Dear Mr. Donato:
We are in receipt of your letter of September 22, 1997 notifying us of the intention of
your organization to have no more than two persons disseminate information about
your organization on the public sidewalk adjacent to the Carlsbad Farmers Market
during its previously scheduled events.
Per your request, I am enclosing a copy of Carlsbad Municipal Code Chapter 8.17
which refers to special event permits. While it does not appear that your anticipated
activities would require a special event permit, please pay particular attention to CMC
§8.17.030 prohibiting a person or entity from in any manner interfering with the orderly
conduct of such event. The Farmers Market has obtained a special event permit and I
suggest that you discuss the propriety and legality of your intentions directly with the
organizers ofthat event.

SIGNS FOR FARMERS'MARKET
On June 19, 19961 met with Cynthia Bueker and Zack at the site. I gave them a copy of the
issues below and the drawing mentioned in item 5. We then went over the signs at each location
and discussed the issues. Both Cynthia and Zack understood the issues and said that they would
give their sign contractor the information and have the signs installed as covered in the issues.
I told them that they could proceed with the sign installation upon your approval. We
recommend that somewhere in the process an agreement to restore the parking lot at no expense
to the City of Carlsbad be made with the Sponsors of the Farmers Market.
The issues we had with the proposai are itemized below in the order of the sign proposal by
Bryant and Dwyer dated 1 -2-96
1. The 18 by 24 inch signs are acceptable and the wording meets Section 22658 of the
CVC.
2. Three signs attached to the north wail is acceptable.
3. One sign at the west entrance is acceptable. However the method of attachment to the
light standard should be with inch stainless steel bands the same as the existing signs.
4. Three signs on the light standard at the east entrance is considered excessive and would
clutter the light standard. One sign would be sufficient to meet requirements for tow-away
according to the CVC.
5. Two signs are proposed to be in the lawn area on pipe posts, which is unacceptable. We
recommend the approved "Telspar Post" Break-Away sign post as shown on Sandag Regional
Standard Drawing No. M-45, copy attached.*

Dear Larry and Ron:
As you are aware, the Village Business Association's request to extend the major redevelopment
permit for the Village Certified Farmers Market was approved by the Housing and
Redevelopment Commission on June 13, 1995. The approving documents were adopted on June
20, 1995. Enclosed is a copy of the approving documents for your records.
As approved by the Housing and Redevelopment Commission, the redevelopment permit was
extended to September 27, 1999. This will permit the Village Business Association to hold the
event at its current location until the subject date; additional extensions may be granted by the
Conmiission. Please note, however, that the City and/or Redevelopment Agency may revoke its
permission to use the public parking lot with a sixty (60) day notice to the Association. This
means that if the City or Redevelopment Agency needs, or desires, to use the parking lot for
other purposes, use of the lot for the Market may be terminated.
Please review the conditions within the approving documents carefiilly. The Association must
comply with all of the conditions to remain in compliance with the terms of the permit. Special
attention is requested immediately to the issue of signage. These signs must be constructed and
installed as soon as possible. The sign copy should read as follows:
• Sign for Great Westem Parking Lot (at entrance to lot) - This sign should read:
"GREAT WESTERN BANK PARKING ONLY.
No Farmers' Market Parking in this lot.
Thank You for Your Cooperation."
• Sign for south entrance to the Alley (west side of entrance)- This sign should read:
"Public Parking Lot for Farmers' Market -»

• Sign for north entrance to the Alley (at entrance, must be seen be traffic travelling east
and west) - This sign should read:
"Public Parking Lots for Farmers' Market
Located on Roosevelt and State Streets."
These signs need to be professionally constructed and must be installed and remain in place for
the entire length of time for the Market. These signs should be no wider than 3 feet and at least
4 feet in height (but no taller than 5 feet).

As the market manager of the Carlsbad Village Farmers' Market, I wish to respond to your
concerns about non-bank customers using the bank parking lot. First, let me review the remedial
steps which have afready been taken:
1) While the bank Is open, the market security guard or myself constantly monitor the bank
parking lot for non-bank customers.
2) Maps of alternative public parking lots available are personally handed to violators.
3) A sign for the entrance to the bank lot, as requested by you, which states "Bank Parking Only"
was ordered from a professional sign maker June 14, 1995, and will be in place at the entrance to
the bank lot June 28,1995.
4) Barriers are placed weekly to block the north entrance to the alley and the south entrance to
the alley just north of the public parking lot designated for Farmers' Market parking.
5) Orange traffic cones are placed weekly to direct traffic flow through the bank parking lot.
Beginning June 28, 1995, the foilowing additionai traffic controi steps wiil be taken:
1) Since the bank ctoses at 4:00 P.M. on Wednesdays, I have assumed it was not necessary to
monitor the bank lot after that time. You experienced a parking lot problem after 4:30 P.M. June 21,
1995. In response to your concern, the bank parking lot will be monitored until the market closes.
2) The Informalion booth and market management center will be moved to the east end of the
Farmers' Market, adjacent to the bank parking lot, to further Increase our efforts to ensure non-bank
customers do not use the bank parking iot.
3) Larger, professional signs, designating appropriate Farmers' Market parking, wili be made
and positioned, as directed by Housing and Redevelopment.
i am confident that these new measures, in addition to our on-going efforts to manage the parking
situation on Wednesday afternoons, will prevent any further incidents. Please call me any time,

Hi Ron. Thanks. I did receive the signed disclosure statennent and I think I now have
everything I need. I do have one concern, however. I spoke to Cynthia this afternoon and
she indicated that Peder Norby has decided that he wants to be involved now in the Market.
She said the Market would have a pastries/bread booth, a bread booth and a pasta booth.
This is one more than what was noted in the application. I need to be very clear on what is
intended for the Market because whatever is approved for the permit is what you guys will
be held to. Cynthia seemed to indicate that if it was not a bread or pasta booth that it would
be "something else". Do you guys have limits on what the "something else" might be? If you
want to keep it more general, then we should probably just say that you want to have three
non-certified, non-produce booths and two information booths with the remainder being the
certified, produce booths. This may or may not cause concern to other merchants in the
area. But, if there is no guarantee that these booths are only going to be used for bread or
pasta, then I do not want to say that in the report. Would you let me know tomorrow what
you want to be restricted to? Also, we need to talk more about the signage for the Market
as related to parking.

The Carlsbad Village Business Association has proposed
consideration of moving the Farmer's Market from its present
location in the parking lot on Roosevelt Street to the street on
State Street between Carlsbad Village Drive and Grand Avenue.
This would require temporary closing of State Street for that
block every Wednesday afternoon from 12 noon to 7:00 p.m. to
accommodate the Farmer's Market.
In addition to the policy considerations involved, you inquire as
to the legality of the proposed street closure. Temporary
closure on such a basis, if accompanied by appropriate
environmental review under the California Environmental Quality
Act, would be lawful.
California Vehicle Code section 21001 states in relevant part:
"Local authorities, for those highways under
their jurisdiction, may adopt rules and
regulations by ordinance or resolution on the
following matters: ... e) (te)mporarily
closing a portion of any street for
celebrations, parades, local special events^
and other purposes when, in the opinion of
local authorities having jurisdiction, the
closing is necessary for the safety and
protection of persons who are to use that
portion of the street during the temporary
closing." (Emphasis added).
The proposed use would constitute either a "local special event"
or certainly, "other purposes", if the City Council determines to
approve the proposed use. There may be some debate as to whether
weekly use constitutes a "special event", but the Council's
authority is broader under the "other purposes" clause. The
limiting factor is that the closing be "temporary" and for some
reason reasonably within the category of events described in
subdivision (e).
Our advice when the redevelopment permit for the Village Farmer's
Market was approved (as well as the Pea Soup Andersen's parking
lot farmer's market) was that the use was categorically exempt
under CEQA so long as the use was six months or less, but that
during the six months "trial period" CEQA analysis would have to
take place so that in the event the use was successful and there
was a desire to continue it beyond the six month trial period.
CEQA analysis was completed in time to accompany consideration of
the extension of the use, or conversion to permanent use.
The CEQA guidelines include a class 4 categorical exemption
consisting of minor public or private alterations in the
condition of land, water and/or vegetation which do not involve
removal of mature scenic trees, including "minor temporary use of
land having negligible or no permanent effects on the
environment, including carnivals, sales of Christmas trees, etc."
However, the regulations further provide in section 15300.2(c)
that a categorical exemption, "Shall not be used for an activity
where there is a reasonable possibility that the activity will
have a significant effect on the environment due to unusual
circumstances."
If the proposed project is not eligible for a categorical
exemption, it could not be permitted without compliance with
CEQA, probably at least an amount of time sufficient to prepare
and circulate and obtain a 45-day public comment period on a
negative declaration.

RE: PROPOSAL TO RELOCATE THE FARMER'S MARKET FROM THE
ROOSEVELT STREET PUBLIC PARKING LOT TO STATE STREET
Dear Larry:
Thank you for your letter of November 3, 1994 regarding the Village Business Association's
request to relocate the Village Farmer's Market from its current location in the public
parking lot on the east side of Roosevelt Street to the public street on State between Carlsbad
Village Drive and Grand Avenue. Your request has been discussed with the staff members of
other Departments within the City of Carlsbad for preliminary feedback. The following
concems were expressed:
1. Generally, the merchants have not wanted streets to be closed during general business
hours. The closure of the segment of State Street that you are proposing has been
requested in prior years and the City received very negative feedback from a number
of the merchants with businesses in this area.
2. Closing of the segment of State Street that you proposed will remove parking within
the Coastal Zone; the Coastal Commission could oppose the closure l)ecause the
market is held on a weekly basis (not a "one time" event). Staff supported use of the
Roosevelt Street parking lot specifically because it was outside the Coastal Zone.
3. The closure of a street has a greater impact on police services required for the event.
Charges for police services would most likely be assessed to the Farmer's Market
event which would increase the operational costs.
Although Redevelopment Staff is willing to assist you with processing the proposal to
relocate the Market, we recommend that no action be taken until the Market has completed
its six (6) month trial period and the City has had the opportunity to assess the impact on
businesses surrounding the market. The redevelopment permit for the Market was approved
on September 20, 1994. Therefore, the six (6) month trial period would be complete on

March 20, 1994. At this time, an extension of your permit will need to be processed. This
would be the best time to make any changes to the permit such as relocation of the Market.
The City encourages you to continue the Market at its current location at least through the
trial period.
If you still wish to pursue the relocation of the Market, an amendment to your redevelopment
permit (94-05) will be required. Enclosed is the application that you must complete. Again,
you will need to submit a site plan and indicate where the shoppers will park. You will need
to submit a new traffic control plan and signage plan. These plans must all be very specific.
Staff also requests that the Village Business Association submit the enclosed petition signed
by every business owner located on the segment of State Street that you wish to close. The
petition must be signed regardless of the business owner's position (favor or oppose) on the
Market.
Once again, the City and the Redevelopment Agency are very supportive of the Farmer's
Market. It has already proven to be quite successful and a very positive addition to the
Village Area. However, there are concems about relocation of the Market which will need to
be addressed and discussed in further detail. Please feel free to contact my office at 434-2935
