I just talked with Skip from Hennessey's and he turned in the new floor plan for the restaurant. He said that you already have the
new floor plan and are calculating their new occupancy load. If you could let me know what their new numbers are, as well as any
comments you might have, I would appreciate it.

Initial review: (Note: This commentary identifies fire protection issues associated with
the project, and/or prescribes specific corrections or information needed to achieve Fire
Department approval.)
Fire department has reviewed this application and would comment that the floor
plan diagrams submitted do not reflect the existing interior environment. In order
to adequately assess the appropriate occupancy number for each scenario, applicant
should re-submit plans that reflect the current interior environment. Additionally,
in response to ongoing flre code compliance concerns, Fire would request that the
applicant strongly consider revising the exiting scheme from the Main building to
include the occupants of the rear (West-side) patio. This will help alleviate the need
to maintain two distinct occupant counts. All the while allowing patrons the
opportunity to move freely between these two areas.

Re: Redevelopment Permit Application - Hennessey's Carlsbad LLC
I received the Redevelopment Permit Review and Comment Request concerning
Hennessey's Carlsbad LLC dated April 22, 2008. The Police Department
concerns include:
1. Is having another restaurant with entertainment necessary or in the best
interest of the Redevelopment District and the City? The number of
restaurants with entertainment is a quality of life issue that, it seems to
me, should have some bearing on the approval ofthis request. I did not
see any comments in the application that supported any reasons for
increasing the number of restaurants with entertainment in the
Redevelopment District.
2. Potential noise from this establishment remains a concern. The applicant
may wish to confirm placement and type of entertainment meets the 65
decibel limit established in Chapter 8.09 ofthe Carlsbad Municipal Code.
3. The maximum size of the band and limited hours of operation should be
specifically identified in the new permit should one be approved

Dear Mr. Greenhoe:
Thank you for applying for a Redevelopment Pemriit in the City of Carlsbad. There are
items that need to be submitted in order to satisfy comments from other City
departments. The attached list includes information that must be submitted to complete
your applrcatbn. This list of items must be submitted directly to the Housing &
Redevelopment Office. Ail list items must be submitted simultaneously and a
copy of this list must be included with your submittal. No processing of your
application can occur until the applrcation is detennined to t>e complete. When all
required matenals are submitted to the Redevelopment Office, the City has an additional
thirty (30) days to make a detemiinatrcn of completeness. If the applrcation is
determined to be complete, processing for a decision on the applrcation wili be initiated.
In addition, please note that you have six months from the date the applicatrcn was
initially filed. April 3. 2008 to either resubmit the application or submit the required
information. Failure to resubmit the applrcation or to submit the materials necessary to
detennine your applrcation complete shall be deemed to -constitute withdrawal of the
applrcation. If an application is withdrawn or deemed withdrawn, a new application must
be submitted.

Dear Sirs,
As the owner of Roosevelt Center 2800 through 2820 Roosevelt Street,
Carlsbad, directly opposite Hennessey's, we object strongly to any increase in
activity at Hennessey's Tavern.
Firstly, we have discussed the fact that their patrons have no respect for our
property and ask Hennessey's to post their premises and advise their customers
they must not park at Roosevelt Center. This did not happen. We have posted
our property; Hennessey customers must not park in Roosevelt Center.
This has littie effect, customers leave cars overnight; drive into our building
walls. Hennessey's customers make statements like; you have no authority and
walk away; they also get very angry at our tenants. We have towed cars, but it
makes no difference; sometimes these peopie come back and damage our
property. Their customers treat our property with no respect, more like a public
parking lot.
When St Patrick's day comes around the entire area is a circus; we cannot
control anything; we have to pay a guard service to protect our property so that
our tenants have parking spaces for their customers. We suffer from excess
trash and landscape damage; Hennessey's is not a good neighbor.
We object and feel that as long as Hennessey's has inadequate parking or
parking that does not relate to, or is not located for their customers' easy access
and use, they should not be allowed to increase the burden on neighboring
properties.
Roosevelt Center is a paridng oasis in an area of under pariced old businesses,
we are burdened by these non-conforming uses, Donut Shop, etc.

Dear Mr. Greenhoe:
As you are aware, the Hennessey's Tavern project, RP 08-17, had a comment period
from Friday, August 8^*^, until Monday, August 18^. During this period, we received one
comment sheet from a property owner within the 300' radius of your property. Please
see the attachment to view the comment letter. We would encourage you, as a business
owner, to find some way that the concerns addressed in the comment letter can be
resolved. The Redevelopment Department suggests possibly limiting live entertainment
at Hennessey's to the evening hours to lessen parking issues that may arise with
neighboring businesses. For example, entertainment could be from 7 p.m. to 11 p.m.
Sunday through Wednesday, and 7 p.m. to 12:30 a.m. Thursday through Saturday.
Please review the letter and our suggestion and then inform us how Hennessey's can
resolve the issue.

On August 27, 2008 the Housing and Redevelopment Director approved Administrative
Redevelopment Permit No. RP 08-17 for property located at 2777 Roosevelt Street.
The decision of the Housing and Redevelopment Director is subject to a ten (10) day
appeal period. The appeal period has elapsed and no appeals were filed.
Attached is a copy of the approved permit authorizing the change in use from
"restaurant" to "restaurant with entertainment." Please review all conditions carefully.
Violation of the conditions could result in revocation of this permit.

Thursdays: Amplified music between the hours of 9pm-lam (3-4
piece band)
Fridays: Amplified music between the hours of 9pm-lam (3-4 piece
band)
Saturdays: Amplified music between the hours of 9pm-lam (3-4
piece band)
Sundays: Amplified music between the hours of 9pm-lam (3-4 piece
band)
On occasion, there may be events (i.e. private parties, city events, street faire, etc.) that
might require bands/DJs outside those hours, but never before 1 lam and never after lam.
