10. FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 2
1. The construction and installation of small new equipment facilities or structures Is a Class 3
Categorical Exemption under the California Environmental Quality Act (CEQA) State Guidelines
section 15303. The Federal Communications Commission (FCC) requires compliance with radio
frequency power density standards (ANSI/IEEE C95.1-1992) for the general public; therefore, the
project would not have a significant impact on the environment. In light of the above, a Notice of
Exemption will be filed upon final project determination.
The following conditions have been approved for the subject project:
1. This approved permit serves as the required redevelopment and coastal development permits
for the subject project. The applicant has received approval to install a radio base station within
the existing basement and three cellular antennas within the existing cupola of Neiman's
Restaurant located at 300 Carlsbad Village Drive, within the Village Faire Shopping Center.

2. The project shall be completed according to, and consistent with, the plans approved by the
Housing and Redevelopment Director on the date noted above. The approved plans have been
stamped by the Housing and Redevelopment Director and indicate the approval date of *t/lSJ00
3. No signage advertising the proposed use shall be permitted on the subject building.
4. The applicant shall obtain all appropriate building and electrical permits prior to installation of
the cellular antenna facility. The building permit application shall include an engineered plan
with details for removing a portion of the concrete foundation wall supporting the fioor above.
Details for construction of any remedial lateral bracing that may be required by the analysis
must accompany the building permit.
5. Colors and materials used to reconstruct dormers shall match colors and materials of existing
dormers and window assemblies.
6. This permit shall be subject to revocation if the applicant fails to conform to any of the above
conditions of approval.
