10. FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 2
The followmg findincis have been made in order to approve the Administrative Redevelopment
Permit for the addition of outdoor tables and chairs and new landscaping on the west side of the
existing Jack in the Box restaurant located at 901 Carlsbad Village Drive:
1. The Housing and Redevelopment Director has determined that the project is consistent with the
policies, goals and action programs set forth within the Carlsbad General Plan.
2. The Housing and Redevelopment Director has determined that the project is consistent with ali
applicable development standards and land use policies set forth within the Village Master Plan
and Design Manual and Village Redevelopment Plan.
3. The subject property is not located within the Coastal Zone, therefore a Coastal Development
Permit is not required.

4. The Planning Director has determined that the project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15304 of the State CEQA Guidelines
and will not have an adverse significant impact on the environment.
The following conditions have been approved for the subject project:
1. This approved permit serves as the required redevelopment permit for the subject project.
2. The project shall be completed according to, and be consistent with, the plans approved by the
Housing and Redevelopment Director on the date noted above. The approved plans have been
stamped by the Housing and Redevelopment Director and indicate the approval date of 1 ISlCD
The project plans are approved subject to the following minor modifications:
• Additional Average Daily Trips (ADT) shall be changed to 140 for a total of 540 ADT.
• The proposed use of "Vinca" on the north side of the existing structure (immediately west of
the entrance) shall be changed to "Agapanthus" or similar landscape material.
• A 6" mow strip shall be added to the east side of sod area located on the north side of
building as shown on the approved plans.
3. This permit allows the applicant to provide a total of 60 seats inside the subject restaurant and a
maximum of 10 seats within the outdoor dining area.
4. Acceptable furniture has been approved as part of this application and is on file with the
Housing and Redevelopment Department. This furniture shall not change without prior written
approval from the Housing and Redevelopment Director.
5. The umbrellas shall be constructed of a wood or metal framework and shall be covered with a
fabric material. No fiberglass umbrellas shall be permitted.
6. The outdoor dining area shall be maintained in a clean and sanitary manner. The area shall be
kept free of all litter.
7. Prior to commencing work, the applicant shall contact San Diego Gas & Electric Company, an
Enova Company, to obtain authorization to complete the work described under this application
within the SDG&E easement described by instrument recorded February 11, 1982 as file no 82-
038379 of official San Diego County Record.
8. This permit shall be subject to revocation by the Housing and Redevelopment Director if the
applicant fails to conform to any of the above conditions of approval.
