I am enclosing a copy of a letter from your firm dated June 8, 1984, over the signature of Georgia W. Barksdale. That letter represents your original application for a street vacation. There is no reference to "...(the City's) directive and require- ment for the vacation,...". I am prepared to recommend to the City Council that you receive a refund of $266.67. In my informational material to the City Council I will explain your position, and your letter of January 7, 1985. There is no need for you to drive 100 miles to plead your case. If there were any costs incurred, that cost should be borne by planning commission and not me. Had I initiated the action for my own personal benefit, I would concur with your position. It is unconscionable for you to absolve the City of responsibility when it was clearly their directive and requirement for the v^ication, and then subsequent reversal that created the problem. Further, it is unwarranted that I need to petition the council, drive 100 miles and plead my case when this matter should be handled internally, and a full refund be granted. Besaw Cornerstone Management Inc. 16131 East Whittier Blvd., Suite 100 Whittier, California 90603 IN REPLY PLEASE REFER TO PR 6.61 Dear Mr. Besaw: With reference to your letter of December 14, 1984, the California Streets and Highways Code provides that the fee for a street vacation bear a relationship to the cost to the city for processing the application. In the case at hand, we estimate that approximately one-third of the office work in processing a street vacation was performed by the City before the Planning Commission took final action on your project. Accordingly, we can recommend to the City Council that you receive 2/3 refund of the fee paid, which amounts to $266.67. Please let me know if this is satisfactory to you. If it is not, you may petition the City Council for a refund of the full $400.00 amount or, in the alternative, request the City to continue to process your application for a street vacation through the City Council, with whom final authority lies. (The Planning Commission discouraged the street vacation but it did not have the legal authority to deny it.) Very truly yours. RONALD A. With respect to Condition No. 1, it is our feeling that the proposed layout is marginal, but that it can be tolerated by the City. We suspect that the minimvun design shown may ultimately be reflected in tenant dis- satisfaction and subsequent inability by the owner to rent space in the building. With respect to Condition No. 2, we feel that the alley, as public property, must be protected from encroachment and inefficient operation. Condition No. 1. 170 sq. ft. parking space ( 8.5» x 20* ). In the garage structure we are proposing 9*xl9* spaces each 171 sq. ft, with standard columns spacing 27* Cnt. to Cnt. Excluding 14" Dia. columns clear width of spaces are 8.6I* more than 8.5* required. Columns shade 14" wide creates additional comfort for the car door opening. Please note that three spaces surrounded by solid walls would be sufficient according to standards ( 3x8.5**25.5* ). This parking design was originally approved back in 198I. We have complete working drawings, based on 99* and 64' outside building dimensions. Providing 24* aisle and 12" thick cone, block walls, we are left with 19* deep parking space. The longest car built In I98O (see attachments) was the Chrysler New Yorker, 222"x78" « l8.5*x6.5* and the average large car was I8.14'x6.42* . In I98O medium cars averaged I6.2*x5.9' and the small car averaged I4.1*x5.4', they can all be accommodated in your standard compact parking space 17'x8 *. Presently we have 3 (three) compact spaces in the garage (allowable 10), we could call for one compact space between each column, but it would not be our preference. Condition No. 2. Seven parking spaces adjacent to 20' wide alley lacking (perhaps some time in the future) a two foot wide strip of land belonging to the property across the alley for vehicle manuvering.
