SDP 11-04/SDP 11-05/SDP 11-06/SDP 11-07 - LA COSTA BLUFFS LOTS 406-409 - Request for approval of four separate Site Development Plans to allow for the development of four 6-unit attached apartment projects each situated on a separate .3857-acre infill site which are generally located adjacent to one another along the north side of La Costa Avenue between Gibraltar Street and Romeria Street, and in Local Facilities Management Zone 6. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 6844, 6845, 6846 and 6847 APPROVING Site Development Plans (SDP 11-04/SDP 11-05/SDP 11-06/SDP 11-07), based upon the findings and subject to the conditions contained therein. 11. INTRODUCTION The project is a request to construct four 6-unit attached apartment buildings each situated on a .3857-acre infill site generally located on the north side of La Costa Avenue between Gibraltar Street and Romeria Street, and in Local Facilities Management Zone 6. Each proposed apartment building consists of a two-story structure with private auto court driveway and covered parking for 12 cars. All four 0.3857-acre project sites are significantly constrained by an existing 1 1/2:1 gradient slope located within the rear portion of the property. The steep slope is undevelopable and requires a top of slope building setback further reducing the site's buildable area. The projects were reviewed for consistency with the General Plan and applicable zoning development standards. There are no significant issues outstanding and staff is recommending approval. III. PROJECT DESCRIPTION AND BACKGROUND Proposed Residential Construction: The applicant is requesting approval to construct four separate 6-unit attached apartment buildings each situated on a previously graded .3857-acre infill site. Access to each residential apartment unit's garage is a common driveway (24' wide) and auto court located off of La Costa Avenue. Each unit will have an entry way along the auto court. The two required visitor parking spaces per apartment building are provided onsite near the front of the project. Three different floor plans are proposed that range between 1,377 square feet and 1,528 square feet in size. Each floor plan has three bedrooms and three bathrooms, a two car garage, and either a private patio area or second floor deck. The building materials consist of stucco walls with a Spanish tile roof There are a variety of roof planes that provide different roof heights and off-set building projections. The building colors and accent trim consists of warm brown and beige/cream tones. All four apartment buildings will use the same SDP 11-04/SDP 11-05/SDP 11-06/SDP 11-07 - LA COSTA BLUFFS LOTS 406-409 December 7, 2011 Page 2 color pallet with each building having its own unique color pattern. The building facades will include a variety of different architectural elements including columns, second floor decks, wood shutters, foam trim under windows and around the eaves, and wrought iron railing. Rear (north) elevations also feature wide expanses of glass to maximize golf course views. The maximum building height is proposed to be 25.2 feet. Landscaping will be provided along La Costa Avenue to enhance the visual appearance of the units and to create a sense of privacy for the residents. Project Site/Setting: The four rectangular shaped 0.3857-acre project sites are located adjacent to each other on the north side of La Costa Avenue between Gibraltar Street and Romeria Street. The project site is zoned Residential Density Multiple (RD-M) and abuts existing multi-family residential to the north, east and west, and open space to the south across La Costa Avenue. Many of the surrounding residential projects within the neighborhood were built at a higher density, approximately 30 units per acre, under the jurisdiction of the County of San Diego. Topographically, each project site consists of a level pad with a steep approximate 25 foot tall downhill slope located on the rear one third of the property. The narrow, constrained sites were previously graded in 1979 and have never been developed. Earlier grading included steep, 1 1/2:1 slopes along the northem property line. The pads are predominantly vegetated with broad- leaf non-native annuals while the northem slopes have some native vegetation (coastal sage scmb). The proposed pad areas are primarily underlain by undocumented fill soils up to 15 feet below existing grade that consist of soft sandy clay which exhibits a moderate expansion potential. Per the recommendations of the soils report prepared for the project by East County Soil Consultation and Engineering, Inc., the entire site is to be re-graded to address the undocumented fill soil issues. The lots will be regraded to approximately the same existing pad elevations and separated by retaining walls varying from zero to six feet in height. Safety railings constmcted of wrought iron material with an open design will be installed on-top of each retaining wall where required per code. The infill projects' are surrounded by multi-family developments and qualify as a CEQA Guidelines Secfion 15332 (In-Fill Development Projects) Class 32 Categorical Exemption. Each .3857-acre project site consists of a previously graded lot and does not contain £iny significant habitat. The four 6-unit apartment projects as proposed do not meet the minimum development standards of the Planned Development Ordinance (Chapter 21.45 of the C.M.C.) and therefore could not be subsequently converted to condominiums. The proposed projects are subject to the following plans, ordinances, standards, and policies: IV. ANALYSIS A. Residential High Density (RH) General Plan Land Use designation; B. Residential Multiple-Density (RD-M) Zone (Chapter 21.24 of the Zoning Ordinance); C. Qualified Development Overlay Zone (CMC Chapter 21.06); D. Hillside Development Regulations and Guidelines (Chapter 21.95 of the Zoning Ordinance); SDP 11-04/SDP 11-05/SDP 11-06/SDP 11-07 December 7, 2011 Page 3 LA COSTA BLUFFS LOTS 406-409 E. Inclusionary Housing Ordinance (Chapter 21.85 of the Zoning Ordinance); and F. Growth Management Ordinance (Chapter 21.90 of the Zoning Ordinance) and Zone 6 Local Facilities Management Plan. The recommendation for approval of these four projects was developed by analyzing each project's consistency with the applicable regulations and policies. The four separate apartment project's compliance with each of the above regulations is discussed in detail in the sections below. A. General Plan Residential High Density (RH) Land Use Designation The General Plan Land Use designation for the property is Residential High (RH) density. The RH Land Use designation allows for the development of two-family and multiple-family residential units within a density range of 15 - 23 dwelling units per acre (du/ac) and at a Growth Management Control Point (GMCP) of 19 du/ac. At the RH GMCP, 7.32 dwelling units (7 units when rounded down) would be permitted on each of these 0.3857-acre properties. Each of the four proposed 6-unit projects have a density of 15.55 du/ac, which is within the RH density range of 15 - 23 du/ac, but is 1.32 dwelling units below the GMCP of 19 du/ac. The GMCP is used for the purpose of calculating the City's compliance with Govemment Code Section 65863. However, consistent with Program 3.8 of the City's certified Housing Element, all of the dwelling units, which were anticipated toward achieving the City's share of the regional housing needs that are not utilized by developers in approved projects, will be deposited in the City's Excess Dwelling Unit Bank. Each six unit apartment project will deposit 1.32 dwelling units into the Dwelling Unit Bank and these excess dwelling units are then available for allocation to other projects. Accordingly, there is no net loss of residential unit capacity and there are adequate properties identified in the Housing Element allowing residential development with a unit capacity, including second dwelling units, adequate to satisfy the City's share of the regional housing need. Each project complies with the Elements of the General Plan as outlined in Table A below: TABLE A - GENERAL PLAN COMPLIANCE ELEMENT USE, CLASSIFICATION, GOAL, OBJECTIVE OR PROGRAM PROPOSED USES & IMPROVEMENTS COMPLIANCE Land Use Each site is designated for Residential High density, (RH - 15-23 du/ac) with a GMCP of 19 du/ac. 7.32 dwellings units could be constmcted on each site at the GMCP (.3857 acres x 19 du/ac). Each residential project density at 15.55 dwelling units per acre (6 DUs) is within the RH density range of 15 - 23 du/ac. 1.32 dwelling units will be deposited into the City's excess dwelling unit bank for each project. The project consists of four separate 6-unit apartment buildings and pursuant to the recently amended Inclusionary Housing Ordinance (Chapter 21.85 of the CMC) apartment projects are not subject to the Inclusionary Housing Ordinance. Yes Public Safety Reduce fire hazards to an acceptable level. The projects meet fire code. The projects are located within a five minute response of Fire Station No. 6. Yes Open Space & Conservation Minimize the environmental impacts to sensitive resources within the City. The projects are conditioned to pay the HMP Mitigation fee for the impact to disturbed lands which provide some benefit to wildlife. The native vegetation (Coastal Sage Scmb) located on the steep northem slopes will remain. Yes Utilize Best Management Practices for control of storm water and to protect water quality. The projects are conditioned to conform to all NPDES requirements and have been designed to include Low Impact Design (LID) elements. A noise study was prepared by ABC Acoustics, Inc., dated August 15,2011 and concluded that each apartment project complies with the exterior 60 dB(A) CNEL noise standard and the interior 45dB(A) CNEL noise standard. Yes Circulation Constmct roadway improvements needed to serve proposed development. All public facilities including curb, gutter and sidewalk have been constmcted along the property frontage. Yes B. Residential Multiple-Density Zone (RD-M) (Chapter 21.24 of the Zoning Ordinance). The projects are required to comply with all applicable use and development standards of the Carlsbad Municipal Code (CMC) including the Residential Density-Multiple zone (CMC Chapter 21.24). The RD-M zone allows for the development of multi-family residential housing in the RD-M zone. The four proposed two story multi-family apartment buildings with a building height of 25.2 feet are compatible with the existing surrounding development. Qualified Development Overlay Zone (CMC Chapter 21.06) Pursuant to Section 21.53.120 of the CMC, a Site Development Plan is required to be processed for these four apartment projects pursuant to Chapter 21.06, the Qualified Development Overlay Zone, of the Ceirlsbad Municipal Code. As demonstrated in Table C below, all of the required SDP findings can be made. TABLE C - SITE DEVELOPMENT PLAN FINDINGS FINDING PROJECT CONSISTENCY That the requested use is properly related to the site, surroundings, and environmental settings; it is consistent with the various elements and objectives of the General Plan; it will not be detrimental to existing uses or to uses specifically permitted in the area in which the proposed use is to be located; and it will not adversely impact the site, surroundings, or traffic circulation. The project consists of the development of four separate 6- unit residential apartment buildings each situated on a 0.3857-acre previously graded infill lot located on the north side of La Costa Avenue between Gibraltar Street and Romeria Street. Each proposed six unit residential apartment project at a density of 15.55 du/ac is consistent with the Residential High Density (RH: 15-23 du/ac) General Plan Land Use designation and compatible with existing multi-family residences that are located in the area. The projects are consistent with the General Plan as discussed in Section "A" of the staff report. Furthermore, the four proposed residential apartment projects will not be detrimental to existing uses or to uses specifically permitted in the area in which the uses are located in that, the four 6-unit apartment buildings are a use permitted within the RD-M zone and are compatible with the multi- family dwelling projects to the north, east and west. Each apartment building is properly related to the site surroundings and environmental settings in that the projects comply with all development standards of the RD- M zone and will result in no environmental impacts. The projects will not adversely impact the site, surroundings, or traffic circulation in that the projects comply with all applicable development standards and are adequately parked onsite and will only generate 48 Average Daily Trips (ADT) each. That the site for the intended use is adequate in size and shape to accommodate the use. Each of the subject sites are adequate in size and shape to accommodate the proposed six-unit residential apartment buildings in that the projects comply with all of the development standards of the RD-M Zone as demonstrated in Table B above. SDP 11-04/SDP 11-05/SDP 11-06/SDP 11-07 December 7,2011 Page 7 LA COSTA BLUFFS LOTS 406-409 TABLE C - SITE DEVELOPMENT PLAN FINDINGS CONTINUED FINDING PROJECT CONSISTENCY That all yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained. The four proposed six unit residential apartment projects have been designed in compliance with the development and design standards of the RD-M Zone and Hillside Development Regulations and Guidelines of the Carlsbad Municipal Code. The projects provide adequate setbacks, lot coverage, complies with the 35 foot maximum height limit and are consistent with the Slope Edge Building Setback in that all of the units, including the decks, are set back from the top of slope so that the buildings do not intmde into a 7:1 ratio slope edge building setback (.7 foot horizontal to one foot vertical imaginary diagonal plane that is measured from the slope to the building). The projects are compatible with existing permitted uses. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. Each project will take access off of La Costa Avenue. La Costa Avenue is identified as a secondary arterial, designed to adequately handle the 48 Average Daily Trips generated by the four separate six unit residential apartment projects. D. Hillside Development Regulation and Guidelines The four six unit apartment projects are developing on existing pre-graded pads and are not proposing development on the steep slopes located on the northem portion of the properties and therefore, the projects are not required to process Hillside Development Permits. The projects are consistent with the Hilltop Architecture and the Slope Edge Building Setback in that all of the units, including the balconies, are set back from the top of slope so that the buildings do not intmde into a 7:1 ratio slope edge building setback (.7 foot horizontal to one foot vertical imaginary diagonal plane that is measured from the slope to the building). E. Inclusionary Housing Ordinance The proposed project consists of four 6-unit apartment buildings and are not subject to the Inclusionary Housing Ordinance. F. Growth Management Regulations The proposed projects are located within Local Facilities Management Zone 6 in the southeast quadrant of the City. The impacts on public facilities created by each 6-unit project, and their compliance with the adopted performance standards, are summarized in the Table D below. Each proposed 6-unit project is 1.32 units below the Growth Management Control Point density for this RH designated property. Consistent with the General Plan and Policy No. 43, 1.32 DUs will be deposited into the City's excess dwelling unit bank for each 6-unit project. V. ENVIRONMENTAL REVIEW The projects (four separate 6-unit apartment buildings) qualify as a CEQA Guidelines Section 15332 (In-Fill Development Projects) Class 32 Categorical Exemption. The projects are consistent with the General Plan as well as with the Zoning Ordinance, the project sites are within the City limits, are less than 5 acres in size, and are surrounded by urban uses; there is no evidence that the site has value as habitat for endangered, rare, or threatened species; approval of the projects will not result in significant effects relating to traffic, noise, air quality, or water quality; and the sites can be adequately served by all required utilities and public services. The projects are exempt from further environmental documentation pursuant to Section 15332 of the State CEQA guidelines.
