To maintain the village scale, the building is styled as a federalist revival period using mod detailed
portico, gabled roof elenents and shuttered windows with mullions. The main mass of the building sets
back 30' fron propertv line and steps back again at the upper level, A soft sand textured stucco will be
used with painted wood trim and fire resistant standing seam metal roof. Mschanical equipment is
screened behind a roof top mechanical well and parkLng is screened fron the street by base wdls for
building. 10,800 square feet are being provided with 36 parking spaces including one handicapped.

a) Explain why there are excepticnal or extraordinary circumstances or
ocnditdcns applicable to the property or to the intended use that do not
apply generally to the other property or class of use in the same vicinity
and zcne: Cndp requires a front vard setback of 20 ft. Request is being made to
have 3 parking spaces within the 20 ft. front vsrd setback. The adjacent parcel to
the south of the propertv currently has a structure built 15 ft. within the front
yard setback. Two parcels south of the property, an apartrr.ent buildina is built
^? ft. within t.he front yard setback. The proposed project would be setback
30 ft. and the only encroachments to the setback would be parking spaces.
b) Explain why such variance is necesscu:y for the preservaticn and
enjoyment of a substantial property right possessed by otl-er property in
t?fi same viciaity and zone but which is denied to the property in question:
The front vard setback requirement has not been imposed on the adjacent property
owners and several other property owners immediately to the south the property.
The imposition of the front yard setback to the subject property would deny me the
riqht to use the property in the same manner as the adjacent property owners~
Request is not being made to allow structures to be built in the tront yaro setback,
as other property owners have done, but rather to allow parking spaces in the
setback.

detrimental to the public welfare or injurious to the property or

of the Village Redevelopment Plan. This pro.iect will complete another step in
implementing the overall goal of improving the urban core area of Carlsbad. A
significant amount of time ahd money will be spent to implement both the spirit and
letter of the design guidelines as stated in the Village Design Manual for the
redevelopment area.
