Indemnification and Insurance Requirement for Village Area Administrative Permit
Certification Statement:
I Certify that I am the Legal Business Owner of the subject business and that all of the above information is true
and correct to the best of my knowledge. I agree to accept and abide by any conditions placed on the subject
project as a result of approval of this application. I agree to indemnify, hold harmless, and defend the City of
Carlsbad and its officers and employees from all claims, damage or liability to persons or property arising from or
caused directly or indirectly by the installation or placement of the subject property on the public sidewalk and/or
the operation of the subject business on the public sidewalk pursuant to this permit unless the damage or liability
was caused by the sole active negligence of the City of Carlsbad or its officers or employees. I have submitted a
Certificate of Insurance to the City of Carlsbad in the amount of one million dollars issued by a company which
has a rating in the latest "Best's Rating Guide" of "A-" or better and a financial size of $50-$100 (currently class
Vll) or better which lists the City of Carlsbad as "additional insured" and provides primary coverage to the City.
I also agree to notify the City of Carlsbad thirty days prior to any cancellation or expiration of the policy. The

CEQA Determination:
This is to advise you that after reviewing the application for the project referenced above, the City has
determined that the following environmental review process (pursuant to CEQA) will be required forthe
project:
The project is exempt from the provisions of CEQA, pursuant to CEQA Categorical Exemption for New
Construction or Conversion of Small Structures - State CEQA Guidelines Section 15303. No
environmental review is required for the project.
A Notice of Exemption will be filed after approval ofthe project with the San Diego County Clerk's Office
which involves a filing fee. Please submit a check to the project planner in the amount of $50.00 made
out to the San Diego County Clerk. The check should be submitted approximately one week prior to
the City Planner decision date.
Target Decision Date:
In the interest of expeditiously processing your application consistent with the State Permit Streamlining
Act (California Government Code Section 65950), an administrative decision to approve or deny the
project should be determined by September 21, 2015.
Therefore, in the interest of achieving that decision date/hearing date, all remaining project issues must
be addressed by September 7, 2015. If all project issues are not resolved by the date listed above, you
may formally request a one-time 90 day application extension. Otherwise, you will need to withdraw
the application.

Thank you for applying for Land Use Permits in the City of Carisbad. The Planning Division has reviewed
your Curb Cafe Permit, application no. RP 14-23, as to its completeness for processing.
The items requested from you eariier to make your Curb Cafe Permit, application no. RP 14-23 complete
have been received and reviewed by the Planning Division. It has been determined that the application
is now complete for processing. Although the initial processing of your application may have already
begun, the technical acceptance date is acknowledged by the date ofthis communication.
Please note that although the application is now considered complete, there may be issues that could be
discovered during project review and/or environmental review. Any issues should be resolved prior to
scheduling the project for public hearing. In addition, the City may request, in the course of processing
the application, that you clarify, amplify, correct, or otherwise supplement the basic information

ISSUES OF CONCERN
Planning:
1. Please add the project number to the top right corner of the plans: RP 14-23.
2. Please label that there are 15 curb cafe seats.
Engineering:
Although LDE has no remaining issues the applicant should be aware of the remaining comments and
conditions.
PERMITS AND APPUCATIONS:
1. Prior to approval of the Curb Cafe Permit, the applicant/permittee must sign an Indemnification
Statement holding the City of Carlsbad harmless from any legal action resulting from the curb caf^
operations and or approved enclosures.
2. Prior to approval of the Curb Cafe Permit, the applicant must submit a Certificate of Insurance to
the City of Carlsbad in an amount to be established by the Risk Manager of the City of Carisbad. The
City shall be listed as an "additional insured" on the certificate.
3. Prior to approval of the Curb Cafe Permit, the applicant shall apply for and obtain an Encroachment

4. Prior to installation of the curb cafe, the applicant shall apply for and obtain a Right of Way Permit.

5. Prior to approval of the Right of Way permit, permits for the installation of a grease interceptor
shall be obtained and the grease interceptor shall be installed in accordance with city requirements
and standards. Contact the City of Carisbad Utilities Division of the Public Works Department at
(760) 602-2420 for more information.
6. Prior to installation of the curb cafe, if electrical service or lighting is proposed, an electrical
permit from the building department may be required.

Thank you for applying for Land Use Permits in the City of Carisbad. The Planning Division has reviewed
your Curb Cafe Permit, application no. RP 14-23, as to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information which
must be submitted to complete your application. The second list is project issues of concern to staff. In
order to expedite the processing of your application, the "incomplete" items and your response to the
project issues of concern to Staff must be submitted directly to your staff planner; therefore, please
contact your staff planner directly to schedule a re-submittal appointment. As part of your re-submittal
package, please prepare and include with your re-submittal: (1) a copy ofthese lists, (2) a detailed letter
summarizing how all identified incomplete items and/or project issues have been addressed; and (3) five
(5) sets of revised plans. No processing of your application can occur until the application is determined
to be complete.
When all required materials are submitted, the City has 30 days to make a determination of completeness.
If the application is determined to be complete, processing for a decision on the application will be
initiated. In addition, please note that you have six months from the date the application was initially
filed, December 22, 2014, to either resubmit the application or submit the required information. Failure
to resubmit the application or to submit the materials necessary to determine your application complete
shall be deemed to constitute withdrawal of the application. If an application is withdrawn or deemed
withdrawn, a new application must be submitted.

Planning:
1. An administrative Village Review Permit and Coastal Development Permit for the proposed expansion
ofthe restaurant is required to be approved priorto issuance of a Curb Cafe Permit. The requirement
for an administrative Village Review Permit and Coastal Development Permit is a correction on the
tenant improvement building permit (CB 14-3016) dated November 10, 2014.
Engineering:
GENERAL INFORMATION TO BE INCLUDED AND/OR VERIFIED ON THE ENGINEERiNG DRAWING:
1. Barriers (including planters, rails, walls, etc.) are not to exceed 36" in height as measured from street
surface.
2. Plants not to exceed 42" in height as measured from the street surface.
3. Indicate the size, color and material ofthe umbrella(s). Umbrella pole and frame shall be made of
wood or metal covered with fabric. No plastic or vinyl material is allowed. Minimum height of the
open umbrella structure is 6'-8".
4. Indicate if electrical and/or lighting is proposed and provide plans and specifications if so No drop
cords or overhead extensions from the roof of the building will be allowed. An electrical permit from
the building department will be required.
5. Indicate that there shall be in skirting or other obstructions other than the paver pedestals impeding
the free flow of drainage along the curb face and within the street section.
6. Address the following sheet specific comments:
Ll.Ol:
• Dimension a I'-O" clearance from the parking striping to the curb cafe perimeter.
• Clarify what portions of the ABC metal barrier are fixed or openable. Comply with ADA
minimum access requirements.
• Add a callout for the proposed umbrella.
• Delete the temporary crash barriers.
• Specify the locations of the 'High Performance Tubular Posts" called out on sheet L1.02 Detail

PERMITS AND APPLICATIONS:
1. Prior to approval of the Curb Cafe Permit, the applicant/permittee must sign an Indemnification
Statement holding the City of Carlsbad harmless from any legal action resulting from the curb cafe
operations and or approved enclosures.
2. Priorto approval ofthe Curb Cafe Permit, the applicant must submit a Certificate of Insurance to the
City of Carisbad in an amount to be established by the Risk Manager of the City of Carisbad. The City
shall be listed as an "additional insured" on the certificate.
3. Prior to approval of the Curb Cafe Permit, the applicant shall apply for and obtain an Encroachment
Agreement from the Land Development Engineering Department. Complete and submit Engineering
Plancheck Application E-23 and Encroachment Agreement Submittal Checklist E-9 to the Land
Development Engineering Counter at 1635 Faraday Avenue, Carisbad CA together with the
