I agree to indemnify, hold harmless, and defend the City of Carlsbad and the Carlsbad Redevelopment Agency or its officers or employees from all claims, damage or liability to persons or property arising from or caused by the installation of the subject sidewalk/freestanding sign on the public sidewalk pursuant to this permit unless the damage or liability was caused by the sole active negligence of the City or its officers or employees. I have submitted a Certificate of Insurance to the City of Carlsbad in the amount of $1 million which lists the City of Carlsbad and the Carlsbad Redevelopment Agency as "additional insured". This Certificate shall remain in effect for as long as the sidewalk/freestanding sign is placed within the public right-of-way. This agreement is a condition of the issuance of this permit for the subject sidewalk/freestanding sign to be placed on the public right-of-way. I understand that an approved sidewalk/freestanding sign permit shall remain in effect for as long as sidewalk/freestanding signs are permitted within the Village Redevelopment Area and the permittee remains in compliance with the subject approved permit. I also understand that the Housing and Redevelopment Commission may conduct an annual review of the applicable sign regulations for sidewalk/freestanding signs and resen/es the right to modify or elimin^ the regulations which currently allow for these signs. A sign pennit must be obtained from the City for these signs. Ordinance Standards (mandatory) • Maximum of one sign per business which must be located in front of the building to which it relates. • Maximum area is len square feet per face. The Design Gtuddine^ These guidelines are to assist the sign designer and compliment the mandatory ordinance standards. They are mteaded to encourage a high level of design quaiity while aiso providmg flexibility to encourage creative design. • 1. The sign design should be simple and easy to read. L'se a brief message. The fewer the words, the more effective the sign. A simple sign with a bnef message ts faster to read, looks cleaner, and is more effecuve. Usmg overly mtncate type hce* or mixmg typefaces on one sign also maices it more difficult to read quickly and reduces the sign's ability lo commuiucate. • 2. Use a durable matenal sxich as MDO (Medium Denstty Overlay) plywood or sictular wood-like matenal. Signs must have a stamed or painted surface finish. • 3. Tbe background color for all signs should be white. • 4. The text should be m 3 colors oniy (too many colors compete with content for the viewer? attention). Fluorescent or Oay-Olo colon are not accepuble. • 5. If a unique business logo is proposed, it's color shall not count as one of the three text colon. (Item 4 above). • 6. Changeable text areas should coinply with the above criteria (1-5) and should occupy no more than 50% of the sign face. Paper or non-ngid changeable areas are oot acceptable.
