Dear Laura:
The City of Carlsbad's Redevelopment Agency iias completed tlie review and
processing of your application for an Administrative Permit to allow tables and
chairs to be placed within the public right-of-way for use as a sidewalk cafe at Le
Passage Restaurant, 2961 State Street. The permit has been approved. The
approved permit and portions of the approved plans are enclosed for your
records. A full size copy of the approved plans will be kept on file with the
Housing and Redevelopment Department. Please read ail conditions carefully.
It is very important that you understand these conditions and that you comply
with them. Violation of the conditions could result in revocation of this permit.

RE: OUTDOOR DINING ENCLOSURE
Dear Laura:
Thank you for your letter of March 30, 2010 regarding a move of the landscape planter three feet to the
north to allow for the enclosure of your outdoor seating area for Le Passage restaurant. Before making a
decision on the relocation ofthe planter, it is requested that you submit an application to amend your
existing permit for outdoor tables and chairs. A copy of your current permit is enclosed for your
information with a copy ofyour approved site plan for said tables and chairs. The approved permit does
not include the railing you have proposed to enclose this area. Therefore, you will need to amend your
permit in order to do so. An application for the amendment is enclosed as well to assist with this
process. Once you obtain approval from our office, you will also need to obtain an encroachment permit
from the City's Engineering Department to install the railing in the public right-of-way.
In reviewing your application amendment, we will be able to determine the best location for the
planter. I noticed in your approved permit that the tables and chairs were to be located at the curb
rather than immediately adjacent to your building. If you wish to keep them next to your building, you
should include this new location in your amended permit application. Please include all dimensions and
the location ofthe planter as it currently is placed in the right-of-way. Please also show where you
would like to have the planter relocated to in order to accommodate your enclosed dining area.
The fee for the application to amend your sidewalk tables and chairs permit is $161. Please submit
payment ofthis fee with your application. If you have any questions, please contact Austin Silva in our
office at (760) 434-2813. He will assist you with the processing ofyour application.

Dear Debbie,
We are requesting that as part ofthe Storefront Improvement Program the sidewalk planter be
moved north by 36 inches (three feet)« This would allow for Le Passage to enclose the two tables
we have out front with a railing and keep the planter in it's present location on State Street,
This would greatly enhance the sidewalk dining experience and allow Le Passage to serve beer
and wine to our guests per ABC regulations within the enclosure. We believe that the railing
enclosure would complete the bistro look very popular among restaurants such as those in Paris
or like those in the gaslamp district in downtown San Diego.
In addition, this small adjustment would provide adequate space for pedestrians, wheelchairs,
or strollers to pass thru on the sidewalk. Lastly, the planter adjusted from it's present location
would not disrupt the character ofthe planters or their value to the beautification effort you
outlined in your letter dated March 25*,
