Dear Mr. Nelson:
Thank you for discussing the temporary plastic drop cloths you are using at Gregorio's Restaurant with
me on July 21, 2010. As we discussed, your current redevelopment permit does not permit the use of
these drop cloths. This was an agreed upon condition to allow for approval of your permit for the
permanent awning that was installed to cover this outdoor dining area in 2005 and to address the
related parking requirement for Village Faire (which exempts outdoor dining areas from additional
parking if they are not enclosed). However, based on our further discussion today that the drop cloths
are required for both comfort ofthe diners and child safety reasons, and that all other options have
already been considered to provide an alternate form of windbreak, I accepted your verbal request to
amend your redevelopment permit to delete the condition prohibiting the use of said drop cloths.
Please accept this letter as formal acknowledgement that the subject condition (prohibition of drop
cloths) has been deleted from the approved redevelopment permit, with the understanding that the
currently installed drop cloths shall be maintained well and kept in good repair, and shali be replaced
when necessary to maintain a professional design quality for the restaurant. Please do not hesitate to
contact the City if you have any other questions or concerns about the conditions on your permit
and/or prior to making any other improvements for your outdoor dining area. This will ensure permit
compliance is not an issue in the future, and that we can be more proactive in assisting to make your
business successful.

Dear Mr. Nelson or Current Restaurant Owner:
On Thursday, June 24, 2010, City staff observed that your restaurant is currently using temporary style
plastic drop cloths for your outdoor dining area. These drop cloths are not permitted per your approved
administrative redevelopment permit that was issued on August 1,2005. Please see attached permit
approval which specifically notes that these type of drop cloths are not permitted for the outdoor patio
area. This was an agreed upon condition to allow for approval ofyour permit for the permanent awning
that was installed to cover this outdoor dining area. Although these drops cloths may have gone
unnoticed for some time, these drop cloths do violate your permit and must be removed immediately in
order for the restaurant to prevent revocation ofthe approval for the outdoor patio awning.
Although we understand that these drop cloths are being used as wind breaks and to guard against the
cooler weather, they are not permitted because the do not meet the design guidelines for the Village. If
it is essential for your business that you have weather protection for your outdoor area, you need to
consider alternate design options. For example, you may want to consider the type of glass wind breaks
installed by the Las Olas Restaurant and Dini's Restaurant both on Carisbad Boulevard. While we
understand that this type of weather protection is more expensive, it is consistent with the design
guidelines for the Village and can be permitted. To assist with the cost ofthis type of improvement, the
Redevelopment Agency offers storefront improvement grants which could be used for the installation of
these glass structures. Please review the attached program information and let me know if this is
fmancing that you would like to pursue to install the glass wind breaks. In the meantime, you will need
to remove the temporary drop cloths that you have installed to clear the noted permit violation.

On August 1, 2005 the Housing and Redevelopment Director conditionally approved
Administrative Redevelopment Permit No. RP 05-06 and Coastal Development Permit
No. CDP 05-30 for property located at 300 Carlsbad Village Drive, Suite 208. The
decision of the Housing and Redevelopment Director is subject to a ten (10) day appeal
period. The appeal period has elapsed and no appeals were filed.
Attached is a copy of the approved permit authorizing the installation of an outdoor
awning over the patio area of Gregorio's restaurant. Please review all conditions
carefully. In particular please note Condition No. 5, which prohibits the use of
temporary plastic drop cloths.
Having completed the land use review process, you may now proceed with the building
permit process. Please check with the Building Department for any questions related to
installation ofthe awning.

Administrative Redevelopment Permit Public Notification Packaqe
The public notification package shall include the following information:
a. A typewritten list of the names and addresses of ail property owners within a 300'
radius of subject property (including the applicant and/or owner). The list shall
include the San Diego County Assessor's parcel number from the latest
assessment roils.
b. 300' Radius Map: A map to scale not less than 1" = 200' showing each lot within
300' of the exterior boundaries of the subject property. Each of these lots shall
be consecutively numbered and correspond with the property owners list.
c. Since the property is also located within the coastal zone the following additional
notification materials are required: a radius map showing ail parcels within a
100-foot radius of the subject property; a list of addresses for ail occupants
within the 100-foot radius; and two-sets if mailing labels addressed to "Occupant"
for each address within the 100-foot radius.
d. Two (2) separate sets of mailing labels of the property owners within a 300'
radius of the subject property. The list must be typed in all CAPITAL LETTERS,
left justified, void of punctuation. For any address other than single-family
residence, an apartment, suite or building number must be included on a
separate line. DO NOT include it in the street address line. DO NOT TYPE

Department. The purpose of this letter is to provide a written response to your
application for an Administrative Redevelopment Permit. In order to complete
and continue processing of the application, the following items are needed.
First, we need the administrative redevelopment permit fee in the amount of
$335. Second, we need building plans for the proposed awning. In particular we
need a site plan, and a floor plan (which indicates the size of the restaurant, the
size of the outdoor eating area, and the number of tables and chairs both Indoors
and outdoors). The information on the size and number of tables and chairs
both inside and on the patio is critcial to analyze parking. Lastly, we need a
building elevation that indicates how the proposed awning is attached to the
building and how it is supported.
