Dear Mr. Meacham:
The six-month processing time for the above referenced
application is over on Oanuary 18, 1988. Since revised plans
have not yet been received, we need a 90-day time extension to
process the application. I need to receive, in writing, your
request for a 90-day time extension by Thursday, December 17,
1987. Otherwise, the project will be scheduled for Design
Review Board for a "denial without prejudice" which we do in
cases where time runs out in processing a project (that action
essentially turns the time clock back to zero).
Please decide which action you would like to pursue. I need to
know by December 17th. If I don't hear from you by then, the
project will be scheduled for the next available hearing as a
"denial without prejudice". Please call me if you have any
questions.

PROCESSING TIME FOR CARLSBAD INN TENNIS CLUB
The Planning Department records indicate that the Tennis Club
application was not considered complete until July 18, 1987
(versus April 20, 1987). Attached for your review are the
following documents showing the chronology of events:
1. Cover sheet of application, dated March 20, 1987.
2. Department letter stating incomplete application,
dated April 16, 1987.
3. Memo to file summarizing results of initial meeting
with applicant, where applicant indicated that the
required engineering information was still under
preparation.
4. Submittal letter for engineering plans, dated June
18, 1987.
Based upon my understanding of Government Code Section 65943,
the application was considered complete on July 18, 1987, 30
days after the submittal of the required engineering
information. Therefore, the 6-month processing time is not
over until January 18, 1987. If you have any problems with
our assumptions or documentation, please call me (ext. 4448).

As you'll recall, the Design Review Board asked me whether or
not there was a time certain that this application roust return
to them. I advised the Board that it did not need to set a
date certain for the return so long as it was legally noticed
and advertised for a future meeting. However, we should keep
in mind the deadline established by the Permit Streamlining Act
which is six months from the date upon which the application
was accepted as complete. In this case, the application
submittal date was March 20, 1987. The date upon which it is
complete is the date that all the information is submitted with
a request in writing by the processing agency or, if no written
request is made for additional information, it is deemed
complete 30 days after its submittal. In this case, if no
written request for additional information was sent to the
applicant, the application is deemed complete on April 20, 1987
and must be acted on within six months thereafter i.e. October
20, 1987. That date may be extended once for a period not to
exceed 90 days upon consent of the City and the applicant
pursuant to Government Code Section 65957. Please keep these
dates in mind while processing this application.

2. The Developer's Engineer shall schedule a meeting with
the Fire Marshal and District Engineer and review the
preliminary water system layout prior to preparation of
the water system improvements plans.

3. The District makes special mention of the existing
water lines and appurtenances located in Oak Avenue and
A.T. & S.F. R/R right of way. This existing water
system will require the developer to field verify the
exact horizontal and vertical location (via potholing).
Special water district conditions for any construction,
grading or landscaping over the existing system shall
be required, and these conditions will be implemented
on improvement plans and approved by District Engineer.
Regarding fees and deposits: The developer will be
responsible for the major facility charge which will be collected
at time of issuance of building permit. Please contact
Mr. Jerry Whitley if you have any questions regarding this
project.

Dear Mr. Leeger:
This letter is intended to give you direction for further
processing of the Carlsbad Inn Tennis Club application. As we
discussed, the newly-approved Transportation Corridor (T-C)
designation and zone have been established, which do not allow
permanent buildings to be constructed within the railroad right-
of-way. The intent is to preserve the ROW for future transit
needs and secondly, to preserve thp existing openspace view
corridor which is provided by the ROW. Based on the intent of
the T-C zone, the clubhouse as presently designed is clearly
incompatible. I suggest the following: the clubhouse cannot be
a "permanent" structure, in accordance with appropriate building
codes; and, it should be reduced in size to accommodate only two
restrooms and a counter area used for scheduling appointments,
etc... This would not seem to require more than 300-400 square
feet. Also, the Beach Area Study suggests some design changes --
the view corridors from Oak and Pine toward the east should not
be blocked by a building or high tennis court fences. Earlier, I
sent you the preliminary exerpts which discussed the tennis
courts.
I think the above information has answered your question
regarding what can or can't be done with the clubhouse. Give me
a call if you have any questions.
