III. DISCUSSION OF ENVIRONMENTAL EVALUATION
Tne applicant is proposing construction of a commercial retail
and 70 unit hotel complex over underground parking. 9,700 square
feet of retail use is proposed, as well as 3,290 square feet for
tne hotel. Presently, the site is vacant and designated for
travel-service types of uses by the Coastal Commission. These
types of uses are consistent with the zoning (V-R, Sub area 5)
and general plan (travel-service). Staff believes the use is
compatible with surrounding uses and also with travel-service
types of uses which are either planned or under construction
along Carlsbad Boulevard.
A traffic study has been performed and City Staff determined
there were no significant impacts created by this proposed
project.
The site presently slopes very slightly to the east. The only
excavation which will take place will be to level the site and
create the underground garage.
Overall, the project meets City requirements and staff believes
it will be a handsome addition to the City.

IV. DETERMINATION (To Be Completed by the Land Use Planning Office)
On the basis of this initial evaluation:
A" I find the proposed project COULD NOT have a significant effect on
the environment, and a NEGATIVE DECLARATION will be prepared.
I find that although the proposed project could have a significant
effect on the environment, there will not be a significant effect in
this case because the mitigation measures described on an attached
sheet have been added to the project. A Conditional Negative
Declaration will be proposed.
I find the proposed project MAY have a significant effect on the
environment, and an ENVIRONMENTAL IMPACT REPORT is required.

NEGATIVE DECLARATION

The City of Carlsbad has conducted an envirorvnentai review of the
above described project pursuant to the Guidelines for Inplementation
of the Califomia Environnental Quality Act and the Environroental
Protection Ordinance of the City of Carlsbad. As a result of said
review, a Negative Declaration (declaration that the project will not
have a significant impact on the environment) is herd^y issued for the
subject project. Justification for this action is on file in the
Planning Department.
A copy of the Negative Declaration with supportive documents is on
file in the Planning Department, City Hall, 1200 Elm Avenue, Carlsbad,
CA. 92008. Ccmnents from the public are invited. Please suhnit
ocmnents in writing to the Plcuining Department within ten (10) days of
date of issuance.
