PUD 92-05. It is the Planning Director's determination that the project is in conformance with the intent, design criteria, and development standards of the Planned Development Ordinance, Chapter 21.45 of the Carlsbad Municipal Code and therefore APPROVES this request based upon the following findings and subject to the following conditions: 1. The project is consistent with the City's General Plan since the proposed density of 3.2 du's/acre is within the density range of 1 to 4 du's/acre specified for the site as indicated on the Land Use Element of the General Plan, and is at or below the growth control point of 3.2 du's/acre. 2. The site is physically suitable for the type and density of the development since the site is adequate in size and shape to accommodate residential development at the density proposed. 3. School fees will be paid to ensure the availability of school facilities in the Carlsbad School District. 4. Park-in-lieu fees are required as a condition of approval. 5. All necessary public improvements have been provided or are required as conditions of approval. 6. This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Planning Director on June 8, 1993. In approving this Negative Declaration the Planning Director has considered the initial study, the staff analysis, all required mitigation measures and any written comments received regarding the significant effects this project could have on the environment. 7. This project is consistent with the City's Growth Management Ordinance as it has been conditioned to comply with any requirement approved as part of the Local Facilities Management Plan for Zone 1. 2O75 Las Palmas Drive • Carlsbad, California 92OO9-1576 • (619)438-1161 Laguna Associates PUD 92-05 - Casas Del Marisol July 8, 1993 Page 2 Conditions: 1. Approval is granted for PUD 92-05, as shown on Exhibits "A" - "M", dated July 8, 1993, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance. 3. This project shall comply with all conditions and mitigation measures which may be required as part of the Zone 1 Local Facilities Management Plan and any amendments , made to that Plan prior to the issuance of building permits. 4. The applicant shall pay an inclusionary housing impact fee, as required by Chapter 21.85 of the Carlsbad Municipal Code, prior to the issuance of building permits. 5. This approval shall become null and void if building permits are not issued for this project within two years from the date of project approval. 6. Approval of PUD 92-05 is granted subject to the approval of MS 92-06. All conditions of approval for MS 92-06 are incorporated herein by reference. 7. The applicant shall establish a homeowner's association and corresponding covenants, conditions and restrictions. Said CC&R's shall be submitted to and approved by the Planning Director prior to approval of the parcel map. 8. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first. 9. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. 10. Preliminary landscape plans shall be submitted. 11. All landscape plans shall be prepared to conform with the Landscape Manual and submitted per the landscape plan check procedures on file in the Planning Department. 12. Landscape plans shall be designed to minimize water use. Lawn and other zone 1 plants (see Landscape Manual) shall be limited to areas of special visual importance or high use. Mulches shall be used and irrigation equipment and design shall promote water conservation. Laguna Associates PUD 92-05 - Casas Del Marisol Jtdy 8, 1993 Page 3 13. The developer shall avoid trees that have invasive root systems, produce excessive litter and/or are too large relative to the lot size. 14. Prior to final occupancy, a letter from a California licensed landscape architect shall be submitted to the Planning Director certifying that all landscaping has been installed as shown on the approved landscape plans. 15. All herbicides shall be applied by applicators licensed by the State of California. 16. The applicant shall pay a landscape plan check and inspection fee as required by Section 20.08.050 of the Carlsbad Municipal Code. 17. The first set of landscape and irrigation plans submitted shall include building plans, improvement plans and grading plans. 18. All landscape and irrigation plans shall show existing and proposed contours and shall match the grading plans in terms of scale and location of improvements. 19. Heavy landscaping shall be provided along the western edge of the property to buffer the residential uses from the adjacent commercial uses. The landscaping shall be at a minimum that shown on Exhibit "E", dated July 8, 1993. 20. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. 21. All sales maps that are distributed or made available to the public shall include but not be limited to trails, future and existing schools, parks, and streets. 22. This project is being approved as a condominium permit for residential homeownership purposes. If any of the units in the project are rented, the minimum time increment for such rental shall be not less than 26 days. A condition so stating this shall be placed in the CC&R's for the project. 23. The owner shall dedicate all land south of the existing sewer pipeline easement, recorded March 5,1964 as File No. 41723 of Official Records, as an open space easement in favor of the City of Carlsbad. 24. The owner shall dedicate a strip of land 25 feet in width south of the existing sewer pipeline easement, in a location approximately as shown on Exhibit "A", dated July 8, 1993, as a public access easement in the favor of the City of Carlsbad. Prior to the approval of grading plans, the project applicant shall receive a Coastal Development Permit from the California Coastal Commission that approves development that is in substantial conformance with the City approval. Evidence that the permit has been received shall be submitted to both the Planning and Engineering Departments. 26. As part of the plans submitted for building permit plan check, the applicant shall include a reduced version of the approving resolution/resolutions on a 24" x 36" blueline drawing. Said blueline drawing(s) shall also include a copy of any applicable Coastal Development Permit and signed approved site plan.
