10. FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 2
The following findings have been made in order to approve the Administrative Redevelopment
Permit for the addition of an outdoor landscape nursery on the west side of the property located at
2763 State Street:
1. The Housing and Redevelopment Director has determined that the project is consistent with the
policies, goals and action programs set forth within the Carlsbad General Plan.
2. The Housing and Redevelopment Director has determined that the project is consistent with all
applicable development standards and land use policies set forth within the Village Master Plan
and Design Manual and Village Redevelopment Plan. Additional on-site parking shall be
installed to accommodate the proposed use.
3. The Planning Director has determined that the project is exempt from the requirements of the
California Environmentai Quality Act (CEQA) per Section 15303 of the State CEQA Guidelines
and will not have an adverse significant impact on the environment.

The following conditions have n approved for the subject project^
1. This approved permit serves as the required redevelopment permit and sign permit for the
subject project. Any changes to the proposed signage will require separate sign permit
approval.
2. The project shall be completed according to, and be consistent with, the plans approved by the
Housing and Redevelopment Director on the date noted above. The approved plans have been
stamped by the Housing and Redevelopment Director and indicate the approval date of ^fgioO.
3. The applicant shall acquire necessary building permits for the conversion of the existing gazebo
to storage.
4. Three (3) parking spaces at the southwest corner of the site shall be paved with aggregate
concrete and striped according to the approved plans.
5. Existing chain-link fence shall be repaired and all barbed wire removed.
6. Prior to use of the property, staff shall complete a final inspection to insure all site changes have
been completed in accordance with the approved plans.
7. This permit shall be subject to revocation by the Housing and Redevelopment Director if the
applicant fails to conform to any of the above conditions of approval.

NOTE TO FILE REGARDING FINAL INSPECTION
On September 14, 2000, a final inspection was conducted for the Potted Palm
Landscape Nursery located at 2763 State Street (RPOO-08). While the parking
was not configured according to the approved plans, the parking lot was
resurfaced and restriped and a total of 15 parking spaces were counted on-site
(13 in the front and 2 in the back off the alley). Based on the square footage of
the existing retail area (1,500 sq. ft.) and the fenced in retail nursery area (2,881
sq. ft.), 15 parking spaces is sufficient to satisfy the required parking (4,381 -5-
300 = 14.6 parking spaces). The applicant has chosen not to enclose the
gazebo at this time. However, at a future date when the gazebo is enclosed the
additional 98 square feet will not affect the required parking.
As a condition of approval, all existing barbed wire was to be removed and the
chain link fence repaired and/or replaced. The applicant replaced a majority of
the chain link fence with new and a new wood fence was added along the
northerly property line. Some barbed wire stills exists along the northerly
property line on the portion of fence owned by the property owner to the north
(Carlsbad Animal Hospital).
At this time, the permanent signs approved for this use have not been installed.
The applicant was made aware of the fact that a separate sign permit and
associated liability insurance is required pnor to placement of an A-Frame sign in
the public nght-of-way.
Overall, the use is a significant improvement to the property and the applicant
has satisfied all site related conditions.

PROJECT ID: RP 00-08 THE POTTED PALMS
The Engineering Department has completed its review of the above referenced project for
compliance with the previously determined issues. The project still has issues which must be
addressed. The following is a list of these issues:
1. Show that the "parking stall" located at the southern portion of the parking lot near the
entrance is cleariy delineated as not a parking stall. Use planters, striping or some other
acceptable method. One suggestion is to designate the area for a bike rack.
2. Show direction of surface drainage fiow across the new pavement with the three parking
stalls. If possible, direct drainage to the landscaped area in order to filter surface
pollutants.
3. Move the entrance gate 5 feet further from the parking stalls to provide space for vehicles
to back into before exiting the site.

COMPLETNESS AND ISSUES REVIEW
Engineenng Department staff has completed a review of the above-referenced project
for completeness and engineering issues of concern. All items needed for engineenng
review are provided for determining the application as complete. Engineering issues
which need to be resolved or adequately addressed prior to staff making a
determination on the proposed project are as follows:
1. Plot the easement identified under item 4 of the preliminary title report.
2. Are the proposed plants in pots or the ground? If they are planted in the
ground, then the plants located within the easement(s) must be relocated
outside the easement. If in pots, then they may be placed as shown on the
site plan. Please clarify on the site plan.
3. Plot the intersection site distance per the California Department of
Transportation Highway Design Manual. It appears that the proposed sign
fronting State Street will interfere with a driver's clear vision of approaching
vehicles on State Street. If the freestanding sign is located an additional six
feet further west (15 feet from the face of curb) then the site distance does
not need to be plotted since the sign will clearly be located outside the
driver's line of site.

Lori - Observations:
Plan shows pedestrian access on the south side of the rear yard. This is part of the
fonner Bauer property is it not? Might not be a good idea to sanction his access
across City property. It could be come a "right" if they use it long enough, or at least
an expectation of future users.
Plan shows added bariDed wire to existing fence. This could look pretty tacky
although there is no ordinance re: this. Perhaps the Master Plan advises against the
use of barbed wire.
The sign on State St looks like a potential sight line obstmction if it exceeds 30" in
height. Maybe they'd consider an A-frame on State St. instead.
Converting the old gazebo to "storage" requires a building permit, but there are no
hindrances to issuing a pennit for that use in that structure. The plan shows it being
upgraded stmcturally to meet that need.
No other issues - I was going to send this via email, but the system is down for the

SUBJECT: The Potted Palm Proposed Nursery {RPOO-08)
Thank you for applying for a Land Use Permit in the City of Carisbad. The Housing and
Redevelopment Department, together with other appropriate City departments has
reviewed your Administrative Redevelopment Permit, application no. RPOO-08, as to its
completeness for processing.
The application is complete, as submitted. Please note that although the application is
considered complete, there are some issues or items of clarification that must be resolved
prior to staff rendering a final decision on the project. The attached list contains those
outstanding issues. Please review the attached list of issues and prepare the necessary
documentation showing resolution of staff's concerns. Once all issues have been resolved to
staffs satisfaction, the Housing and Redevelopment Director will render a final decision on the
project.

ISSUES OF CONCERN

Outstanding issues that need to be resolved or adequately addressed prior to staff making
a determination on the proposed project are as follows:
Housing & Redevelopment Department
1. Site plan should be revised to include and/or address the following:
a. In the site analysis table include total retail area and total number of
parking spaces required.
b. Add a summary table with the following signage information: a) total street
frontage (i.e. linear distance of proposed use fronting State Street); b) total
signage allowance (one square foot of signage per linear foot of street
frontage is allowed); c) the amount of existing signage and type; d) the
amount of signage to be removed and type; and e) the amount of new
signage proposed and type.
c. Pedestrian access shown on south side of property will conflict with
adjacent parking. Relocate pedestrian access to west side of property.
d. Existing gazebo is shown as for storage purposes only. If this is intended
to house the cash register and be used for retail transactions it should be
noted on the plans.
e. Barbed wire Is inconsistent with the Design Guidelines for the Village
Redevelopment Area. Plans should indicate the removal of existing barbed
wire and eliminate any reference to the addition of the same.
f. Existing chain link fence is in disrepair. Indicate on the plans that repairs to
existing fence will be made accordingly.
2. Existing standards for the redevelopment area require the total area enclosed
by the fence be counted as retail space. Calculation of this area indicates
there is 3,944 square feet of retail space. This would require 14 parking
spaces to accommodate the use. At the present time, there are only 7
additional parking spaces on-site that can be counted towards meeting the
parking requirements for the proposed use. Seven additional parking spaces
can be accommodated off-site through a private lease agreement with a
property owner within 300 feet of the subject property or participation In the
Parking In-Lieu Fee Program. The other option is to limit the retail area to no
more than 2,100 square feet including the gazebo. The remainder of the site
can be "permanently" landscaped with some sort of assurance from the
business owner that it will not be used as retail space.
Building Department
1. Converting the existing gazebo to "storage" requires issuance of a separate building
permit. The detail shown on the site plan is adequate for building permit purposes.

1. On the site plan, plot the easement identified under item 4 of the preliminary title
report.
2. Indicate on the site plan if the proposed plants are in pots or the ground. If they are
planted in the ground, then the plants may not be located within the easement{s). If
in pots, then they may be located as shown on the site plan.
3. Plot the intersection site distance per the California Department of Transportation
Highway Design Manual. It appears that the proposed sign fronting State Street will
interfere with a driver's clear vision of approaching vehicles on State Street. If the
freestanding sign is located an additional six feet further west (15 feet from the face
of curb) then the site distance does not need to be plotted since the sign will clearly
be located outside the driver's line of site.

A redlined check print set has been included with this letter to graphically depict the
comments discussed above. Please submit 6 sets of revised plans, along with the redlined
check print set, to the Housing and Redevelopment Department to complete the processing
of the Administrative Redevelopment.

Dear Mr. Gonzalez:
On August 3, 2000 the Housing and Redevelopment Director conditionally approved
Administrative Redevelopment Permit No. RP 00-08 for property located at 2763 State
Street. The decision of the Housing and Redevelopment Director is subject to a ten
(10) day appeal period. The appeal period has elapsed and no appeals were filed.
Attached is a copy of the approved permit authorizing the addition of an outdoor
landscape nursery on the west side of the subject property. Please review all
conditions carefully. Violation ofthe conditions could result in revocation ofthis permit.
Before Initiating construction of the subject project you must complete the process to
obtain the appropriate building permits for the conversion of the existing gazebo to
storage. The appropriate building permit application has been enclosed for your use.

RE: RP 00-08 THE POTTED PALMS; REQUEST TO INSTALL MONUMENT SIGN
I reviewed the applicant's request to install the proposed monument sign at the northeast comer of the
property. The request is to relocate the sign from 15 feet back from face of curb as shown on Exhibit A to
10 feet from face of curb. After reviewing the proposal in the field, I determined that the sign may be
located 10 feet from face of curb in the same alignment as the currently approved location. The sign will
not interfere with safe site distance at this location.
