HomeMy WebLinkAboutRP 92-08; Laguna Drive Street Improvements; Redevelopment Permits (RP)STAFF REPORT DATE: OCTOBER 7, 1992 TO: DESIGN REVIEW BOARD FROM: PLANNING DEPARTMENT SUBJECT: RP 92-08/CDP 92-07 - LAGUNA DRIVE STREET IMPROVEMENTS - Request for a Minor Redevelopment Pennit and Coastal Development Permit to install curb and sidewalk on the north side of Laguna Drive between State Street and Buena Vista Circle in Subarea 6 of the Village Redevelopment Zone. I. RECOMMENDATION That the Design Review Board ADOPT Design Review Board Resolution No. 194 APPROVING Minor Redevelopment Permit 92-08 and ADOPT Design Review Board Resolution No. 195 APPROVING Coastal Development Permit 92-07 based upon the findings and subject to the conditions therein. II. PROJECT DESCRIPTION AND BACKGROUND The City's Engineering Department is requesting a Minor Redevelopment Permit to install curb and sidewalk along the last remaining properties within the Redevelopment Zone on the north side of Laguna Drive that do not contain curb and sidewalk. The sidewalk wiU front a medical office building at 570 Laguna Drive, KKOS Radio Station at 550 Laguna Drive, and a portion of Maxton Brown Park. These sidewalk improvements are a continuation of the overall plan to instaU sidewalks on the north side of Laguna Drive as conceptuaUzed in the 1991-92 Capital Improvement Program. The remaining improvements located outside the Village Redevelopment Plan are anticipated to be installed beginning spring of '93 (See attached map for VR Zone boundary). Because these improvements are proposed within the Village Redevelopment Area and the Local Coastal Zone, a Redevelopment Permit and California Coastal Development Permit is required. More specificaUy, this proposal is being processed as a Minor Redevelopment Permit in accordance with Carlsbad Municipal Code Subsection 21.35.080(a) which states that "requests not involving a stmctural change" shall be considered minor in nature and shall receive approval from the Design Review Board prior to project development. A Coastal Development Permit is required pursuant to Subsection 21.81.020 which states that "no development shall occur in the coastal zone without a permit having first been issued." ® RP 92-08/CDP 92-07 LAGUNA DRIVE STREET IMPROVEMENTS OCTOBER 7, 1992 PAGE 2 The Planning Commission has determined on December 18, 1991 that the sidewalk improvements at this site are consistent with the General Plan through adoption of PCD/GPC 91-02 titled the "1991 Capital Improvement Program". Section 65401 of the Califomia Government Code requires a finding for General Plan consistency for all public works projects. III. ANALYSIS Planning Issues 1. Are the proposed improvements consistent with the intent and purpose of the Village Area Redevelopment Plan and Village Design Manual? DISCUSSION Village Area Redevelopment Plan and Design Manual Consistency One of the ViUage Area Redevelopment Plan's objectives is to provide "pedestrian and bicycle access to....open areas". By providing pedestrian access to Maxton Brown Park, this objective will be achieved. The Design Manual emphasizes that the 'Village Redevelopment Area shall manifest a strong pedestrian orientation with safe, convenient, and aesthetically pleasing pedestrian ways". By providing curb and sidewalk to separate pedestrian from vehicular traffic, the proposed improvements are providing a more convenient and safer method of travel. SUMMARY The proposed sidewalk and curb improvements will benefit the community by providing a safe, convenient, and aesthetically pleasing pedestrian way. The improvements are consistent with the Village Area Redevelopment Plan and Village Design Manual, and therefore, staff recommends that the Design Review Board approve Redevelopment Permit 92-08 and Coastal Development Permit 92-07. IV. ENVIRONMENTAL REVIEW Some non-native trees will be displaced by the sidewalk, but the removal of such trees will be insignificant. The tree removal, as well as other potential environmental effects, have been evaluated under an Environmental Impact Assessment (EIA) for PCD/GPC 90-10 titled "Laguna Drive Sidewalk Project" in January 1991. The EIA indicated that no environmental impacts were anticipated and a Negative Declaration was issued. Because all environmental review per the Califomia Environmental Quality Act has been processed, and no significant changes to the project have occurred since January 1991, staff has filed a Notice of Prior Environmental (CompUance dated August 20, 1992.
