Supplemental to Application Form
Project Name: Real Blue Properties and Blue Jay Interiors
Project Address: 2956 Roosevelt Street, Suites 1 and 2
This application is to allow for approval of a change in use of Suites 1 and 2 at 2956 Roosevelt Street
from a retail only (previous) use to a retail and real estate office use. The two suites noted (800 square
feet total) are intended to be shared by Blue Jay Interiors (retail use) and Realblue Properties (real
estate office use) as one contiguous space. Blue Jay Interiors will operate as a retailer of Carlsbad
branded gifts, crafts, and design decor. The business license for this business has already been approved
and the business is operational. Realblue Properties offers real estate and property management
services, and is the applicant to allow approximately 400 square feet (about 50%) of the total
contiguous space to be used as a real estate office.
The property is located in Land Use District 1 of the Village Master Plan and Design Manual, and is also
located in the Coastal Zone for the Village Area. Real Estate offices are a provisional use within Land Use
District 1. In addition, because the property is located with the Coastal Zone segment of the Village, the
Master Plan indicates that all ground floor uses in the Coastal Zone of the Village must provide for uses
that are visitor-serving commercial and/or services which will aid in the comfort/enjoyment of a tourist
or a regional guest's visit to the area.
The combined uses of retail sales of Carlsbad branded gifts, crafts and design decor and property
management/real estate services will provide both visitor-serving commercial products and services,
and meet the intent of the Village Master Plan to provide a lively mix of uses in this core Village area and
provide for services which aid local and regional visitors. The real estate/property management office
component of the proposed use is small in scale (less than 400 sf) and consumer-oriented in nature. It
will not disrupt retail continuity and is located in an area which already provides for several office uses
and is between two public parking lots.
Within the commercial complex, there are currently 6 office/retail suites. The other land uses are office
and commercial services; not general retail. As a result, the proposed change in land use to retail/office
would not result in land use conflicts or disrupt retail continuity, and actually enhance the consumer-
oriented and visitor serving nature intended for the area. It should be noted that there is very limited
retail on the entire block. The land uses in the block are primarily office and/or a commercial services
(mostly non visitor-serving commercial). Our particular building is also located between two public
parking lots.
No buildings will be built or expanded as part of this application, and there are no other improvements
proposed for the site. This application is for a land use change only to allow for both the retail and real
estate office use in Suites 1 and 2 of the property located at 2956 Roosevelt Street. Based on the above
description of the project, as the applicant, I believe the following findings can be made to allow for the
proposed change in use and/or to allow the provisional use of real estate office at the noted location:
1. The office is compatible in scale and character to the surrounding Village development (because
it is only about 400 sf in size) and much less than some of the surrounding office developments).
2. The development is not likely to negatively impact existing or planned retail continuity in
significant concentrations of commercial shops (because the building design is not conducive to
retail operations due to its setbacks from the street and architectural features, and there is very
limited retail already located on the block).
3. Sufficient on-site parking is available to serve employee and customer parking needs (because
the parking requirements for retail and office are the same, and no parking will be removed).
4. The office will not result in an undue reduction of livability for adjacent residents (because there
are no adjacent residents)
In addition, the combination of uses (retail and real-estate/property management services which are
consumer-oriented) will meet the intent of providing visitor-serving commercial uses at the ground floor
of all buildings in the Village segment of the Coastal Zone because the primary use will be the retail sales
of Carlsbad-branded crafts, home decor, etc. The real estate and property management services will be
an accessory use to the retail, visitor-serving use at the noted location.

The City has completed a review of your application for an Administrative Review Permit RP 13-12 to
allo~ a vacant commercial space to be used as office space located at 2956 Roosevelt Street, in District
1 of the Village Review (V-R) Zone, and in Local Facilities Management Zone 1. A notice was sent to
property owners within a 300' radius of the subject property requesting comments regarding the above
request. No comments were received within the ten day notice period (ending on October 2, 2013).
It is the City Planner's determination that the project, RP 13-12-Realblue Properties, is consistent with
the Carlsbad Village Master Plan and Design Manual and with all other applicable City ordinances and
policies. The City Planner, there APPROVES this request based on the following:
Findings:
1. The City Planner has determined that the project is consistent with the policies, goals and action
programs set forth within the Carlsbad General Plan in that the office use provides
employment opportunities and complements the existing commercial and residential uses in
the pedestrian-oriented downtown Village.
2. The City Planner has determined that the project is consistent with Chapter 21.35 (Village
Review Zone) of the Carlsbad Municipal Code and all applicable development standards and
land use policies set forth within the Village Master Plan and Design Manual in that the office
use will not break up retail continuity on Roosevelt Street. The proposed office space is
located between two public parking lots and there is no existing retail elsewhere located on
this block of Roosevelt Street. There are no anticipated impacts to the nearby residents as a
result of the office use locating in the proposed space. No additional parking is required for
the change to an office use.
3. That the total cost of the proposed development is less than $60,000.
4. That the City Planner has determined that the project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per section 15303 Class 3 of the State CEQA
Guidelines as the project involves the conversion of an existing small structure from one use to
another where only minor modifications are made to the structure and will not have any
adverse significant impacts on the environment.

5. The City Planner has reviewed each of the exactions imposed on the Developer contained in
this approval, and hereby finds, in this case, that the exactions are imposed to mitigate impacts
caused by or reasonably related to the project, and the extent and the degree of the exaction is
in rough proportionality to the impact caused by the project.
Conditions:
1. Approval is granted for RP 13-12 as shown on Exhibit "A" dated October 9, 2013 on file in the
Planning Division and incorporated herein by reference. Development shall occur substantially
as shown unless otherwise noted in these conditions.
2. If any of the following conditions fail to occur, or if they are, by their terms, to be implemented
and maintained over time, if any of such conditions fail to be so implemented and maintained
according to their terms, the City shalt have the right to revoke or modify all approvals herein
granted; deny or further condition issuance of all future building permits; deny, revoke, or
further condition all certificates of occupancy issued under the authority of approvals herein
granted; record a notice of violation on the property title; institute and prosecute litigation to
compel their compliance with said conditions or seek damages for their violation. No vested
rights are gained by Developer or a successor in interest by the City's approval of this
Administrative Review Permit.
3. Staff is authorized and directed to make, or require the Developer to make, all corrections and
modifications to the Administrative Review Permit RP 13-12 documents, as necessary to make
them internally consistent and in conformity with the final action on the project. Development
shall occur substantially as shown on the approved Exhibits. Any proposed development
different from this approval shall require an amendment to this approval.
4. The Developer/Operator shall and does hereby agree to indemnify, protect, defend and hold
harmless the City of Carlsbad, its Council members, officers, employees, agents, and
representatives, from and against any and all liabilities, losses, damages, demands, claims and
costs, including court costs and attorney's fees incurred by the City arising, directly or indirectly,
from (a) City's approval and issuance of this Administrative Review Permit, (b) City's approval
or issuance of any permit or action, whether discretionary or non-discretionary, in connection
with the use contemplated herein, and (c) Developer/Operator's installation and operation of
the facility permitted hereby, including without limitation, any and all liabilities arising from the
emission by the facility of electromagnetic fields or other energy waves or emissions.
5. The Developer shall comply with all applicable provisions of federal, state, and local ordinances
in effect at the time of building permit issuance.
6. Prior to the issuance of a building permit, owner/applicant shalt submit to the City a Notice of
Restriction to be filed in the office of the County Recorder, subject to the satisfaction of the City
Planner, notifying all interested parties and successors in interest that the City of Carlsbad has
issued an Administrative Review Permit on the real property owned by the owner/applicant.
Said Notice of Restriction shall note the property description, location of the file containing
complete project details and all conditions of approval as well as any conditions or restrictions
specified for inclusion in the Notice of Restriction. The City Planner has the authority to execute

and record an amendment to the notice, which modifies or terminates said notice upon a
showing of good cause by the owner/applicant or successor in interest.
7. This approval shall become null and void if building permits are not issued for this project within
24 months from the date of project approval.
Engineering:
NOTE: Unless specifically stated in the condition, all of the following conditions, upon the approval
of this proposed development, must be met prior to approval of a building permit.
8. Developer shall comply with the City's Stormwater Regulations, latest version, and shall
implement best management practices at all times. Best management practices include but are
not limited to pollution treatment practices or devices, general housekeeping practices,
pollution prevention and educational practices, maintenance procedures, and other
management practices or devices to prevent or reduce the discharge of pollutants to
stormwater, receiving water or stormwater conveyance system to the maximum extent
practicable. Developer shall notify prospective owners and tenants of the above requirements.
Code Reminders:
9. Approval of this request shall not excuse compliance with all applicable sections of the Zoning
Ordinance and all other applicable City ordinances in effect at time of building permit issuance,
except as otherwise specifically provided herein.

CEQA Determination:
This is to advise you that after reviewing the application for the project referenced above, the City has
determined that the following environmental review process (pursuant to CEQA) will be required for the
project:
The project is exempt from the provisions of CEQA, pursuant to CEQA Categorical Exemption for the
conversion of small structures from one use to another where only minor modifications are made to
the interior-Section 15303. No environmental review is required for the project.
A Notice of Exemption will be filed after approval of the project with the San Diego County Clerk's Office
which involves a filing fee. Please submit a check to the project planner in the amount of $50.00 made
out to the San Diego County Clerk. The check should be submitted approximately one week prior to
the City Planner decision date.
Target Decision Date:
In the interest of expeditiously processing your application consistent with the State Permit Streamlining
Act (California Government Code Section 65950), an administrative decision to approve or deny the
project should be determined by November 15, 2013.
