Dear Ms. Branciforte:
The purpose of this letter is to inform you that the processing of the pennit for the
placement of tables and chairs on the public sidewalk adjacent to your restaurant was
never completed. While this has in no way affected your ability to use the outdoor tables
and chairs in conjunction with your restaurant, there is the potential for it to affect the on-
going use of the outdoor dining area. Therefore, the Housing & Redevelopment
Department is committed to providing as much assistance as possible to aid in the
completion of the permit process for the benefit of all parties involved.
To assist you in the final completion of the permit process, Linda Holmes, a recent
addition to our staff, has been assigned the task of working with you to complete the
application process. Within the next few weeks she will be contacting you to schedule a
site visit and discuss any additional information needed to complete the approval process
for your application.
Please accept our apology for the lengthy delay in getting your permit application for
sidewalk table and chairs processed. Thank you for your patience and cooperation in

Dear Ms. Branciforte:
Thank you for submitting your application for a redevelopment permit for the tables and chairs
your business establishment has placed within the public right-of-way. Your application has been
reviewed and determined to be incomplete at this time for further processing. At this time, the
application and payment for related fees is being retumed to you for further action. Once you
have provided the additional information requested, you must resubmit your application at the
Community Development Department located at 2075 Las Palmas Drive. Please note that you
are not to submit your application to the Housing and Redevelopment Department. Your
application and fees must be submitted to the Community Development counter located at 2075
Las Palmas Drive. A facility finder is enclosed for your use.
Supplemental information which includes a site plan must accompany the completed application.
The site plan must be drawn to scale and must provide the information requested within the
application checklist (see attached). The site plan submitted with your completed application
does not provide the information requested within the application. Please prepare a new site plan
which provides the following information:
• Name and address of applicant and business.
• Location and dimension of tables and chairs.
• Sidewalk Dimensions.
• Location of existing trees, planters, and/or other enclosures. Include location of enclosure for
Caldo Pomodoro Restaurant, with distance noted between enclosure and first chair for
Branci's. Please note that when the chair is pulled out from the tables, there must be a five
foot clear sidewalk area between the enclosure and the chair back.
• Location and dimensions of business building, including locations of, and dimensions of,
entrances and exits to and from the building.
• A summary chart which includes the number of tables and chairs to be located inside the
business establishment, in the courtyard area, and on the public sidewalk area.
• North arrow and scale for plans (i.e., 1" = 10').

With your application, you must submit three copies of the detail site plan noted above. Also,
you must provide three copies of building elevations and floor plans for the sidewalk tables and
chairs; these plans must clearly reflect the design of the tables and chairs, their location on the
sidewalk, and their relationship to the building. Please note that all of this information can be
provided on a one page site plan. However, it must be detailed with dimensions noted for all
features. To assist you in preparing the required site plan, I have enclosed a copy ofthe site plan
that was submitted for the Caldo Pomodoro. This copy of the site plan will hopefully help you to
understand the type of information required to be included on your site plan for Branci's.
If you wish to use photographs to represent the building elevations and location and type of
tables and chairs, these photographs need to be much larger and much more clear than those
provided within your original application. Please provide a photograph of the entire front of the
building and provide dimensions of the building frontage. These pictures should be included on
your site plan if they are to be used to satisfy the requirement for providing building elevations.
Thank you for your immediate attention to this matter. Please resubmit your application to the
Community Development Department within 30 days of the date on this letter. If the application
is not resubmitted within 30 days, your tables and chairs located within the public right-of-way
will be subject to removal. If you have any questions regarding this correspondence, please

Dear Fran:
As you are aware from your effort to obtain a permit for the sidewalk tables and chairs
for the Caldo Pomodoro, there are specific standards for the number of, and placement
of, the outdoor tables and chairs. Recently, the Redevelopment Agency received
several complaints indicating that the table(s) you are placing on the sidewalk for the
ice cream shop are presenting a public sidewalk access problem as a result of the
recent installation of the permanent enclosure for Caldo Pomodoro. Therefore, it is
requested that you immediately take action to remove the obstacle created by the
placement of your table(s) on the sidewalk for the ice cream shop. Also, please review
the attached regulations for sidewalk tables and chairs and submit an application for the
appropriate permit to allow for the continued placement of tables and chairs on the
sidewalk for the Branci Ice Cream Shop.
Please remember that the Caldo Pomodoro restaurant may have no tables placed
outside the approved enclosure area. If the Caldo provides service to any tables
outside the enclosed area, the restaurant will be in violation of its approved permit. In
addition, the number of tables and chairs located outside (on private or public property)
for the Branci Ice Cream Shop may not exceed the number of tables and chairs located
inside the ice cream shop. Please take prompt action to complete the attached
application for a permit for the outside tables and chairs for the Branci Ice Cream Shop
and return it to my office with the required attachments, which include a site plan for the
location ofthe tables and chairs on the sidewalk.

Dear Mr. Bencheikh:
Enclosed please find two forms that must be completed with current information related to the
Sidewalk Tables and Chairs at your business, Branci's Cafe Dolce. The original permit for the
Sidewalk Table and Chairs was never completed gaining approval of the permit. Please
complete the two forms where indicated bv red check marks, and retum them to me as soon as
possible.
The week of August 6-10, staff visited the site. It appears that only one table is located in the
public right-of-way, next to the tree. As long as the table remains two feet away from the curb
and allows five feet clear between the table and the building for pedestrian passage, the
placement of the table will not create a problem. Please note that you may not have more
seating outside the Cafe than inside. On the original application, Ms. Branciforte had noted
that there were 14 stools inside. Staff noted that there were a total of 6 tables and 12 chairs
outside the Cafe: 5 tables w/2 chairs inside the courtyard and one table w/2 chairs in the public
right-of-way.
I have also attached information on Sidewalk Cafe Location and Development Criteria and Other
Requirements. Since the table and chairs already exist in the public right-of-way, it is imperative
that we receive a copv of vour insurance immediatelv, showing that the Citv of Carlsbad and the
Carlsbad Redevelopment Agencv are named as additional insured (See Other Requirements #4).
Please fill in the information as requested and retum as soon as possible. Upon receipt of the
requested information/items, we will be in a position to final the permit. If, however, you have
decided to remove the table and chairs as well as the sign from the public right-of-way, please
notify us in writing of that decision so that we may close the file. Thank you for your prompt

to the City of Carlsbad in the amount of $1 million which lists the City of Carlsbad and the Carlsbad Redevelopment
Agency as "additional insured". This Certificate shall remain in effect for as long as the tables and chairs are placed
within the public right-of-way. This agreement is a condition of the issuance ofthis administrative redevelopment permit
for the subject sidewalk tables, chairs and/or enclosure on the public right-of-way. I understand that an approved
sidewalk tables and chairs permit shall remain in effect for as long as sidewalk tables and chairs are permitted within the
Village Redevelopment Area and the permittee remains in compliance with the subject approved permit.

SIDEWALK CAFES
Location and Development Criteria:
1. Sidewalk tables and chairs shall be limited to eating and drinking establishments only.
2. Tables and chairs should not unduly disrupt pedestrian and vehicular movement.
3. Tables and chairs must be placed a minimum of two feet from the curb to allow adequate space for the opening of
vehicle doors.
4. A clear area of at least five feet in width must be maintained for pedestrian use over the entire length of the
sidewalk in front of the business.
5. Tables are encouraged to be placed in line with tree wells, street lights and other street furnishing elements in
order to maximize a linear unobstructed area.
6. Where tables are placed next to the building facade, a clear area of at least five feet in width must be maintained
to building entries.
7. Tables must not block access to fire emergency facilities (i.e., fire hydrants).
8. Tables, chairs and umbrellas should be restricted to the frontage ofthe business, and should not encroach on the
frontage of any adjacent business.
9. All sidewalk obstruction including non-permanent trash receptacles should be removed completely from the
sidewalk area daily prior to the close of business.
10. Furniture should be of a uniform color and design and of substantial construction to withstand outdoor use.
Umbrellas should be made of a wood or metal framework and should be covered with fabric. No vinyl umbrellas
shall be permitted.
11. Trash receptacles should be provided by the eating or drinking establishments and the area of the sidewalk cafe
must be kept free of litter.
12. The Housing and Redevelopment Director may approve temporary or permanent enclosures for the sidewalk cafe
area as part ofthe sidewalk cafe permit ifthe Director finds that the enclosure will not impede pedestrian traffic
and is desired for other safety or aesthetic reasons.
Other Requirements:
1. An approved sidewalk cafe permit remains in effect for as long as sidewalk cafes are permitted within the Village
Area and the permittee remains in compliance with the subject approved permit. No new permit shall be required
unless the applicant ceases to use the sidewalk tables and chairs for a period of 6 months or longer; in this case, a
new permit with appropriate fee will be required. The approved permit which remains in effect may be amended
without additional fees as approved by the Housing and Redevelopment Director.
2. The State Department of Alcohol Beverage Control shall regulate the sale of alcoholic beverages within the
Village. The applicant must obtain the appropriate permits and/or approvals from ABC prior to selling or serving
alcoholic beverages to customers using the sidewalk tables and chairs.
3. Applicant/permittee must sign an Indemnification Statement holding the City of Carlsbad and the Carlsbad
Redevelopment Agency harmless from any legal action resulting from sidewalk cafe operations and/or any
approved enclosures for the sidewalk cafe.
4. The applicant/permittee must submit a Certificate of Insurance to the City of Carlsbad in the amount of $1 million.
The City of Carlsbad and the Carlsbad Redevelopment Agency shall be listed as "additional insured" on the
Certificate. The Certificate must remain in effect for as long as the tables and chairs are placed within the public
right-of-way.
