QUALITY ACT (CEQA) APPLICABILITY/PROCESS DETERMINATION
This is to advise you that after reviewing the application for the project referenced above, the
City has determined the following:
The project is exempt from the provisions of CEQA, pursuant to CEQA Guidelines Section
15301 (e), Existing Facilities. No environmental review is required for the project.
However, the City is required to file a Notice of Exemption form with the County Clerk's .Office.
The County requires a $50 filing fee, which the City collects from the applicant. Please submit
a check for $50 payable to San Diego County Clerk to Gina Ruiz, project planner.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Department
has reviewed your Planned Development Permit Amendment, application no. PUD 91-05 (E), as
to its completeness for processing.
The items requested from you earlier to make your Planned Development Permit Amendment,
application no. PUD 91-05 (E), complete have been received and reviewed by the Planning
Department. It has been determined that the application is now complete for processing.
Although the initial processing of your application may have already begun, the technical
acceptance date is acknowledged by the date of this communication.
Please note that although the application is now considered complete, there may be issues that
could be discovered during project review and/or environmental review. Any issues should be
resolved as expeditiously as possible. In addition, the City may request, in the course of
processing the application, that you clarify, amplify, correct, or otherwise supplement the basic
information required for the application.
For your information, as part of the project's review, it was publicly noticed according to Zoning
Ordinance Section 21.45.090 (B). While no request for an informal public hearing on the project
was submitted, a comment letter was received. This letter and staff's response to it are
enclosed.

SUBJECT: PUD 91-05 (E) - ENGESETH ADDITION
This letter is in response to your expressed concerns regarding the proposed 630 square foot
second story addition to an existing two story residence located at 6747 Barberry Place. The
addition consists of an entertainment/game room, elevator, bedroom, laundry room, and
bathroom.
Additions in existing Planned Developments (PUD) are permitted through an Administrative
PUD Amendment (Section 21.45 of the Carlsbad Municipal Code, Planned Developments),
following the standards set forth within that section. An Administrative PUD Amendment is
reviewed and acted upon by the Planning Director (appealable to the Planning Commission and
City Council). There are several findings that need to be made before the Planning Director can
issue an approval. Along with applicable setbacks and height limitations, these findings do
require City staff to evaluate building design as well as any criteria that was approved per the
original PUD permit.
Regarding the architectural character of the proposed project, staff has determined it maintains
the appearance and integrity of the home's existing architectural design. As an example, the
addition does not expand beyond the existing building footprint, aside from the addition of some
supporting columns, nor exceed the existing home's height. The addition also continues the roof
lines, materials and colors, window and door placement architectural style of the original home.
This project was subject to a noticed public review period (8/26/08-9/09/08). During this period,
staff did not receive any other objections or any requests for an informal public hearing
regarding this project and the public review period is now closed. City staff has reviewed the
project, applying Chapter 21.45, and has determined that because the project does meet all the
required development standards, including design, all required findings can be made. Therefore,
the Planning Director will be approving the project.
As mentioned above, decisions of the Planning Director may be appealed to the Planning
Commission based on Zoning Ordinance Section 21.54.140. The Zoning Ordinance is available
online at http://www.carlsbadca.gov/planning/index.html. Appeals must be filed within ten days
of the director's decision and require the appellant to pay a filing fee and establish substantial

written evidence that reasons for the appeal exist. The appeal period will begin the day the
Planning Director's decision is mailed, and a copy of this decision letter will be mailed directly
to you.

Dear Ms. Ruiz
I am responding to your notification regarding a 630 square foot second story addition to
the existing residence of Mr. & Mrs. Engeseth, 6747 Barberry Place in Carlsbad. With this letter
I am expressing my strong objection to this project not for personal reasons but merely as a
matter of principle as former member of the Association's Board of Directors.
The architectural character and style in our neighborhood, known as Mariners Point
Community Association has been unique in that the developer, Lennar Corporation, mixed three
floor plans with varying exterior designs and a pleasant color palette and building materials to
not let the neighborhood look like a regular look-alike housing tract. It has greatly contributed to
the vast (double or even triple) increases in property values during the past decade.
From the beginning of Association governance, the numerous members on the Board of
Directors guarded this appearance and would not allow front or street facing alterations in order
to maintain the integrity of the architecture. In fact, the Association's Architectural Committee
denied one homeowner's application for an almost identical second story addition in the year
2000 and their appeal to the Board of Directors was also turned down.
With the approval of this application from Mr. and Mrs. Engeseth in their rather
prominent location at the corner of Camino De Las Ondas and Barberry Place will in all
likelihood encourage other homeowners with identical floor plans to apply for second story
additions over then" two-car garages. The truly boxy and out of style appearances of such
additions will forever diminish the architectural character of the neighborhood as we have known
it. I consider it a very negative development for Mariners Point and I am saddened to know that
the City of Carlsbad - while insisting on high standards of architecture in Planned Unit
Developments (PUD's) at the beginning - does later on (as in this case) merely involve itself in
checking for proper setback ordinances and height limitations. The City should not reduce its
responsibility to just such matters but should also encourage the maintenance of high caliber and
attractive architectural appearances in PUD's as well.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Department
has reviewed your Planned Development Permit Amendment, application no. PUD 91-05 (E), as
to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information
which must be submitted to complete your application. This list of items must be submitted
directly to your staff planner by appointment. All list items must be submitted
simultaneously and a copy of this list must be included with your submittals, including
two (2) sets of plans. No processing of your application can occur until the application is
determined to be complete. The second list is issues of concern to staff. When all required
materials are submitted the City has 30 days to make a determination of completeness. If the
application is determined to be complete, processing for a decision on the application will be
initiated. In addition, please note that you have six months from the date the application was
initially filed, August 6, 2008, to either resubmit the application or submit the required
information. Failure to resubmit the application or to submit the materials necessary to
determine your application complete shall be deemed to constitute withdrawal of the application.
If an application is withdrawn or deemed withdrawn, a new application must be submitted.
