The area of concern to the Police Department with this plan is:
General security for the building, employees and patrons.
Pian review recommendations
Lighting- Aisles, passageways, and recesses related to and within
the building complex shall be illuminated with an intensity of at least
twenty-five one hundredths (.25) footcandles at the ground level during
the hours of darkness. Lighting devices shall be protected by weather and
vandalism-resistant covers.
Open parking lots shall be provided with a maintained minimum of one (1)
footcandle of light on the parking surface during the hours of darkness.
Lighting devices shall be protected by weather and vandalism covers.
Landscaping- The exterior landscaping should be kept at a
minimal height and fullness giving police, security services and the
general public surveillance capabilities of the area. It should also be
designed so as to not provide coverage for someone trying to hide.
Storage or disposal bins- should be located away from the area
of any loading or receiving area. Disposal bins should be designed in a
manner as to not provide coverage for someone trying to hide or sleep.
Doors- Wood doors shall be of solid core construction with a
minimum thickness of one and three fourths inches. Hollow steel doors
shall have a minimum sixteen U.S. gauge and have sufficient reinforcement
to maintain the designed thickness of the door when any locking device is
installed. Glass doors shall have fully tempered glass or rated burglary
resistant glazing.

All swinging exterior wood and steel doors shall be equipped with
security hardware such as a dead bolt, re-enforced strike plate and latch
cover.
All double doors shall be equipped with an astragal constructed of steel a
minimum of .125 inch thick which will cover the opening between the
doors. The astragal shall be attached to the outside by means of welding
or with non-removable bolts spaced apart on not more than ten inch
centers.
The inactive leaf shall be equipped with metal flush bolts having a
minimum embedment of five-eighths inch into the head and threshold of
the door frame.
The jamb on all aluminum frame swinging doors shall be so constructed or
protected to withstand 1600 pounds of pressure in both a vertical
distance of three inches and horizontal distance of one inch each side of
the strike, so as to prevent violation of the strike.
Panic hardware shall be installed whenever it is required by the Uniform
Building Code.
Cashier-Special attention should be given to the cashier area. It
should be placed to afford the cashier visibility of the entrances and exits
with no signs or obstacles impeding surveillance.
The entrance and exits should be well defined and marked to avoid
conflicts.
Viewers- The door to the rear should be equipped with a viewer.
The entrances should be given additional lighting during hours of
darkness. All exterior lights should be of the vandal resistant type.
All roof openings shall be secured.

Water District conditions for potable water, reclaimed water and
sewer systems are as follows:
1. The entire potable water system, reclaimed water system and
sewer system shall be evaluated in detail to insure that
adequate capacity, pressure and flow demands are met.
2. The Developer shall be responsible for all fees, deposits and
charges which will be collected at time of issuance of the
building permit. The San Diego County Water Authority
capacity charge will be collected at issuance of application
for meter installation.
3. Sequentially, the Developers Engineer shall do the following:
A. Meet with the City Fire Marshall and establish the fire
protection requirements.
B. Prepare a colored reclaimed water use area map and submit
to the Planning Department for processing and approval.

C. Schedule a meeting with the District Engineer for review,
comment and approval of the preliminary system layout

subject property unless the water district serving the
development determines that adequate water service and sewer

Thank you for sharing a copy of the draft staff report for RP 92-10 (Fish House Vera
Cruz) with the Housing & Redevelopment Department. Enclosed is the draft staff report
with suggestions for change prior to completion of the final staff report.
Additional revisions will need to be made because the applicant has indicated that they
no longer intend to remodel the existing building. They are requesting permission to
demolish the main building as well as the two accessory structures and construct a new
building within the existing building footprint at 417 Carlsbad Village Drive.

A. This use is permitted by the Village Design Manual. The goal of tho mmiuai for this
portion of Carlsbad is to "function as the major....specialty, commercial center for
the downtown area." The proposed restaurant will enhance this function. Designs
which "utilize a high degree of landscaping" are also encougged along.. ."street front
setbacks". This development proposedpnot only landscapmg along the street, btt^ (JUAJ
landscaped areas along the side of the [buildings which are visible from the street.
These elements will add to and compliment the existing landscaping along Carlsbad
Village Drive, and integrate the project into the downtown.
The Village Rcdcvcropmoftt Manual is the City's adopted Local Coastal Program. As
noted above, the project complies with the manual and is lierefore consistent with
the Coastal Program.
B. The City's General Plan contains the following guidelines pertinent to this
commercial development;
"Provide a variety of commercial and tourist recreational
activity in the downtown core commercial area, especially close
to the beach, in connection with special entertainment
facilities, restaurants and other uses..."
"Encourage cleanup, landscaping, beautification (and) utility
undergrounding in the downtown core commercial area."

The site is located within Local Facilities Management Zone 1. The impacts on public
facilities created by the proposed project and compliance with the adopted performance
standards are summarized in the tables below. This type of commercial property
conversion was anticipated by the Local Facilities Management Plan for this Zone.

FISCAL IMPACT
The Fish House Vera Cruz project would generate positive economic impacts for the City
and the Redevelopment Agency. The City receives 1% of the total annual sales generated
as sales tax revenues. This project has been estimated to generate $20,000 annually in
sales tax revenues. In addition, the Redevelopment Agency receives 1% of the assessed
value of property located within the Village Redevelopment Area. This project is expected
to increase the assessed value (Land plus improvements) of the site by approximately
$400,000. The tax increment revenue increase would be about $4,000 and the total
estimated tax increment revenues to be generated annually would be about $5,976. The
total amount of revenues generated by the proposed Fish House Vera Cruz project for the
City and the Redevelopment Agency would be approximately $25,976.
The Housing and Redevelopment Department is supportive of this project, which would be
a positive addition to the Village Redevelopment Area.

WHEREAS, a verified application has been filed with the Gty of Carlsbad and
referred to the Design Review Board; and
WHEREAS, said verified application constitutes a request as provided by Titie
21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Design
Review Board did, on the dav of, 1992, hold a duly noticed public hearing to consider

1. The proposed restaurant will enhance the commerdal center function of the
downtown and enhance the street landscaping and is therefore consistent with the
goals and objectives of the Village Design Manual.
2. The project meets all the requirements of the Zoning Ordinance.
3. The engineering analysis by City staff indicates that points of traffic conflict have
been mitigated through onsite circulation design, median constmction, and
movement restrictions on the public street.
4. The pioject proposes a restaurant in the downtown core commercial area, dose to
the beach. Seva:al amenities such as the addition of street landscaping and removal
of derelict buildings will occur as a result of this project. The proposal is therefore
consistent with the General Plan.
Conditions:
1. Detailed mechanical equipment and mechanical equipment plans shall be submitted
for review and on approval of the Planning Department prior to issuance of building
pennits.
2. Signs shall be subject to approval of a separate City sign permit application prior to
installation.
3. Detailed exterior lighting plans (induding fixtures) shall be submitted for the review
and approval of the Planning Department prior to issuance of Building Permits.
4. Paridng spaces for this use have been provided based on the allocation of floor
space within the stracture as follows:
Restaurant Use = 1,330 sq. ft
Retail Use = 2,016 sq. fL
Revisions to the above floor space aUocation in a manner which wiU requiie more

project to the satisfaction of the Planning Director.

and concealed from view and the sound buffered from adjacent properties and
streets, in substance as provided in Building Department PoHcy No. 80-6, to the
satisfaction of the Directors of Planning and Bmlding.
11. The appUcant shaU prepare a detaUed landscape and irrigation plan which shaU be
submitted to and approved by the Planning Director prior to the issuance of grading
or buUding permits, whichever occurs first.
12. AU landscaped areas shaU be maintained in a healthy and thriving condition, free
from weeds, trash, and debris.
13. The developer shaU instaU street trees at the equivalent of 40-foot intervals along
aU pubUc street frontages in conformance with Gty of Carlsbad standards. The
trees shaU be of a variety selected from the approved Street Tree List.
14. AU landscape plans shaU be prepared to conform vsdth the Landscape Manual and
submitted per the landscape plan check procedures on fUe in the Planning
Department.
15. Landscape plans shaU be designed to minimize water use. Lavm and other zone 1
plants (see Landscape Manual) shaU be limited to areas of spedal visual importance
or high use. Mulches shaU be used and irrigation equipment and design shaU
promote water conservation.
16. The developer shaU avoid trees that have invasive root systems, produce excessive

the beach. Several amenities such as the addition of street landscaping and removal
of dereUct buUdings vydU occur as a result of this project. The proposal is therefore
consistent with the General Plan.

The Engineering Department has completed its review of the subject project. The
Engineering Department is recommending that the project be approved subject to the
foUowing conditions:
34. Unless a standards variance has been issued, no variance from City Standards is
authorized by virtue of approval of this site plan.
35. The appUcant shaU comply with aU the rules, regulations and design requirements
of the respective sewer and water agencies regarding services to the project.
36. The appUcant shaU be responsible for coordination with S.D.G.&E., Pacific BeU
Telephone, and Cable TV authorities.
47. The owner of the subject property shaU execute a Hold Harmless Agreement

LAND TITLE
A power line easement constrains the site. The project is designed around the easement.
Use of the existing railroad right-of-way for parking was addressed by the Housing and
Redevelopment Commission on 9-08-92 by approving sublease of 11 City leased parking
spaces therefore there are no conflicts with boundaries.
IMPROVEMENTS
AU improvements along the project frontage are in and are not in need of repair. However
the project is within the boundaries of the Carlsbad ViUage Drive Street Scape Project.
A contract for the Street Scape Project has not been awarded, therefore this project is being
required to constmct it's project frontage share of the improvements. If a contract is
awarded before this project puUs a buUding permit then these improvements wiU not be
required.
