Rincon Street, Suite 11 5 Corona, CA 91719 SUBJECT: PUD 92-01 (E) - COSTA DO SOL (THE COVE) The City has completed a review of the minor amendment to PUD 92-01 (E) to change the floor plan types on Lot Nos. 21 and 52, all located within the Costa Do Sol (The Cove) project in Specific Plan 203 within Local Facilities Management Plan Zone 20. It is the Planning Director's determination that the project is consistent with the development standards of the zoning and Specific Plan 203, and therefore, APPROVES this request based on the findings and conditions contained therein. Findings: 1. The project is consistent with the General Plan since the amendment will not change the residential density of the project, and a change in the type of floor plan on the two lots will not impact land use, circulation, housing, open space, or recreation. 2. The placement of Floor Plan 2R on Lot Nos. 21 and 52 both relate to the site, surrounding neighborhood, and environmental setting, in that the homes have smaller building footprints than the originally approved floor plans and the homes both meet front, side, and rear yard setbacks, lot coverage, parking, and the building height standards of the zoning. The two lots are adequate in size and shape to accommodate the homes, in that a reasonable sized home, in keeping with the neighborhood, can be accommodated on the lots. The lots still meet the required development standards and provide for positive lot drainage around the two homes. 4. The proposed amendment is compatible with the surrounding neighborhood, in that the same floor plans and homes have been approved and constructed on lots throughout the balance of the project. 5. The street system serving the proposed land use is adequate to properly handle all traffic generated by the proposed use, in that the amendment proposes to only change the design of the homes and does not add additional residential density or change the land use of the lots. 7. The amendment is consistent with the amendment procedures and development standards of Specific Plan 203, and meets all City policies and standards. 8. Due to the minor nature of the amendment, it will not cause any additional environmental impacts and the Planning Director has determined that the environmental effects of the project have already been considered in conjunction with previously certified and adopted environmental documents (FEIR 90-03) on file in the Planning Department, therefore, the minor amendment is exempt from CEQA under Section 15182(a): "Residential Projects Pursuant to a Specific Plan", and Section 15301: "Minor Alteration to the design of a private structure involving no intensification of land use previously approved". Conditions: 1. The Planning Director does hereby APPROVE the Minor Planned Development Permit Amendment for PUD 92-01 (E) entitled "Costa Do Sol" as shown on Exhibit "A" on file in the Planning Department and incorporated by this reference, dated January 16, 1997, subject to the conditions herein set forth. All other conditions and approvals of said prior permits as amended to date and not amended by this action remain in full force and effect. Exhibit "A" dated January 16, 1997 replaces Exhibits "B"- "C", dated November 15, 1995. Staff is authorized and directed to make or require the Developer to make all corrections and modifications to the approved Documents, as necessary to make them internally consistent and conform to the Planning Director's final action on the project. Development shall occur substantially as shown on the approved exhibit. Any proposed development substantially different from this approval, shall require an amendment to this approval. 2. The Developer shall provide the City with a reproducible 24"X36", mylar copy of the Site Plan, as approved by the final decision making body. The Site Plan shall reflect the conditions of approval by the City. The plan copy shall be submitted to the Planning Director and approved prior to building permit issuance. This Planning Director determination is final unless the determination is appealed to the Planning Commission. The appeal shall be filed in writing with the appropriate PUD 92-01 (E) - COST7TOO SOL (THE COVE) JANUARY 16, 1997 PAGE 3 appeal fee of $490.00 and sent to the Planning Director within ten calendar days after receipt of the Planning Director's determination.
