SUBJECT: RP 85-20 - MC WHA - Request for a minor redevelopment
permit to APPROVE a Seafood retail use on the southeast
corner of Carlsbad Blvd. and Oak AVe. in subarea 5
of the Village Redevelopment Area.
I. RECOMMENDATION
It is recommended that Design Review Board ADOPT Resolution No. 059
APPROVING RP 85-20 based on the findings contained therein.
II. ITEM EXPLANATION
At their meeting of October 9, 1985, the Design Review Board heard
a presentation on RP 85-20 - Mc Wha. The Design Review Board motion
to ADOPT Resolution No. 059 APPROVING RP 85-20 failed due to a tie
vote. The Design Review Board directed staff at that time to return
with the condition imposed on the owner when the City vacated a ten
foot strip along Oak Avenue,
The redesigned parking lot is in final plan check at this time.
The developer has stated that construction will begin as soon as permits
can be obtained. A site plan of the proposed improvements is attached.

SUBJECT: RP 85-20 - MCWHA - Request for a minor redevelopment
permit to APPROVE a seafood retail use on the southeast
corner of Carlsbad Blvd. and Oak Avenue in Subarea 5
of the Village Redevelopment Area.
I. RECOmEND AT I ON
It is recommended that Design Review Board ADOPT Resolution No
059 APPROVING RP 85-20 based on the findings contained therein
II. PROJECT DESCRIPTION
The applicant is requesting a minor redevelopment permit to open a
retail seafood market at 201 Oak Street. The use will occupy a
560 square foot portion of a retail center located at the southeast
corner of Carlsbad Blvd. and Oak Avenue. The main tenant and
owner of the center is 7-Eleven Food Stores.
The proposed project is located in subarea 5 of the Village
Redevelopment Area. This area is envisioned as serving the major
tourist/tourist commercial related center for the Redevelopment
Project Area. The applicant presently operates a successful
seafood restaurant on the west side of Carlsbad Blvd one-half block
south of this location. The applicant also has a successful
restaurant and retail seafood outlet at Oceanside Harbor. This use
could be limited to packaged retail take-out only.
Parking, for proposed use is located in a 16 space lot serving the
retail center. Staff feels the lot is adequate to serve this
proposal in additional to the other businesses at this location.
No parking problem exists at this location and staff has received
no complaints about the existing parking conditions.
As proposed, this use will be compatible with the surrounding uses
and with the goals of subarea 5 of the Redevelopment Area, therefore
staff recommends approval of RP 85-20.

9 WHEREAS, said verified application constitutes a request as
10 provided by Title 21 of the Carlsbad Municipal Code; and
11 WHEREAS, pursuant to the provisions of the Municipal Code,
12 the Design Review Board did on the 9th day of October, 1985, hold
13 a public hearing to consider said application on property described
14 as:
15 A portion of Block 18 Carlsbad, in the City of Carlsbad,
County of San Diego, State of California, Map No. 535,
16 filed May 2, 1888, and more particularly 201 Oak Avenue.
17 WHEREAS, at said public hearing upon hearing and considering
18 all testimony and arguments, if any, of all persons desiring to be
19 heard, said Board considered all factors relating to RP 85-20.
20 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review
21 Board of the City of Carlsbad, as follows:
22 A) That the foregoing recitations are true and correct.
23 B) That based on the evidence presented at the public
hearing, the Board recommends APPROVAL of RP 85-20,
24 based on the following findings:
25 FINDINGS:
26 1) The proposed project satisfied all the development
standards and design criteria of the V-R (RP) Zone
27 and the General Plan of the City of Carlsbad.

and policies of the Village Design Manual.
3) That the project is compatible with the surrounding
uses.
CONDITIONS:
4) Approval is granted for RP 85-20 as shown on Exhibit A
dated September 26, 1985, incorporated by reference and
on file in the Redevelopment Office. Development shall
occur substantially as shown unless otherwise noted in
these conditions.
5) Approval of this request shall not excuse compliance
with all sections of the Zoning Ordinance and all other
applicable City ordinances in effect at the time of
building permit issuance.
REDEVELOPMENT OFFICE
6) All sales shall be limited to packaged take-out. Sale
of food to be consumed on the premises is specifically
prohibited.
7) Any signs proposed for this development shall be
designed in conformance with the City's Sign Ordinance
and shall require review and approval of the Community
Redevelopment Manager prior to installation of such
signs.

Review Board of the City of Carlsbad, California, held on this 9th
