SUBJECT: Administrative Redevelopment Permit for the Conversion of the Sea
Breeze Apartments to a Hotel/Motel
Dear Lori:
This letter accompanies Don and Angeli Forster's application for an Administrative
Redevelopment Permit to convert the existing Sea Breeze Apartments at 3150 Ocean
Street to a hotel/motel use.
Background
In 1981 the City approved a Building Permit for the construction of a three story, 8-unit
apartment at this site. This approval allowed for 4 ground level studios and 4 two story,
two bedroom units. The two bedroom units were located in the second and third floors of
the building. Subsequent to that, the four, 2 bedroom units located on the second and
third floors were converted into eight units, resulting in a total of 12 units on this site.
This conversion was done by the previous owner, who did not obtain building permits for
this work. The current owner, Don Forster purchased the property in 1986, after this
conversion had been completed. Mr. Forster was not aware that this conversion had been
done without obtaining the necessary permits from the City.
Due to an anonymous complaint in June 2001, Mr. Forster received a letter from Code
Enforcement giving him the option of obtaining building permits for the four units
created without permits. Unfortunately there is inadequate on site parking for 12
apartment units.
Currently, there are 19 on-site parking spaces, which met City parking requirements for 8
apartments when this project was approved for construction in 1981. The parking
standard for hotels/motels is at 1.2 spaces/unit. Based on this standard a 12-unit hotel
would require 14 on-site spaces.

Although this building was approved as an apartment, it has been used basically more as
a hotel/motel use than an apartment. Ever since it was constructed the units have been
rented for short time periods more in accordance with a hotel/motel type use. The
Califomia Coastal Commission placed a deed restriction on the property, which required
that the four ground floor studio units be available for rental on a short-term basis (less
than 31 days) during the summer months. Historically, the four studio units have been
rented in conformance with this requirement. The rentals of the other units are mostly on
a weekly basis in the summer and on weekly and monthly basis in the winter
Proposal
Mr. Forster is applying for an Administrative Redevelopment Permit to formally convert
the previously approved eight unit apartment project to a 12 unit hotel/motel and continue
to rent them on a transient basis rather than as apartments on long term leases
A hotel/motel use would be more in keeping with the surrounding uses and this site's
designation by the current Redevelopment Plan. The property is located in Land Use
District 9/Tourism Support area of the Redevelopment Plan. This portion of the
Redevelopment Area is designated for tourist commercial uses such as hotels (Exhibit A).
Approval of an Administrative Redevelopment Permit to change the existing apartments
to a hotel/motel there would not result in any significant change to the exterior of the
existing structure. One of the first floor units will be modified for handicap accessibility,
a residential fire sprinkler system will be installed and the second/third floor townhouse
units will be converted into flats. Two of the existing parking spaces will be converted
into one handicapped van parking space resulting in a total of 18 onsite parking spaces.
As mentioned above a 12-unit hotel project only requires 14 onsite parking spaces.
There will be no change to the existing use of the site. The site would continue to operate
in the same manner as it has been operated for years on a weekly and monthly basis. All
units would retain kitchen facilities, which are similar to many of the new suite hotels and
timeshare units.

10. FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 3
The following findings have been made In order to approve the Administrative Redevelopment Permit
for the change in use from multi-family residential to hotel/motel on property located at 3150 Ocean
Street:
1. The Housing and Redevelopment Director has determined that, as conditionally approved, the
project is consistent with the Carlsbad Municipal Code, the Carlsbad General Plan, the Carlsbad
Village Area Redevelopment Plan, and all applicable development standards and land use
policies set forth within the Village Master Plan and Design Manual and Village Redevelopment
Plan.
2. The hotel/motel use is appropriate to the land use district and adjacent development In that it Is
classified as a permitted use in Land Use District 9. Additionally, the proposed project would
convert an existing nonconforming use (multi-family) into a conforming use (hotel/motel) and
help in satisfying the goals and objectives of Land Use District 9, which are to provide a wide mix
of uses with an emphasis upon facilities, goods and services to tourists and regional visitors
traveling along the coast

3. The site is adequate In size to provide the necessary parking as well as adequate space for
landscaping to integrate the project Into the Village character in that the project exceeds the
parking requirement for hotels/motels and all existing landscaping will be maintained.
4. The project enhances the Carlsbad Village image and character by providing a unique visitor
serving use along the coast
5. The Planning Director has determined that the project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15303 of the State CEQA Guidelines as
the conversion of a small structure and will not have an adverse significant impact on the
environment
The following conditions have been approved for the subject project:
1. The project shall be completed according to, and consistent with, the plans approved by the
Housing and Redevelopment Director on the date noted above. The approved plans have been
stamped by the Housing and Redevelopment Director and indicate the approval date of \/l(g/QS .
2. Prior to issuance of any building permit, Developer shall comply with the requirements of the
City's anti-graffiti program for wall treatments if and when such a program is formally established
by the City.
3. The Average Daily Trips (ADT) and floor area shown on the site plan are for planning purposes
only. Developer shall pay traffic impact and sewer impact fees based on Section 18.42 and
Section 13.10 of the City of Carlsbad Municipal Code, respectively.
4. The property owner and/or developer shall comply with the "Storm Water Management Plan for
Sea Breeze Vacation Rentals" on file with the City. Prior to the issuance of building permits, the
developer shall Install a filter within the existing storm drain inlet located at the west end of the
driveway in accordance with said plan.
5. The applicant shall show the location of any proposed water lines and detector check valves for
the fire sprinkler system on the building plans. The location and design shall be subject to the
City Engineer's approval.
6. A Central Station Alarm System shall be required by the Fire Department. Other Fire Department
requirements may be required through the building permit plan check process.
7. The applicant shall obtain all appropriate buiiding permits prior to converting the 8 existing
residential units to 12 hotel/motel units.
8. Prior to the issuance of the building permit, the property owner shall submit to the City a Notice
of Restriction to be filed In the office of the County Recorder, subject to the satisfaction of the
Housing and Redevelopment Director, notifying all interested parties and successors in interest
that the City of Carlsbad has issued an Administrative Redevelopment Permit on the real property
owned by the Developer. Said Notice of Restriction shall note the property description, location
of the file containing complete project details and all conditions of approval as well as any
conditions or restrictions specified for inclusion in the Notice of Restriction. The Housing and
Redevelopment Director has the authority to execute and record an amendment to the notice
which modifies or terminates said notice upon a showing of good cause by the Developer or
successor in interest

9. Applicant shall obtain a business license from the City of Carlsbad prior to operating as a
hotel/motel use.
10. The maximum stay of any hotel/motel guest shall be limited to six (6) months.
11. The hotel operator shall be responsible for the collection and payment to the City of Carlsbad of
Transient Occupancy Tax (TOT) for all persons staying 30 days or less. Transient Occupancy Tax
shall be based on the current rate established by City ordinance.
12. This permit shall be subject to revocation if the applicant fails to conform to any of the above
conditions of approval.
