra, but instead the case is presently cited because it indicates that municipal exercise
of police powers are preempted by State Law if it is covered by State Law.
The Califomia Business and Professional Code 5412 is directly in point. It reads as
follows:
"Notwithstanding any otiier provision of tiiis ciiapter, no advertising display wiiich was
lawfully erected anywhere within this state shall be compelled to be removed, nor shall its
customary maintenance or use be limited, whether or not the removal or limitation is
pursuant to or because of this chapter or any other law, ordinance, or regulation of any
governmental entity, without payment of compensation, as defined in the Eminent Domain
Law (Title 7 (commencing with Section 1230.010) of Part 3 of the Code of Civil
Procedure)..."
The owner contends that the exceptions in 5412.1, 5412.2 and 5412.3 do not apply
since the center has not decided to abate all pole signs.
Secondly, the Califomia Business and Professional Code 5412.6 states:
"The requirement by a governmental entity that a lawfully erected display be removed
as a condition or prerequisite for the issuance or continued effectiveness ofa permit, license,
or other approval for any use, structure, development, or activity other than a display
constitutes a compelled removal requiring compensation under Section 5412, unless the
permit, license, or approval is requested for the construction of a building or structure which
cannot be built without physically removing the display."
Clearly, the City demand that the sign be removed before a permit for music can be
issued is covered by this section.
The city is telling Mr. Giblin he cannot have a permit for music until the sign is
removed. Mr. Giblin is suffering economic loss because of this decision.
The constitutional question of free speech is raised because the US Supreme Court in
Central Hudson Gas and Electric Corp V. Public Service Cen (1980) 447 US 557, 565, 65
LEd 2d 341, 1005 Ct 2343 indicates a sign must be content neutral. It is applicant's
contention that in judging the issue, the City cannot consider what is on the sign as long as it
is not offensive. There are numerous Califomia cases holding that First Amendment rights
give the owner of a sign the right to place any reasonable advertising on the sign, and the
govemment cannot consider its content unless it is in the govemment's interest to eliminate
visual blight, controversial advertising or traffic hazards. None of these issues apply in this
case, and the owner of the center has the right to maintain his sign, and advertise any tenant
or combination of tenants in the center. The tenant does not own the sign, but since the
tenants' and owner's success depends on successful advertising the tenant and owner both
suffer economic loss if their rights are denied, and accordingly are entitled to fair and just
compensation.
In conclusion, the applicant between that the landlord and tenant have a property right
that remains under the present circumstances, and any denial of said right is in violation of
the law and is subject to inverse condemnation.
