FINAL NOTICE OF MUNICIPAL CODE VIOLATION
ORDER TO REMOVE
PLEASE TAKE NOTICE: As the owner or occupant of the property located at
571 Carlsbad ViUage Drive, you are hereby notified that you are in violation of
Carlsbad Municipal Code, Section 18.04.015, for the construction of a silo without
aproval or permits. In addition, a storage container has been placed at the back of
the Brewery which was not approved in your redevelopment permit. Please find
enclosed a copy of your letter dated July 3, 1996, referencing your agreement to
submit plans, obtain permits, and move the sUo by November 1, 1996. As of today,
this has not been completed.
You are hereby ordered to be in full compliance with the provisions of Carlsbad
Municipal Code no later than November 15. 1996. For you to be in full compliance
you shall obtain a permit for the silo, move the sUo to the location approved by the
Planning Commission, and remove the storage containers. Failure to comply by
the above referenced date will result in this case being referred to the City
Attorney's office for legal action.

did not foHA/ard you a letter indicating that the billing notice should be sent directly to the
restaurant. Therefore, please accept this memo as formal notice to change the billing
address for the Carlsbad Village Microbrewery and Public House to the following:

Dear Brett:
According to the City's Finance Department, you have outstanding bills related to the
sublease agreement with the Redevelopment Agency for parking for your restaurant.
As ofthe date ofthis correspondence, the sublease payments for February, March,
April, May, June and July, 1996 have not been remitted to the Finance Department.
These payments need to be made immediately in order for you to remain in compliance
with your redevelopment and coastal development permits. As a reminder, the rent,
according to our approved agreement, is payable in advance and due on the first day of
each calendar month.
The purpose of this correspondence is to put you on notice that the Carlsbad Brewery
and Public House is not in compliance with its approved Redevelopment and Coastal
Development Permits due to the fact that six (6) monthly payments for parking are
overdue. If you do not resolve this matter within ten (10) days ofthe date ofthis letter,
we will be required to take action to begin the revocation of your permits.
If you have any questions regarding the outstanding payments, please contact the
Finance Department directly at 434-2867. If you have questions regarding your permit,
you may contact my office at 434-2935.

Dear Mr. Garrison,
Thank you for responding to our inquiries regarding final inspection and the installation of our
grain silo. As you requested, the following describes our intentions.
On July 5th we will pay an additional $211.50 for our building permit and request final
inspection of items 2-5 listed on your letter dated June 13, 1996. This should complete your
records of all original construction with exception of our silo. As previously mentioned the silo
is a seperate issue since its approval was handled by redevelopment as an addition to our permit.
We intend to submit all appropriate paperwork and designs for the silo no later than September
1, 1996. With approval forthcoming, we will start construction on October 1, 1996 with
completion by November 1, 1996.

After our phone coversation I went back and reviewed your building file. I am enclosing
three letters that show that the City never has completed a final inspection of the premises
and that there were still some outstanding corrections.
In order to obtain your final inspection you must renew your building permit by first
paying $211.50. Once this fee is paid, you may then call 438-3101 to request a final
inspection.

For your information...
Last night at the Housing and Redevelopment Commission meeting, the
Commission approved a Major Redevelopment Permit and Coastal Development
Permit for a new Blockbuster Video store to be constructed at 660 Carlsbad
Village Drive. Blockbuster will now begin the process to obtain building
permits. Copies of the final approving resolutions will be forwarded to you
for your information.
Also, last night, the Commission approved an amendment to the Major
Redevelopment Permit and Coastal Development Permit for the Carlsbad Brewery
and Public House to permanently install the large grain silo which has been
located on the site but not in use since July, 1995. The Brewery owners will
now begin the process to obtain the appropriate building permit to install
the silo on the sight. A copy of the approving resolution for this project
will also be forwarded to you for your review.
If you have any comments on either of these projects, give me a call at
X2935. Thanks for your help in continuing the processing of these projects
for permits!

Dear Brett:
Enclosed please find a copy of the draft report which has been prepared for review
by the Design Review Board as related to your request to amend your redevelopment
permit to install the large grain silo on the site of the Carlsbad Village Brewery and
Public House located at 571 Carlsbad Village Drive. This item is scheduled for action
by the Design Review Board on February 7, 1996.
Before we can complete the processing of your application, however, the following
actions are required by you as the applicant for the amendment to your
redevelopment and coastal development permits:
1. The Redevelopment Agency will not charge you the $800 normally assessed
for an amendment to a major redevelopment/coastal development permit.
However, you will be required to pay for the costs related to the noticing of the
public hearings related to this action. You must submit a $500 deposit to my
Cr^ office by January 25, 1996. This deposit will be used to pay for all costs related
I to the noticing for the public hearing. Any funds which are not used for the
noticing will be returned to you upon final action on the project amendment by
the Housing and Redevelopment Commission.
^2. Your signature and that of the property owner is required on the attached
\'>A\ application and disclosure forms. Please submit these signed forms to my
\\ office no later than January 31, 1996.
3. You will need to submit at least seven (7) copies of your site plan and
^ elevations to my office no later than January 31, 1996. The report and plans
\ rxl. must be distributed to the Design Review Board members on February 1, 1996,
no exceptions. If I have the only set of plans in my office, please make
arrangments with me to pick them up so that you may make the required
copies and return them to me by the noted date.

As we have discussed previously, your request to amend your redevelopment and
coastal development permits will first be presented to the Design Review Board for a
recommendation. Following action by the Board, your request will be submitted to the
Housing and Redevelopment Commission for final action. After the Commission takes
action, you will need to obtain your building permit to install the silo, if approved.

Dear Brett:
This letter is forwarded to you to confirm our telephone conversation on the moming of
September 6, 1995. I contacted you and we discussed two (2) issues - revised plans for the
amendment to your redevelopment permit and the parking lease payments for the Brewery
and Public House project.
The first issue was a request for an update on your progress on preparing the plans needed to
amend your major redevelopment permit for the Carlsbad Village Microbrewery and Public
House project to include the grain silo installed on the site. You indicated that you are still
waiting for structural calculations from the silo manufacturer and expect to receive them by
fax by the end of the day on September 6, 1995. Once you have received the subject
calculations, it is my understanding that you should be able to complete your plans for the
required amendment to your permit. Please note again that you must submit complete revised
site plans and elevations which clearly identify the location and design of the grain silo. This
means that the same plans you submitted for your original permit must be amended to show
the silo, including all appropriate dimensions for the silo and all related improvements (i.e.,
landscaping, partial screening, etc.). The structural calculations and foundation specifications
are required for the building permit. You will not be able to obtain a building permit,
however, until the amended redevelopment permit is approved. Therefore, it is unportant to
submit the revised site plan and elevations for the entire microbrewery and public house
project as soon as possible so that staff may begin preparing the necessary reports for
consideration by the Design Review Board and the Housing and Redevelopment Commission.
The second issue was related to payment of your monthly lease payment on your parking
agreement with the City/Redevelopment Agency. The City's Finance Department has
forwarded payment requests to you for the months of July (to be prorated), August and
September. We have not received payment to date on your lease agreement. The Agreement
indicates that the lease payment requirement begins with the issuance of any Certificate of
Occupancy; this means that your temporary Certificate of Occupancy or conditional approval
to open from the Building Department initiated the requirement to make the parking lease
payment(s).

The noted lease payment requests were forwarded to the address indicated within the
agreement which is 1002 Tait Street in Oceanside. Per our telephone conversation, the
Finance Department has been notified that you would like for the lease payment requests to
be forwarded to the brewery/public house site directly at 571 Carlsbad Village Drive. The
agreement, however, requires written notice of a change in address. Therefore, please
forward a letter to the City's Finance Department indicating your desire to designate a
different address for all notices related to the subject parking lease agreement.

I think we may have a problem at the Brewery. The grain silo was delivered
this morning and it is huge! It is taller than the building and it sticks
out like a sore thumb. Pat and I went and looked at it together. We are
going to draft a ;joint letter to send to Brett to express our concerns. But,
I am not sure ultimately what to tell him. Do we take it back for review by
the Design Review Board and Housing and Redevelopment Commission or do we
just make a decision about what to do administratively?
Brett is goincf to call for a final inspection on Tuesday, July 18th. I
called him this morning to talk to him about the silo and he was completely
defensive. He told me that if the City wants the Brewery that he has to have
the silo. When I explained that he never indicated on his plans that the
silo was going to look like it does, he just blamed it on the architect. He
says the City has always known that he had to have a silo. I told him that
he should have shown it on his plans and then it wouldn't now be a problem.
He was very argumentative, almost hostile.
So, I guess I am whining. Could you take a look at the silo and let me know
what we should tell Brett? I am at a loss. He won't even recognize that he
screwed up! He just kept saying that the City is going to have to
compromise.

know what staff's position on a recoiiiinendation should be. That's really your's and Evan's call.
"The silo Structure requires a separate building perrait. Provide complete engineered plans for
plan review. Tlie plans for the silo should include a foundation design to accomodate seismic
or wind loads, depending upon the most restrictive condition. Please design the structure to stand
alone, not attached to the building,"
'Tt is suprising to say the ieast to find that this silo structure has been brought to the site with
City staff only having heard of its imminent arrival on Monday, July 10. Tliis silo was never
shown on any exhibit or elevation brought into the City for review, nor was the need for it
expressed to the City in advance of its arrival."

Paul York and I inspected the brewery this afternnon. We allowed Brett to
open on Saturday with certain conditions met.
He agreed to the conditions. One of those was not to use the silo until its
structural system is approved and installed (it is temporarily secure). He
agreed to dilligently pursue the screening option as soon as his architect
completes the design and gets an engineer to analyze it.
Overall the list of corrections was minor stuff, with the exception of the
silo and a gas vent system for the vat that cooks the beer. The vent needs
to be upgraded. He received a correction notice detailing the conditional
opening, and he signed the notice acknowledging his agreement to the
conditions. All other City departments had signed off.
A permanent Certificate of Occupancy will be issued when all conditions are
complete.

Just to let you know, I spoke to Robert Royce today. He is the architect for
the brewery project. He indicated that he was as surprised to see the Silo
as we were. He was especially suprised at the size of it. He said he did not
know about the silo when he was designing the project. I told him that I
thought the grain containers were simply suppose to be two and half foot in
diameter cylinders which would run up the back of the building. He said that
was his understanding as well. But, of course, he does not want to say or do
anything to hurt the brewery. So, he is working on the design of the
screening wall for the brewery and wanted to get more information from me. I
shared with him the information we gave Brett yesterday. I will send Brett a
letter to outline our agreement to make sure that there are no
"misunderstandings".

The decision was made to require an amendment to the Major Redevelopment
Permit for the Brewery project to allow for the silo structure. Marty, Pat
and I delivered a letter to Brett, via Vince, this morning. We discussed the
matter with Vince because Brett was not there (due to a Bachelor Party on
Thursday night!). I will send you both a copy of the letter. We told them in
the letter that staff could not support the design and location of the
existing silo but we may give in on that and just let them submit the
existing for approval. I imagine they will probably get it approved if no
one protests. But, we felt it still should go through public review. I asked
Ofie what she thought about the silo and she didn't have a problem with it.
She thought it fit in with the brewery character of the building just like
you guys. I like the building better without it but I guess I can be
persuaded to like it!
Vince was told that the brewery could still receive approval to open with
the understanding that the silo can't be used until the redevelopment permit
has been amended. However, if Brett indicates that he won't process the
redevelopment permit for amendment, then he may not get his certificate of
occupancy. Also, for information purposes, the parking agreement has been
executed. So, that condition has been met.
