Chris Salomone, Tony Mata and I have discussed your letter of
January 29, asking to be relieved of installing the mansard
on the back side of the stairway and the west side of the building.
We are able to find a compromise that might make it easier for you
to complete the requirements of the Design Review Board. We believe
light weight aluminum or fiberglass roof covering would work and
would satisfy the condition. You should complete this requirement.
The condition can be removed only by the Design Review Board.

Dear Mr. Orenyak,
I'm in receipt of your letter of 27 January, 1986, regarding
certain design requirements on the building at 2911 State Street
(Plaza de la Fuente). Please be assured that I did not intentionally
disregard any conditions of approval for the project.
During the period subsequent to the design review meeting and the
final city approval of my plans, it was determined that the continuation
of the tile mansard accross the back side (west) of the stairway landing
would project into the alley right-of-way and interfere with traffic,
and if builf" back into the deck it would not allow adequate space for
the stairs. It was made Note 1 on Sheet 1 of Plan #84-547.
The extension of the tile mansard accross the rear roofline of the
building (west side) was only deleted after much study and the determin-
ation that it would require the cutting into the roof and would be a
major structural modification to the 65 year old building, and not worthy
of the possible risk involved. This change was made Note 2 of Sheet 1
of Plan #84-547.
These modifications were made only after diligent consideration and
discussions with city redevelopment, city building department officials
and my engineer and architect. It was never my intent to disregard or
show a lack of interest in Resolution 039; just the contrary.
I was of the understanding that these modifications had been thoro-
ughly discussed and cleared by city staff and confirmed when my final
plan was approved on December 11, 1984 by the city building department.
Please let me assure you that I have the greatest respect for the
City of Carlsbad, and that my motivation for undertaking the restoration
of the old Los Diego Hotel included making a contribution to the city's
redevelopment effort. It is my hope that this review of my position
will clarify the possible misunderstanding that seems to exist and that
you will be able to reconsider your intent to deny further occupancy of
the premises.
In this regard, I would appreciate at your earliest convenience,
meeting with you, Chris Salamoni and Tony Mata to discuss this matter
and to seek a satisfactory solution. I can be available any time this
week or next and would suggest we meet at the building (2911 State St.).

Dear Mr. Betz;
This department has become concerned regarding your disregard of a
specific condition of approval for your project at the southwest corner
of State and Grand.
Resolution No. 039 was amended to add this additional condition:
Tile on west end of building to be extended at the top of
the stairway to the north end and the tile on the roof to
be extended from the north to the south end of the building
on the west side.
Since you have shown no apparent interest in complying with this
condition, this department has no recourse but to deny any further
requests for occupancy of the premises.

testing and design data prepared as follows:
1. Calculations sheets 1 to 17, P)|^5 2
2. Plans of building and details for rehab.. Sl to S5 and specs.
3. Testing results from Testing Engineers.
4. Detailed catalog cuts for anchors, etc.
5. Correspondence from your office depicting requirements to conform.
This report will also satisfy the State Historical Building Code set forth.

MEMO FOR THE RECORD May 17, 1984
SUBJECT: Engineering inspection of building at State and Grand
On 16 May 1984 Neste, Brudin and Stone, Inc., Civil Engin-
eers, provided an on-site visual inspection of the building
located on the southwest corner of State and Grand to provide
a preliminary structural report to determine whether the build
ing is sound and to report any apparent weakness.
A company representative, Mr. CR. Babcock, P.E., conducted
the inspection which included all exposed exterior surfaces,
the interior, the attic, the roof, the heating room, the sub-
flooring and the foundation from beneath the building. As
contracted, a verbal opinion and observation review was submit
ted that in summary indicated the following:
A. The basic structural integrity of the building is sound.
B. Some portions of the sub-floor and supports are in need
of remedial repairs due to apparent previous termite dam-
age.
C. Roof tiles should be replaced by new tiles and installed
in conformance with code for safety.
3, The below signed accompanied Mr. Babcock on the inspection and
received a detailed verbal commentary and opinion on all aspects
of the building.
4, Mr. Babcock stated his availability to provide follow-up com-
ments/opinions as necessary on those areas of the building he
inspected .
