During the public notice period, there was some concern about the
potential of noise coming from patrons using the patio of the
restaurant during the late hours. To reduce the potential of noise
being a problem, staff and the applicant have come up with an
additional condition for the project. The condition would read
"The use of the restaurant patio shall cease at 12:00 am". This
would allow the patrons of the restaurant to finish the last meal
which is served as late as 11:00 pm.

Resolution No. 185, approving an amendment to the redevelopment
permit, does not contain a finding that the amendment is consistent
with the general plan. It also does not contain a finding of
consistency with the Village Redevelopment Area Plan. These
findings are required by C.M.C. sections 21.35.100 and 21.35.115.
Please refer to my last memorandum on the approval of a major
redevelopment permit for more details.
Finding No. 2 states that the project meets all the requirements of
the "Zoning Ordinance" by providing adequate setbacks and parking.
This reference should be to a specific chapter or chapters of Title
21.
To allow the public and members of the design review board to
understand which "Zoning Ordinances" are being applied in these
approvals, the staff report should reference Chapter 21.35 (major
redevelopment permit) and Chapter 21.81 (Coastal Development
Permits in the Village Redevelopment Area.)

Dear Mr. Dini,
This letter is in response to your request that the City waive any additional
sewer pennit fees that will be required as a result of your proposed outdoor
patio dining area.
The City's sewer ordinance, Title 13.10.020(a) states, "A sewer permit shall
be required for any structure which is altered, remodeled or expanded where
such alteration, remodeling or expansion results^ in an increase in the
equivalent dwelling units of sewage generated from such structure."
Your proposed outdoor patio dining area will add an additional 18 seats
which by code will generate one additional EDU (equivalent dwelling unit)
of sewage for each seven seats or fraction thereof. You mentioned in your
letter that you feel that the additional seating provided by the patio will
transfer a large portion of your clientele to the patio area but will not
maximize your overall seating. The code makes no provisions for whether
or not the seating provided in the restaurant is used to is maximum
potential, it is based solely on the number of seats provided.
City staff has no ability to grant your request of the waiving of code required
sewer permit fees.

I did speak with Pat Guevara at the Carlsbad Mimicipal Water District
regarding your request. He informed me that he has been working with you
recently regarding questions you have had conceming your monthly sewer
service fees which are based on water used and not sewer permit EDU*s.
Pat also confirmed the fact that you would be required to pay the additional
sewer pennit fees as required by code for the additional sewer EDU's
generated by your proposed additional patio dining seating. These additional
sewer permit fees are required to be paid at the time of issuance of a your
building permit for your patio dining area.
If you have any further questions regarding this issue please direct them to
Pat Guevara at the Water District at 438-2722 extension 132.

Dear Mr. Dini:
There are a few items on the plans submitted for the patio addition that should be
addressed. The landscape plan should call out the existing location of the palm tree to
be moved. The landscape plans should reflect the usage of mulching in the planting
areas. Also label the existing manhole cover. Signage for the site may be affected by
the proposed signage on the elevations shown. I don't know how much signage is
existing to know if the signage shown will be over the allotment for the site. If you could
provide some data on this, I can look into this matter for you. The sign will require a
separate permit.
Your application has been tentatively scheduled on May 20, 1992. In order for us to
proceed, we must perform the noticing as required in Section 65091 of the California
Government Code. If the required items are not received by April 30,1992, your project
will be rescheduled for a later hearing. In the event that the scheduled hearing date is
the last available date for the City to comply with the Permit Streamlining Act, and the
required noticing items have not been submitted, the project will be scheduled for denial.
Please submit two sets of the required 600' radius map, list of property owners, labels
for each property owner and for the applicant, and postage. Your application will not go
forward until these items have been received. Please sign the attached statement and
return it with your labels.

$E5000.00 in sewer impact fees when we first built this res-
taurant five years ago.
With the present poor economy and the general business problems
of the Carisbad area we have never reached our original sewer
impact projection and feel that this $'^800.00 fee should be
waived. We pay heavy sewer fees on a monthly basis due to water
use in our restaurant.
We feel the additional seating provided by the patio will trans-
fer a large portion of our clientele to this outside area but
will not maximize our overall seating to equal the rates of the

Being in business today is tough on everybody and high fees of

Planning department staff reviewed the proposed patio addition to
the existing restaurant located at 3290 Carlsbad Blvd. on February
7, 1992. The following issues were brought up:
1. This proposal would require an amendment to the existing
Major Redevelopment Permit RP 84-11.
2. There are concerns of reducing the already limited front
yard setback. Staff would like to retain the landscaped
setback along the Carlsbad Blvd. corridor. One
alternative would be to eliminate the perimeter wall and
glass screen to keep the effect of an open setback. If
the project were brought forward, an increase in the
quality of landscaping would be required.
3. The proposed project would require 4 additional parking
spaces. Per section 21.44.050(5), there is a provision
for a reduction of 15% for common facilities. Since the
Inn and restaurant are related uses, and the Inn has
extra parking available, the total parking spaces for
both uses would still conform, therefor there is adequate
parking available.
4. The existing right-of-way along the property frontage on
Carlsbad Blvd. is 0.5 Ft from the back of sidewalk, not
4'6" as shown on the preliminary plan.
5. Due to the possible future need for additional right-of-
way along Carlsbad Blvd, the engineering dept. will
require the proposed patio to maintain the 4.5 ft
structural setback from the back of sidewalk as shown.
Engineering may require an offer-of-dedication for an
additional 4.0 ft with the formal submittal of this
project.
6. Be aware that the proposed outdoor patio/seating (18 seat
increase) will also increase the sewer Equivalent
Dwelling Unit's (EDU) and sewer impact fees.
