The redevelopment permit allows Mr. Dini to add 225 square feet of additional patio area which is anticipated to provide 24 additional seats within the outdoor seating area. This pennit was approved with the understanding that there would be no entertainment of any type within this area, and the outdoor area shall be closed by no later than 10:00pm. The proposal is categorically exempt (Class 1, additions to exisfing structures, 15301(e)(1)), and I will forward a signed exemption under separate cover. My only other comment is that the decking and additional tables proposed beyond the wall (enclosed dining area) will reduce landscaping and bring diners closer to a major arterial roadway. How will this improve or enhance this site? ANNE HYSONG Citv of Carlsbad Housing & Redevelopment Department October 17, 1997 Michael Dini Dini's by the Sea 3290 Carlsbad Blvd. Carlsbad, CA 92008 Subject: Redevelopment Permit No. 97-07, Outdoor Seating Expansion Dear Mr. Dini: Thank you for submitting your application for a Redevelopment Permit for your project located at 3290 Carlsbad Blvd. Your administrative redeyelopment permit application was received for processing on September 22, 1997 and has been deemed complete for further processing as of the date of this correspondence. Although your application has been deemed complete for fiirther processing, there are some changes/corrections to the plans that will need to be resolved before the Housing and Redevelopment Director will be able to provide you with final approval of your application. As part of staffs review, you application and plans were forwarded to the Engineering, Plaiming and Building Departments for their review. Based on the subject review, the following corrections and/or changes must be made to the plans you originally submitted for approval: 1. The Carlsbad Village Master Plan requires a minimum front and side yard setback of 5 feet. The proposal to constmct a deck on the property line is in violation of this requirement and cannot be approved as proposed. Please revise the plans to delete the deck in the required setback. 2. If the deck can be build outside of the set back, please provide an elevation and the method of screening the underside of said deck. 3. The south property line is not shovm on the site plan. Please revise the plans to show the distance firom the proposed awning to the south property line. Once the above referenced changes have been made, please resubmit four (4) copies of the revised plans to this office for continued processing. Once you have submitted your revised plans and staff has determined them acceptable, we will be able to proceed with the public review and comment period on you proposed project. Once approved, staff can then complete the process by issuing the final notice to announce the appeal period of the Housing and Redevelopment Director's decision. The total public review and comment period is approximately 20 days. No action can be taken to approve a building permit until the redevelopment permit is issued following completion of the comment and appeal periods. Therefore, you are encouraged to make the required corrections/changes to your project plans and retum them as quickly as possible so that we may continue the process.
