Dear Marie:
On August 30, 2002 the Housing and Redevelopment Director conditionally approved
Administrative Redevelopment Permit No. RP 02-27 for property located at 3055
Harding Street. The decision of the Housing and Redevelopment Director is subject to
a ten (10) day appeal period. The appeal period has lapsed and no appeals were filed.
Attached is a copy of the approved permit authorizing the expansion of the outdoor
dining area and the removal of the existing driveway apron on Harding Street. Please
review all conditions carefully. Violation of the conditions could result in revocation of
this permit.

COMPLETENESS REVIEW
PROJECT ID: RP 02-27 POLLOS-MARIA PATIO/COURTYARD
The Engineering Department has completed its review of the above referenced project for
compliance with the previously determined issues. The project appears to comply with Gity
engineering standards and ali issues have been addressed. Please add the following conditions
of approval to the approving resolution or letter:
ENGINEERING CONDITIONS
1. Developer shall comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permit. Developer shall provide improvements constructed
pursuant to best management practices as referenced in the "California Storm Water
Best Management Practices Handbook" to reduce surface pollutants to an acceptable
level prior to discharge to sensitive areas. Plans for such improvements shall be
submitted to and subject to the approval of the City Engineer. Said plans shall include
but not be limited to notifying prospective owners and tenants of the following:
A. All owners and tenants shall coordinate efforts to establish or work with
established disposal programs to remove and properly dispose of toxic and
hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other such
fluids shall not be discharged into any street, public or private, or into storm drain
or storm water conveyance systems. Use and disposal of pesticides, fungicides,
herbicides, insecticides, fertilizers and other such chemical treatments shall meet
Federal, State, County and City requirements as prescribed in their respective
containers.
C. Best Management Practices shall be used to eliminate or reduce surface
pollutants when planning any changes to the landscaping and surface
improvements.
2. The "10 ft. X 18 ft. back-up space" located south of the building shall be
designated as such by the use of pavement graphics and/or signs.

Thank you for applying for a land use permit in the City of Carlsbad. The Housing &
Redevelopment Department along with all other appropriate departments have
reviewed your administrative redevelopment permit, application no. RP02-27, as to its
completeness for processing.
The application is complete, as submitted. Although the initial processing of your
application may have already begun, the technical acceptance date is acknowledged by
the date of this communication. The City may, in the course of processing the
application, request that you clarify, amplify, correct, or othen/vise, supplement the basic
information required for the application.
In an effort to continue to process the application in the most expeditious manner as
possible, a list of issues identified by staff during the initial project review phase has
been included with this correspondence.

ISSUES OF CONCERN
RP 02-27
Staff has completed a review of the subject project for issues of concern. The following
items need to be resolved or adequately addressed prior to staff making a final
determination on the proposed project: (Please note, the issues are listed under the
department which identified them as an area of concern.)
Building:
1. Our building permit records indicate the restaurant was originally approved for a
maximum of 20 seats and two bathroom facilities for men and women. The floor
plan submitted as part of the current application indicates only one bathroom and
30 seats inside the existing restaurant. As a condition of project approval, the
existing bathroom will have to be converted back to two separate restroom
facilities as shown on the approved building plans. In addition, the number of
indoor seats may not be expanded to 30 without the payment of additional sewer
fees.
2. Please revise the floor plan to show two separate bathroom facilities and the
number of seats proposed.

Engineering:
1. On the site plan, remove the new handicap parking space since vehicle back-up
space is insufficient at this location. Replace as a paved area for back-up of
vehicles exiting from the number ten parking stall. Use a sign or pavement
graphics to designate as a non-parking space.

Housing & Redevelopment:
1. Revise the site plan to show the new handicapped parking space.
2. Please submit 3 sets of revised plans to the Housing & Redevelopment
Department addressing the above-identified issues. Once the revised plans
have been resubmitted the initial public notice will be sent out starting the first of
two 10-day notices required as part of the administrative redevelopment permit
process.
