NEGATIVE DECLARATION
PROJECT ADDRESS/LOCATION: Jefferson Street from 1-5 to Oak Avenue, Oak Avenue
from Jefferson Street to the AT&SF Railroad right of way, and the railroad right of way
from Oak Avenue to a point 1,400 feet south of Tamarack Avenue,
PROJECT DESCRIPTION: Vista/Carlsbad Sewer Interceptor
The City of Carlsbad has conducted an environmental review of the above described project
pursuant to the Guidelines for Implementation of the Califomia Environmental Quality Act
and the Environmental Protection Ordinance of the City of Carlsbad. As a result of said
review, a Negative Declaration (declaration that the project will not have a significant
impact on the environment) is hereby issued for the subject project. Justification for this
action is on file in the Planning Department.
A copy of the Negative Declaration with supportive documents is on file in the Planning
Department, 2075 Las Palmas Drive, Carlsbad, Califomia 92009. Comments from the
public are invited. Please submit comments in writing to the Planpipg Department within
30 days of date of issuance.

ENVIRONMENTAL IMPACTS
STATE CEQA GUIDELINES, Chapter 3, Article 5, section 15063 requires that the City conduct an
Environmental Impact Assessment to determine if a project may have a sigmficant effect on the environment.
The Environmental Impact Assessment appears in the following pages in the form of a checklist. This checklist
identifies any physical, biological and human factors that might be impacted by the proposed project and
provides the City with infonnation to use as the basis for deciding whether to prepare an Environmental
Impact Report or Negative Declaration.
* A Negative Declaration may be prepared if the City perceives no substantial evidence that the project or
any of its aspects may cause a sigmficant effect on the environment. On the checklist, "NO" will be checked
to indicate this determination.
* An EIR must be prepared if the City determines that there is substantial evidence that any aspect of the
project may cause a significant effect on the environment. The project may qualify for a Negative
Declaration however, if adverse impacts are mitigated so that environmental effects can be deemed
insignificant. These findings are shown in the checklist under the headings "YES-sig" and "YES-insig"
respectively.
A discussion of potential impacts and the proposed mitigation measures appears at the end of the form under
DISCUSSION OF ENVIRONMENTAL EVALUATION. Particular attention should be given to discussing
mitigation for impacts which would otherwise be determined significant.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Design Review Board of the City of Carlsbad will hold
a public hearing at the Council Chambers, 1200 Carlsbad Village Drive (formerly Elm
Avenue), Carlsbad, Califomia, at 5:00 p.m. on Wednesday, June 5, 1991, to consider
approval of a request for a Redevelopment Permit and Redevelopment Coastal Permit to
allow the constmction of a 36" to 48" sewer interceptor within the City's right-of-way on
property generally located along Jefferson Street and Oak Avenue, and within the AT&SF
Railroad right-of-way from Oak Avenue to the southem redevelopment boimdary.
Those persons wishing to speak on this proposal are cordially invited to attend the public
hearing. If you have any questions, please call the Redevelopment Department at 434-

If you challenge the request for a Redevelopment Permit and Redevelopment Coastal Permit
