STATEMENT OF AGREEMENT
TENTATIVE PARCEL MAP
CITY OF CARLSBAD
The Subdivision Map Act and the Carlsbad Municipal Code sets a fifty (50) day time
restriction on Engineering Department processing. This time limit can onty be extended
by the mutual concurrence of the Applicant and the City. By accepting applications for
Tentative Parcel maps concurrently with applications for other approvals which are
prerequisites to the Map (I.e., Environmental Assessment, Environmental Impact Report,
Condominium Plan, Planned Unit Development, etc.), the fifty (50) day time limits are often
exceeded, tf you wish to have your application processed concurrently, this agreement
must be signed by the Applicant or his agent. If you choose not to sign the statement,
the City will not accept your application for the Tentative Parcel Map until all prior
necessary entitlements have been processed and approved.
The LJndersigned understands that the processing time required by the City may exceed
the time limits; therefore, the Undersigned agrees to extend the time limits for City
Engineer action and fully concurs with any extensions of time up to one (1) year from the
date the application was accepted as complete to properly review ail of the applications.

1) Approximate contours at 1' intervals for slopes less than 5%, 2'
intervals for slopes between 5% and 10%, and 5* intervals for slopes
over 10% (both existing and proposed). Existing and proposed
topographic contours within a 100 foot perimeter of the boimdaries
of the site. Existing onsite trees; those to be removed and those to
be saved.

SUBJECT: ADMINISTRATIVE VARUNCE NO. 95-07 - Request to allow a reduction of
the front yard setback from 20 feet to 15.5 feet of a two family lot on property
located at 2201 Levante Street in tlie R-2 zone and located in Local Facilities
Management Zone 6.
Dear Mr. Mendelson:
The Planning Director has completed a review of your application for an Administrative
Variance, AV 95-07 at 2201 Levante Street. After careful consideration of the
circumstances surrounding this request, the Planning Director has determined that the four
findings required for granting an Administrative Variance can be made and, therefore,
APPROVES this request based on the following findings and conditions.
Findings;
1. There are exceptional or extraordinary circumstances or conditions applicable to the
property or to the intended use that do not apply generally to the other property or
class of use in the same vicinity and zone because of an error during construction
placed the building setback at 15.5 feet versus 20 feet.
2. The requested variance is necessaiy for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and zone
but which is denied to the property in question because the existing structure was
erroneously built with a reduced front yard setback which prohibits the owner from
meeting the requirements, of the Planned Development ordinance, for the
condominium conversion of the duplex. Since only one of the two units on the
property has a reduced front yard setback, the allowance for tandem parking can be
met in front of the other unit.
3. The granting of this variance will not be materially detrimental to the public welfare
or injurious to the property or improvements in the vicinity and zone in which the
property is located. The property is located on the inside curve of a public street.
This reduces the visual impact of the reduced setback since the reference for the
setback is difficult to determine since none of the homes are in line as on a straight
street. The site has adequate area to provide for tandem parking for guest parking
without impeding on the public right-of-way. There is also adequate on street
parking for guest parking.

4. The granting of this variance will not adversely affect the comprehensive General
Plan because the existing site is in conformance with the density range of the Land
Use Element.
This decision may be appealed by you or any member of the public to the Planning
Commission within ten days of receipt of this letter. Appeals must be submitted in writing
to the Planning Commission at 2075 Las Palmas Drive in Carlsbad, along with a payment
of $490. The filing of such appeal within such time limit shall stay the effective date of the
order of the Planning Director until such time as a final decision on the appeal is reached.

The City has completed a review of the application for a two-unit condominium development
located at 2201 -2203 Levante Street.
It is the Planning Director's determination that based on the attached conditions, the project is
consistent with the City's condominium regulations (Chapter 21.45) and with all other applicable
City Ordinances and Policies. Further, the project has been found to be categorically exempt
from environmental review according to Section 15301 (k) of the California Environmental Quality
Act and a Notice of Exemption was filed on September 24, 1993.
This memo, including the listed findings and conditions, constitutes approval of CP 93-06.
Findings:
1. The project is consistent with the City's General Plan Land Use Element, and with all
other elements of the City's General Plan.
2. Adequate public facilities necessary to serve this project will be provided as required by
the City Engineer in conjunction with the approval of the parcel map (MS 93-09) required
for this project.
3. The project is consistent with the design criteria and development standards of Chapter
21.45 (Planned Development Ordinance) of the City's Zoning Code.
Conditions:
1. Approval is granted for CP 93-06 as shown on Exhibit "A", dated September 24,1993, on
file in the Planning Department and incorporated herein by reference.
2. A copy of the final planned development site plan, incorporated all conditions of approval,
shall be submitted to and approved by the Planning Director prior to final map approval
of MS 93-09.

6. This project is being approved as a condominium project for residential homeownership
purposes. If any of the units in the project are rented, the minimum time increment for
such rental shall be not less than 26 days. A condition so stating this shall be placed in
the CC&R's for the project.
7. This project shall comply with all conditions and mitigation required by the Zone 6
Local Facilities Management Plan approved by the City Council on November 10, 1987,
incorporated herein and on file in the Planning Department and any future amendments
to the plan prior to the final map approval.
8. The applicant shall have a compliance inspection performed by the City of Carlsbad
Building Department prior to final map approval.
9. The applicant shall notify all tenants that the units are converting to condominiums and
submit a tenant notification form to the Planning Director prior to final map approval.
10. The applicant is aware that the City is preparing a housing impact fee as an alternative
to the inclusionary requirements stipulated in Policy 3.6b of the Housing Element. If in
the development of the impact fee program, it is determined by the City Council in order
to find consistency with the Housing Element of the General Plan as well as consistency
with Section 66473.5 of the Government Code (Subdivision Map Act), that this project is
subject to this fee and a parcel map has not been issued, the applicant or its successors
in interest shall pay whatever reasonable impact fee that is required and in effect at the
time of issuance of parcel map. If required fees are not paid, this application will not be
consistent with the General Plan and approval for this project will be void. No impact fee
will be required if a parcel map is issued prior to the effective date of the Inclusionary
Ordinance (ZCA 91-06).

A preliminary decision has been made, pursuant to Section 20.24.120 of the City of Carlsbad
Municipal Code, to approve the tentative parcel map of the proposed minor subdivision subject
to the following conditions:
1. The tentative parcel map approval shall expire twenty-four (24) months from the date of
the letter containing the final decision for tentative parcel map approval.
2. The applicant shall provide the City with the approved tentative parcel map. The map
shall be to scale on a reproducible 24" x 36" xerox or photo mylar. The tentative parcel
map shall reflect the conditions of approval by the City. The reproducible shall be
submitted to the City Engineer, reviewed and signed by the City's project engineer and
project planner prior to submittal of the building plans, final map, improvement or grading
plans, whichever occurs first.
3. Unless a standards variance has been issued, no variance from City Standards is
authorized by virtue of approval of this tentative parcel map.
4. The applicant shall comply with all the rules, regulations and design requirements of the
respective sewer and water agencies regarding services to the project.
5. The applicant shall be responsible for coordination with S.D.G.&E., Pacific Bell Telephone,
and Cable TV authorities.
6. Prior to approval of the parcel map the applicant shall pay all current fees and deposits
required.
7. The applicant shall defend, indemnify and hold harmless the City and its agents, officers,
and employees from any claim, action or proceeding against the City or Its agents,
officers, or employees to attack, set aside, void or null an approval of the City, the
Planning Commission or City Engineer which has been brought against the City within
the time period provided for by Section 66499.37 of the Subdivision Map Act.
8. Prior to approval of the parcel map the owner shall pay and/or enter into an agreement
with the City to pay any drainage area fees established as a result of the Master Drainage
Plan Update.
9. Prior to approval of the parcel map the applicant shall pay park-ln-lieu fees to the City as
required by Chapter 20.44 of the Carlsbad Municipal Code.

10. Prior to the approval of the parcel map the applicant shall pay the recording fees for all
agreements, easements and documents required for this project.
11. The project is approved under the express condition the applicant pay the additional
public facilities fee prior to parcel map approval in accordance with City Council
Resolution No. 9169 adopted July 28, 1987 and as amended from time to time. The
applicant further agrees to pay any development fees established by the City Council
pursuant to Chapter 21.90 of the Carlsbad Municipal Code. The applicant's written
agreement to pay said fees is on file with the office of the City Clerk and is incorporated
herein by this reference. If the fees are not paid, this application will not be consistent
with the General Plan and approval for this project shall be void.
12. Prior to approval of the parcel map the owner of the subject property shall execute an
agreement holding the City harmless regarding drainage across the adjacent property.
13. The final parcel map shall comply with the requirements of Condominium Permit (CP)
93-06.
The applicant may request a review of the preliminary decision with the City Engineer in writing
within ten (10) days of the date of this letter. Upon such written request, the City Engineer shall
arrange a time and place with the applicant for such review.
