Over the past 28 years we have experienced steady growth in our core business of satellite communications and we now employ over 1,700 staff in our Carlsbad offices. This growth and success have also created the need for more complex satellite and antenna systems. ViaSat will need to accommodate several new initiatives at our headquarters in order to support continued development and growth. This may require antennas up to 9-meters in diameter for the following business and technical reasons: 1. Re-location of our primary satellite services from Atlanta to Carlsbad. Historically, our primary enterprise satellite services have been operated out of our facility near Atlanta, George on a 6.1-meter Ku-band antenna. Ku-band satellite communication are very sensitive to degradation due to rain and the high rain rate in the Atlanta area has caused substantial and excessive network service outages over the past several years. We have lost business as a direct result of these outages and are at further risk of losing more business. To mitigate the risk of further loss ofbusiness, the company has decided to move our primary enterprise service hosting to our facility in Carlsbad. The rain rate in Carlsbad is substantially better and our network availability will be much improved. However, our satellite link budget calculations show that we may need to increase the antenna size to 9-meter to achieve sufficient inbound link margins. The satellite footprint as received in Carlsbad is weaker than in Atlanta and must be offset by the additional gain provided by the larger antenna. 2. Support for our ViaSat-2 satellite initiative In 2012 ViaSat successfully launched ViaSat-1 which delivered the next generation satellite broadband service across the US. ViaSat-1 is the highest throughput satellite ever built, offering more Ka-band capacity than all other satellites over North America combined. ViaSat is currently developing ViaSat-2 which will offer improved price / performance across a much larger geographic area. This system will require the installation of numerous satellite gateways throughout the hemisphere. These gateways will have antennas that are all a minimum of 4.5- meter, but in some cases up to 9-meter. Proper development and support of the satellite project will require the installation and testing of the same type and size of gateway antennas at our Carlsbad location. 3. Specific partner and customer requirements In order to help defray teleport construction and operations costs, ViaSat is considering an offer from a key partner to share services at our facility. A specific requirement for this partnership is the installation of a 9-meter C-band antenna for service in the NSS-5 satellite. C-band satellites cover very large areas with very low power and require the extra gain inherent in larger antennas to operate properly. In general, larger satellite antennas provide higher performance, high network availability, lower power consumption, lower off-axis emissions and a reduced susceptibility to RF interference. Satellite link budget calculations are used to determine minimum antenna size for desired network availability. In the course of supporting our core business it is likely that we will need to accommodate various sizes of ground based antennas in Carlsbad. Over time we intend to consolidate all antennas over 3.7 meters into our expanded antenna farm. ViaSat is listed as one of Carlsbad's Major Employers on the City of Carlsbad webpage. We believe the growth of the company has been beneficial to the community and we look forward to working with the City to find mutually agreeable ways to install the larger antennas needed to sustain our continued growth. The project requires a conceptual landscape plan drawn to scale on 24" x 36" sheets. Please refer to Development Permit Form (P-2) for specific requirements. As shown on the site plan, antennas up to 9 meters (29+' tall) exceed the maximum height limit (twenty feet) for a ground mounted antenna pursuant to Section 21.53.140(e)(l)B of the CMC. As such, please provide written justification and/or evidence to support the need for the additional antenna height. A request to increase antenna height above 20 feet is allowable through the MCUP process pursuant to Section 21.42.140 ofthe Zoning Ordinance provided findings can be made. Engineering: 1. Staff has concerns with the proposed antenna heights up to 9 meters tall and their visual impact on the commercial site to the north, and from the public rights-of-way (Palomar Airport Road and El Camino Real). Specifically, the proposed antenna farm does not comply with the maximum permitted height for satellite antennas. The City Planner has the ability through the Minor Conditional Use Permit process to allow deviations to development standards, such as the height of a satellite antenna. However, support for this proposal is contingent upon staff being able to justify that the project is compatible with other uses in the neighborhood. Therefore, staff highly recommends that the landscape plan clearly demonstrates how the antenna farm will be screened so that there is little or no visibility from the aforementioned adjacent property and roadways, in addition to ensuring compliance with Section 21.53.140(e)(l)D of the CMC. Please refer to the conceptual landscape plan previously approved through PIP 98-07(B)/MCUP 09-06. 2. In addition to landscape screening, please consider painting the antennas to blend in with the existing and proposed landscape, or other stealth techniques to reduce their visibility from adjacent properties. 3.
