SUBJECT: RP 93-05 McSHERRY GARAGE CONVERSION - WITHDRAWAL LETTER
The City has received and reviewed your letter dated Januaiy 10,1995 (attached) informing
the City that due to the inability to secure insurance coverage, the back building on the
subject site will be retumed to the allowed use of a garage to serve the dwelling unit on the
property. The non-conforming use of a retaO shop (pet store/grooming) has been abated
and will not operate at the site. Your office use may be conducted in the residence under
the provisions of Chapter 21.10.010(7)(A-K) of the Carlsbad Municipal Code (Home
Occupations). Compliance must be maintained with those provisions.
Should you want to propose an office at your property, a Redevelopment Permit would have
to be processed. With this letter, the City formalfy withdraws RP 93-05 and closes the
pending code violation case subject to tibe approval of the City's Principal Building
Inspector.

than buildings on the lot or lots, and as to those
buildings, no closer than forty feet;
(6) A two-family dwelling when the lot upon
which it is located has a sideline abutting a lot or
lots zoned R-3, R-T, R-P, C-1, C-2, C-M or M, but
in no case shall the property used for such
two-family dwelling consist of more than one lot
nor be more than ninety feet in width, whichever is
thgjeast;
21.10.010 Permitted uses.
In an R-l zone, the following uses only are per-
mitted and as hereinafter specifically provided and
allowed by this chapter subject to the provisions of
Chapter 21.44 goveming off-street parking requirc-
ments:
(1) One-family dwellings;
(2) Accessory buildings and structures, including
private garages to accommodate vehicles owned,
operated and used by residents of the dwelling unit
and which are compatible with the surrounding
neighborhood in which the residence is located;
(3) Greenhouses less than two thousand square
feet in area. Greenhouses greater than two thousand
square feet are permitted by approved conditional
use permit only. In either instance, all requirements
for yard setback and height shall be met;
(4) Agricultural crops;
(5) On each lot or combination of adjacent lots
under one ownership, there may be kept one horse
for each ten thousand square feet in the lot or lots;
provided, however, that any such horse may be kept
only if it is fenced and stabled so that at no time is
it able to graze, stray or roam closer than fifty feet
to any building used for human habitation, other
ome occupations which are not disruptive
to the residential character of the neighborhood and
which are subject to the following conditions:
(A) Home occupations shall be conducted as a
secondary use by a resident or residents of the pre-
mises.
(B) No employees shall be employed on the pre-
mises.
(C) All home occupation activities shall be con-
ducted entirely within the residential structure, ex-
cept for permitted agricultural or horticultural uses.
(D) There shall be no extemal alteration of ap-
pearance of the residential structure which would
reflect the existence of the home occupation.
(E) No storage of materials, goods, equipment,
or stock in trade shall be pennitted where visible
from the exterior of the property. No deliveries or
pickups by heavy duty commercial vehicles shall be
permitted.
(F) Sale of goods or services shall not be con-
ducted on the property, except for agricultural goods
grown on the premises. This provision shall not be
construed to prohibit taking orders for sale where
delivery of goods or performance of services does
not occur on the property.
(G) The home occupation shall not cause any
extemal effect which is inconsistent with the resi-
dential zone or disrupts the neighborhood, including
but not limited to, noise from equipment, traffic,
lighting, offensive odor, or electrical interference.
(H) No advertising, signs, or displays of any kind
indicating the existence of the home occupation
shall be peraiitted on the premises.
(I) The home occupation shall not cause the
elimination of required off-street parking.

(J) The home occupation may not utilize an area
greater than twenty percent of the combined total
floor area of ail on-site structures.
(K) A city business license is required for the
conduct of a home occupation;
—(8) Packing or sorting sheds of a total floor area"
of six hundred square feet or less. Packing and
sorting sheds greater tiian six hundred square feet
are permitted by approved conditional use permit
only;
(9) Mobile homes certified under tiie National
Mobilehome Constmction and Safety Standards Act
of 1974 (42 U.S.C. Section 5401 et seq.) on a foun-
dation system pursuant to Section 18551 of the State
Healtii and Safety Code;
(10) Signs subject to tiie provisions of (Chapter
21.41;
(11) Small family day care homes providing care
for six or fewer children;
(12) (A) Large family day care homes providing
care for seven to twelve children if a permit for
operation is first approved by tiie land use planning
manager. The land use planning manager shall issue
a permit for operation if the manager finds:
(i) Adequate ingress and egress to tiie property
is or will be provided to ensure the safe dropping
off and picking up of children,
(ii) The lot is not located closer than one thou-
sand two hundred lineal feet from another large
family day care center on the same street,
(iii) The lot is situated and the play area designed
to minimize any adverse noise impacts to adjacent
properties. The land use planning manager may
require noise attenuation measures (e.g., block wall)
if he determines that the use could create such im-
pacts to adjacent properties,
(iv) That the applicant has or will obtain all li-
censes and permits required by state law for opera-
tion of the facility. The applicant shall keep all state
licenses or permits valid and current,
(v) The facility meets all applicable building
standards and will not have a significant adverse
affect on the environment which cannot be mitigated
or for which a fmding of overriding consideration
cannot be made.
(vi) The facility meets all zoning standards otiier-
wise applicable to otiier single-family residences;
(B) The owner of tiie subject property shall make
1 written application to tiie land use planning manag-
|er. Such application shall include all materials
deemed necessary by tiie land use planning manager
to show that the requirements of subsection (A) are
met The applicant shall pay a fee set by city coun-
cil resolution.
(Q All property owners within three hundred
feet of the subject property shall be notified in writ-
ing of said requested use at least ten days prior to
the decision of tiie land use planning manager. No
hearing shall be held unless requested by the appli-
cant or an affected person. The decision of tiie land
use planning manager may be appealed to tiie plan-
ning commission within fifteen calendar days of the
written decision of tiie land use planning manager.
The appellant shall pay the cost of the appeal.
(13) Satellite television antennae subject to tiie
provisions of Section 21.53.130 of tiiis code. (Ord.

21.10.015 Second dwelling unit by
administrative permit.
(a) The public good is served when tiiere exists
in a city, housing which is appropriate for the needs
of and affordable to all members of tiie public who
reside within tiiat city. Among otiier needs, tiiere is
in Carisbad a need for affordable rental housing.
Therefore, it is in the public interest for tiie city to
promote a range of housing altematives in order to
meet the affordable rental housing needs of its citi-
zens. This section is intended to provide a rental
housing altemative by establishing a procedure to
creale new second dwelling units.
(b) The provisions of this section shall apply to
single-family zones R-A, R-E and R-l, areas desig-
nated by a master plan for single-family detached

SUBJECT: RP 93-05 - McSHERRY GARAGE CONVERSION
In response to your request to extend the deadline for your resubmittal of the above
referenced project, the City hereby grants you an extension of the deadline until 4:00 pm
Januarv 13. 1995. This extension is granted with the understanding that all the items listed
on the City's November 3, 1994 letter be submitted to achieve a complete application (10
copies of the site plans per the redlined site plan, application and fee for a Coasta]
Development Permit, etc; please refer to the November 3 letter). Consistent with the
November 3 letter, it is intended that your resubmittal will result in a complete application
which will then allow to project to go forward to the Design Review Board with a staff
recommendation of denial if all standards (including parking, etc) are not met. An
incomplete resubmittal, a late resubmittal, or the lack of a resubmittal by the above stated
deadline will result in an automatic withdrawal of the Redevelopment Permit by the
Planning Department and a reactivation of this case with Code Enforcement. Code
Enforcement action will likely center on immediate compliance with all applicable codes for
the site. No further deadline extensions, or an incomplete resubmittal will be entertained
by the City.

SUBJECTS RP 93-05-AfeSHERRY GARAGE CONVERSION
The City sent you a letter dated Ocotber 4,1994 summarizing the project's status and the need for
you to decide if you would pursue both a Redevelopment Permit and a building permit. That letter
was sent about two weeks after City staff had met with you at the site and informed you that such
a decision would be required soon. The letter went on to establish a deadline of October 28 for you
to contact the City with a decision. No response has been received.
Therefore, in compliance with the October 4 letter, RP 93-05 will be taken forward for a
recommendation of denial to the Design Review Board (DRB). However, as stated in the October
4 letter, this application remains incomplete and only a complete application can be taken to the
DRB. The following items are required to make the application complete; which will then allow staff
to process a staff report and schedule the item for the DRB:
(1) Resubmit ten (10) copies of the project site plan. Make the revisions as shown on the
attached redlined site plan. These revisions are necessary for clarity and accuracy purposes.
Only one site plan (the one showing five parking spaces) will be presented to the DRB. As
explained previous^, the DRB can not approve projects that do not comply with parking
codes in the coastal zone.
(2) Per the October 4 letter, an application (cover sheet only with property owner signature) and
payment of fees ($400) for a Coastal Development Permit.
These items must be received by the Planning Department to my attention by December 2.1994.
This wili allow for a DRB meeting by early February 1995. If these items are not received by
December 2 then this project will be immediately withdrawn from processing by the Planning
Department and turned back over to the City's Code Enforcement Division on Monday December
5, 1994. Given the time spent on this project and assessing all related issues. Code Enforcement
action will likely focus on immediate abatement of all on-site code violations.

SUBJECT: RP 93-05 - McSHERRY GARAGE CONVERSION
As a follow up to our on-site meeting of September 20, 1994, this letter is to inform you that the Planning
and Building Departments will support the reduction of usable floor area within the two stmctures located
at 3043 Harding Street This approach can be used to create a parking ratio that can be satisfied on-site.
This could allow the pending Redevelopment Permit (RP 93-05) to gain Design Review Board approval.
However, as emphasized by City staff at our field meeting, the RP approval will be conditioned upon the
issuance of a building permit which may have several design, residential conversion and/or handicap
accessibility issues. Obtaining the RP approval but not securing the building permit afterward will
ultimately return the property to a code violation/enforcement matter.
Per your letter of July 21, 1994, all permit processing timelines have been waived and the application
remains incomplete. If this project is to be pursued, in addition to outstanding incomplete items, a Coastal
Development Pennit application must be filed for the project to be deemed complete. Staff would like
to know by October 28 if you intend to proceed with the RP application and will commit to obtaining a
building permit; otherwise the RP will have to go forward with a staff recommendation of denial. Your
option at that point is to appeal to the City Council. Denial by the Council would also retum the property
to a violation/enforcement status. Your only other option appears to be demolition and redevelopment of
the site.
Any efforts to pursue an approval on the RP and a Coastal Development Permit and later to secure a
building pennit need to involve a qualified designer familiar with applicable code requirements. The
storage shed on-site will need to be removed with development of tiiis project After hearing your
decision on how you wish to proceed (approvable RP/CDP vs denial), we will collectively decide on the
requirements and timeframes to finish processing this projecL

Thank you for your assistance, and that of John Davis and Debbie
Fountain, in helping me to submit this redevelopment permit
application. Your numerous comments and on-site assistance was
very helpful.
Attached to the application are two site plans. Alternative 1
showing 5 parking spaces, and Alternative 2 showing 4 parking
spaces. While you have indicated that staff must propose denying
the application to the Design Development Review Board, I also
understand that they have the authority to waive the additional
parking space requirement. If the Review Board finds, as other
officials viewing the property have found, that the parking space
is "sufficient", they will, hopefully, approve the application.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Department
has reviewed your Redevelopment Permit, application no. RP 93-05, as to its completeness for
processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information
which must be submitted to complete your application. This list of items must be submitted directly

staff's support or lack of support (based on compliance with standards, etc) would be
made.
If a re-design is not submitted by December 22, 1993 then the project would be deemed
"incomplete" and you would have six months from the date of incompleteness to make
a resubmittal. Regardless of your decision, staff would be willing to meet with you to
discuss project specific issues and the requirements necessary to process your
