BUILDING AT 785 GRAND
As we discussed on the telephone yesterday, Charles Rowe has
requested relief from condition #16 of Design Review Resolution No.
091. Resolution No. 091 was referred to in Resolution No. 083 of
the Housing and Redevelopment Commission approving the office
building at the corner of Jefferson and Grand.
Condition No. 16 States:
**This project is approved sxibject to the
condition that no medical offices be allowed
to occupy/lease any portion of the building.
Should the applicant at a later date intend to
lease any of the structure for medical office
use, additional parking shall be required to
be provided at a ratio of one space/200
sq.ft., of gross floor area."
On March 15, 1989, Mr. Rowe went before the Design Review Board and
asked relief from condition no. 16. The Design Review Board at
that meeting approved the Grand Office Building renting 2100 square
feet on the first floor to a medical group, provided 2100 square
feet elsewhere in the building is left vacant until a parking
district is formed.
Recently a Dr. David Tracy, DDS., applied for a business license to
locate his office in the building. At the time this business
license was reviewed, it was determined that 4484 square feet of
other medical uses were already present in the building, resulting
in a parking shortage under the zoning ordinance of 13 spaces for
the building as a whole. Due to the requirements of condition no.
16 of Design Review Board Resolution No. 091, as modified, and the
parking shortage, Dr. Tracy's business license application could
not be granted. Mr. Rowe has requested a hearing before the Design
Review Board for relief from condition no. 16. Because Design
Review Board Resolution No. 091 was incorporated by the Housing and
Redevelopment Commission and because Mr. Rowe has already gone to
the Design Review Board for relief, I am not sure if appeal to the
Design Review Board is the proper procedure. Please advise. Thank

Dear Mr. Keegan:
This office has reviewed your request for a permit to construct a 4' x 6' two-sided plywood
sign on a 2' X 4' frame at 785 Grand Avenue. On May 16, 1990, a neon commercial sign
was approved for La Mar Chiropractic at 785 Grand on a temporary basis (SP 90-52). One
of the conditions of approval for this temporary neon sign is that it be removed when other
signage is proposed on the site. Please notify us when the temporary neon sign has been
removed and we will then issue the permit for your two-sided plywood sign.

SUBJECT: INFORMATION REPORT ON BUSINESS LICENSE REQUEST FOR
DR. DAVID TRACY - 785 GRAND AVENUE
Approval of the Redevelopment Permit (RP 86-21) for the building at 785 Grand Avenue
contained a condition stating:
"This project is approved subject to the condition that no medical offices be
allowed to occupy/lease any portion of the building. Should the applicant
at a later date intend to lease any of the structure for medical office use,
additional parking shall be required to be provided at a ratio of one
space/200 square feet of gross floor area."
Subsequently the applicant requested relief from this condition. In response to his
request, the Design Review Board on a 5-0 vote passed the following motion:
Design Review Board approved The Grand Office Building renting 2,100
square feet on the first floor to a medical group, provided 2,100 square feet
elsewhere in the building is left vacant until a parking district is formed.
Dr. Tracy's business license request was reviewed for compliance with the above
condition and motion. Based upon information supplied by the building owner, (copy
attached) Charles Rowe, the following uses were present at the time of the business
license application:

There are 59 parking spaces on site, resulting in a current shortfall of 13 spaces. Due
to the project's conditions of approval, and due to the existing parking shortage, staff has
recommended denial of this business license application.
Upon being made aware of staff's analysis, Mr. Rowe requested that the dental office be
allowed with the building owner being conditioned to pay a fee to a parking district in lieu
of providing the actual parking spaces. He has also requested a hearing before the
Design Review Board to discuss the possibility of allowing selected medical professions
to occupy the building. (See attached July 6, 1990 letter from Charles Rowe to Patty
Cratty.) It is Staff's opinion that allowing medical uses would require a Zoning Ordinance
Amendment since it would change the ordinance's parking requirements.

As per our phone conversation today, I am writing you
this letter regarding my Business License Application
to the City of Carlsbad with respect to my parking
requirements.
My profession is Oral and Maxillofacial Surgery. My
practice will be unlike the practice of general dentistry
and all other dental specialities in that my patient
flow is much smaller. This is due primarily to the
fact that I will be the sole health care provider in
my practice. In contrast to other dental practices, I
will not employ hygienists or dental assistants with
specialized training which would allow them to treat
patients without my direct supervision. As a result of
my decreased patient flow due to my specialized practice,
my parking requirements are not as demanding at that of
my fellow colleagues.
I am hopeful that this information will expedite my
application for a license.

Explanation of Request lloyd Tracy is the former Mayor in Vista, and
has son, David Tracy, is an oral surgeon who wants to open a
business in Carlsbad at 785 Grand Avenue. He applied for a
business license on May 25th, but has not heard anything yet.
The landlord at above location needs business license before he
rents the space, and if he does Att receive it soon, he will be
renting to someone else. Can you please check on why the delay
in getting this business license? THANK YOU.

Dear Chris:
As discussed with you, the leasing of 785 Grand has
been very slow the last eight (8) months. I believe
the main reason for this has been the overall vacancy
factor throughout the City of Carlsbad, especially
along Palomar Airport Road.
We have a medical group who is very interested in leasing
Suite 101 which consists of twenty one hundred (2100)
square feet. This medical group is currently located
in downtown Carlsbad and would like to move due to
the likelihood of their existing location being
redeveloped. We are very close to their existing
location, therefore moving to our building would not
cause a disruption to their patient medical services.
By accommodating a medical group, we would not be in
conformance with Design Review Board Resolution 091
Condition #16. We formally request a hearing date
before the Design Review Board to address this matter.
Incidentally, the parking spaces required between office
and medical are four (4) additional spaces.
Your most urgent attention to this matter is requested.
I truly believe the longer our building goes unleased,
the harder it will be for other projects in downtown
Carlsbad.

As you are aware the leasing of The Grand Professional
Building has taken longer than anticipated. We have
erected leasing banners to encourage the leasing of
the building. I hereby request that the leasing banners
be allowed to remain in place until we are sufficiently
leased to remove them. Approximately 90% of our
inquiries are direct results of the banners.
In our current estimation, we should be able to remove
the banners in three to six months, although we sincerely
would like to be able to remove them sooner.
