Dear Mr. Bradstreet,
I am writing you to notify the Parks and Recreation Dept., that
Multitech Properties will no longer be maintaining the offsite
slopes adjacent to Elm Ave. between Celinda Dr. and Dana Dr, in
Carlsbad, California.
As the enclosed documents indicate, Multitech has met all of its
requirements with relation to the offsite improvements of
Carlsbad Tract 83-20 including landscaping and maintenance of the
subject slopes.
I am also including a copy of a letter from our Property
Management Dept. regarding the water meters which service the
offsite slopes.
Should any questions or concerns arise regarding this issue,
please feel free to contact me at 455-1900.

The Notice of Completion for the above-referenced subdivision has
recorded. Therefore, per instructions from our Engineering, we
are hereby reducing the Faithful Performance Bond. Please consider
this letter your notification that Insurance Company of the West
Faithful Performance Bond No. 138720 is hereby reduced from $160,500
to $80,250. We are required to retain the remaining amount (25% of
the original bond amount) for a period of one year. At that time,
if no claims have been filed, it will be released.
The Labor & Materials Bond, in the amount of $160,500 will be eligible
for release six months from the date of recordation of the Notice of
Completion, on November 10, 1989.
A copy of the recorded Notice of Completion is enclosed for your
records.

Dear Ms. Landers:
Please find enclosed a drawing of a proposed fence to be installed
at the top of a low (1 to 3 block) retaining wall between our park-
ing lot and Buildings 9, 10 & 11 which lie below it and toward the
east. The fence is designed to provide a 44" high safety barrier.
The planting on the slope beyond will be visible through the open
fencing. The masonry wall and fence will be painted the same color.

Carlsbad Tract 83-20
Dear Members of the Planning Commission:
Ue request an 18-month extension for this Site Development Plan from June 26,
1986, its current expiration date, to December 26, 1987. The Site Development
Plan is for Lot 74 of Carlsbad Tract 83-20, which we intend to finalize prior
to its expiration date of July 17, 1986.
The basic reasons for requesting the extension include the following:
Although we have dealt with the requirements of Carlsbad Tract 83-20 in
a timely manner (for example, we submitted all of the grading and improvement
drawings on February 15, 1985) finalizing all the details has taken longer
than anticipated. It has also taken longer than anticipated to negotiate a
cost-sharing arrangement for the construction of the offsite portion of Elm
Avenue, which is a requirement of the tentative map.
The subdivision requires extensive land development work which will take
a minimum of six months to twelve months to complete, and a building permit is
not available until the grading and associated land development improvements
have been completed.
Please let me know if any other information is required, or other issues exist,
with respect to this extension request. It is my understanding that the Planning
Commission will consider this as an informational item.

I have researched our files and as requested have determined the
expiration date for the above-mentioned project. This is as
follows:
SDP 84-3(A) - Resolution No. 2455 - Approved June 26, 1985
Building permits must be issued at least one year from
date of approval.
Expiration date: June 26, 1986
CT 83-20 - Resolution No. 7673 - Approved July 17, 1984
Tentative map expires two years from date of approval.
Expiration date: July 17, 1986
If you wish to request an extension on the site development plan,
you must submit a letter to the Planning Commission stipulating
the reasons for the request as well as the additional time
necessary. This information would then be presented to the
Planning Commission for approval.

Dear Ms. Landers:
This letter is a follow-up of the phone conversation which
I had with a receptionist in your office, Monday, March 10,
1986. (You were in a meeting when I called.)
As a member of the San Diego C—ounty Archaeological E.I.R.
Review Committee, I wish to issue a protest (albeit tardy)
against the issuance of a grading permit for such a significant
site as Rising Glenn. It is a terrible shame existing laws
do not protect such a unique archaeologically fecund site
as Ri s ing 61enn.
Rising Glenn will be an unfortunate loss. With stricter legis-
lation, perhaps the loss of equally unique sites will not occur
again.
Thank you for the opportunity to comment on this project. I
an afraid the tardiness of this response is due entirely to a
misunderstanding on my part.

Dear Ms. Landers:
I received your letter of March 6, 1986, regarding the mitigation of impacts at
the Rising Glen Subdivision, and I wanted to explain why I did not review the
report. While one of the jobs of the officers of the Society for California
Archaeology is to review public documents relating to archaeology, I was not
able to do so in this case because the company I work for is in direct competi-
tion with the company that prepared the environmental studies. If I reviewed
the archaeology report, ethical questions about conflict of interest could be
raised. In the case of this particular report, I referred the project to the
San Diego Archaeological Society, a local avocational group that reviews
archaeology reports without conflict. This group, and Mr. Royle in particular,
has been providing impartial review of local projects for many years. In the
future, I would suggest that archaeology reports be sent directly to the
following individual for review:

report for cultural resources located on the Rising Glen

permit time for public comment. This time period has elapsed

The City feels that all conditions of approval regarding
archaeological mitigation have been met. A certified
archaeologist will be required to be present onsite during the
grading .

Reference: Rising Glen Archaeological Program Design
Dear Mr. Holzmiller:
This letter is submitted at the request of the City of
Carlsbad in order to document the archaeological work
completed to date at site SDM-W-143/146 within the Rising
Glen subdivision, and to provide a detailed work program for
the proposed phase II effort. The work program is designed
in compliance with Section 21083.2 of the Public Resources
Code and is based on a projected maximum budget of $46,000.
The proposed program design, as detailed below, will help to
answer three important research questions relating to San
Diego County prehistory. First, the siltation of Buena Vista
lagoon and changes in prehistoric diet through time will be
addressed by shell speciation, faunal analysis and extensive
dating. Second, the relationship between the Early Milling
and the Late Milling cultures will be examined through
analysis of stone tool production technology, etc. Finally,
while inland Luiseno occupation has previously been docu-
mented at various stites, the much needed addition of this
coastal Luiseno data will expand our overall knowledge of
prehistoric Luiseno culture throughout the county.
Introduction
Four prehistoric cultural resources originally recorded by
Malcolm Rogers in 1929 as SDM-W-143, W-144, W-145, and W-146
are located either in part or in their entirety within the
Rising Glen project boundaries. During an archaeological
reconnaissance of the subject property by Heritage Environ-
mental Services in July 1983, these resources were relocated
and described as a single site, SDM-W-143/146. The occu-
pation areas of SDM-W-143/146 which lie within the project
boundaries, as they correspond to the originally recorded

sites, have been assigned specific locus designations (Figure
1). SDM-W-143 lies entirely within the project boundaries
and is represented by the eastern portions of Loci D and E.
The majority of SDM-W-144 extends off-property to the south
and is represented by the southern portion of Locus E. SDM-
W-145 lies almost entirely off-property to the west, with
Locus A comprising the eastern peripheries of the main occu-
pation. Finally, SDM-W-146 extends off-property to the west,
with Locus C and the western portion of Locus D comprising
part of the major occupation. Of the 47-acre project area,
approximately 8.5 acres, or 18 percent, is underlain by
midden.
In August 1983, a limited archaeological testing program was
conducted at SDM-W-143/146 by WESTEC Services, Inc. to
evaluate the significance of the site. The testing program
revealed at least two areas of substantial archaeological
midden deposits, separated by an existing horse ranch. The
quantity and types of artifacts recovered indicated the
presence of Late Prehistoric (Luiseno) occupation deposits
overlying older Early Milling (La Jolla) material. This
suggests the possibility of continuous occupation at SDM-W-
143/146 for the past 7,000 years. It was concluded that the
archaeological resources at SDM-W-143/146 are significant and
"unique" (given the definitions of Section 21083.2), and
mitigation was required given anticipated project impacts.
Specifically, WESTEC recommended that a representative sample
of the site be excavated and the recovered materials
analyzed, with a special focus placed on seasonality studies
of shellfish, species identification of bone (particularly
fish), pollen studies for reconstruction of past environ-
ments, and collection of materials for radiometric dating.
Program Design
RBR & Associates, Inc. was requested to design and execute a
data recovery program. The results of WESTEC1s limited
testing program were sufficient to document the existence of
a significant subsurface data base at SDM-W-143/146.
Analysis of this data base can be used in addressing several
important research questions. First, there is the long-
standing argument regarding the siltation of the San Diego
County lagoonal systems and the disappearance of shellfish as
a food source, which C. N. Warren places at 3,000 to 4,000
years ago and G. Shumway et al. at 1,000 years ago. Next,
there is the relationship between the La Jolla peoples of
the Early Milling Period (ca 7,500 to 2,000 years ago) and
the Luiseno culture of the Late Prehistoric Period (2,000 to

200 years ago), as evidenced by continuity/discontinuity in
the subsistence base, artifact assemblage and raw material
selection for stone tools. Finally, there is the relationship
between the previously undocumented coastal Luiseno occupa-
tion sites and their well-known inland counterparts; no
Luiseno coastal village has been previously identified and
examined.
The limited testing done by WESTEC was not sufficient to
delineate and characterize this site. RBR & Associates, Inc.
designed a two-phase data recovery program of which the Phase
I fieldwork and cataloging, along with the speciation of
shell recovered from a single excavation unit, have been
completed. Phase I included the the delineation of four
distinct activity loci based on surface observation (Locus A
comprises 17, 466 m2, Locus C is 12,078 m2, LOCUS D is 10,707
m2f and Locus E is 11,102 m2) , carbon mapping, mapping and
collection of diagnostic surface artifacts, excavation of
twenty 1 by 2 meter units, cataloging of all recovered
cultural materials, and speciation of the shellfish remains
recovered from excavation Unit 3. Locations for the 20
excavation units were selected using a stratified random
sample, and constitute approximately .05 percent of the
archaeological site's surface area. The excavation units
ranged in depth from 20 cm to 190 cm, 70 cm being the mean
depth. Artifacts recovered during Phase 1 include: 66
groundstone implements, 74 flaked stone tools, 6,473 flakes
and cores, 139 ceramic sherds, 7 bone artifacts, 11 shell
beads, and 677 historic artifacts, mostly metal and glass
fragments. Faunal material includes: 2,586.7 g of animal
bone, 88.5 g of fish bone and 407,425.3 g (over 900 Ibs) of
shell. Radiocarbon and botanical samples, as well as soil
column samples for flotation were taken.
These efforts resulted in the expenditure of $17,500 to date.
The remaining $28,500 of the projected archaeological budget
will be required to complete the Phase II artifact and faunal
analyses and to prepare final reports. The projected
analyses are described below:
Faunal Analysis
Animal and fish bone and teeth specimens recovered will be
identified as to genus and species wherever possible, as well
as age at death. The purpose of faunal analysis is
threefold: 1) to identify the variety of fauna present in
the regional environment over the long period of occupation;

2) to identify the species of animals, fish and birds that
were included in the human diet and their changing ratios
with time and, 3) to identify the time of year when the site
was inhabited. The amount of bone and the represented
species will be compared by locus and by unit and level
within each locus in order to examine the dietary changes
through time of the prehistoric inhabitants of SDM-W-143/146.
Changes in diet, when correlated with radiocarbon dates, can
document environmental change, differential exploitation by
different cultural groups (i.e., La Jolla/Luiseno), and the
necessity of a hunting tool kit determined by resource
availability.
Shellfish Analysis
Shellfish remains will be speciated in order to provide
quantifiable data on this aspect of prehistoric diet. Infor-
mation on seasonality of gathering and shell midden homo-
geneity will clarify the role and function of shellfish in
the diet of the prehistoric inhabitants of SDM-W-143/146.
Shellfish analysis relates directly to the research question
of the siltation of Buena Vista Lagoon. If the lagoon became
silted during the time of prehistoric occupation it would be
reflected in the archaeological record by a gradual decrease
in shellfish remains leading to an ultimate absence of shell.
This dietary change, brought on by environmental conditions,
would necessitate a shift to a more reliable food source.
Hunting of small and medium mammals, rodents, birds, and fish
may become more important, as well as more intense gathering
of vegetal foods. These dietary changes are discernable
through analysis of the culturally deposited food remains
excavated at SDM-W-143/146. If dietary change did in fact
occur, the approximate dates can be obtained through correla-
tion with associated radiocarbon dates. If, instead, a
steady reliance on shellfish through time is indicated, the
assumed siltation of Buena Vista Lagoon can be negated. This
would have far reaching potential for future research in
prehistoric diet, population movements, and stone tool
technology.
Stone Tool and Flake Analysis
Stone tools will be analyzed as to their raw material, pro-
duction base, functional use wear, production technology, and
morphology. Particular stone tools have been used as
diagnostics of certain cultural groups and/or time periods,
e.g., small triangular projectile points (Cottonwood

Triangular Series) are identified with the Late Prehistoric
Period in San Diego County (both the Luiseno and Diegueno
cultures). Stone tool production technologies are also
identified with particular peoples, e.g., the split-cobble
production base is traditionally associated with the La Jolla
culture. Raw material availability and preference also
change through time, e.g., cryptocrystallines (chert and
chalcedony) become more available during the later occupa-
tions in San Diego County, whereas quartz, although available
earlier, seems to be selected for in greater quantity during
the Late Prehistoric times.
Cores, flakes and shatter, the waste by-products of stone
tool production, will be analyzed by specific criteria to aid
in understanding prehistoric technology. Cores, seven types
of flakes and two types of shatter define the technology
employed by individuals within a society in making tools.
Production technology is variable through time and between
cultural groups and can be identified through detailed
analysis, e.g., pressure flaking is associated with Late
Prehistoric stone tool manufacture.
Radiocarbon Dating
SDM-W-143/146 is unique in that datable amounts of carbon
occur in direct association with the occupational
stratigraphy and at virtually all levels of the midden. Most
prehistoric middens provide only occasional radiocarbon
dating opportunities (e.g., isolated hearths) not necessarily
associated with specific cultural remains. SDM-W-143/146
affords a rare opportunity to obtain an essentially con-
tinuous absolute chronology from the youngest (i.e., highest)
to the oldest (i.e., lowest) occupational levels. It is this
chronology, correlated with the other analyses, that will
allow a unique insight into San Diego prehistory. This
chronological correlation, when published, will provide other
workers an expanded basis for the interpretation of other
North County cultural resources. Carbon samples selected for
analysis will be chosen from all loci, with variation in
units and levels in order to obtain the most inclusive set of
occupation dates for SDM-W-143/146.
Obsidian Sourcing and Hydration
Obsidian is differentially present at sites in this region,
on the surface and in subsurface deposits. Information on
the source(s) and relative dates of obsidian specimens from
SDM-W-143/146 relate specifically to the La Jolla/Luiseno
interface. Obsidian samples can be identified as to specific
source deposit using neutron activitation analysis, x-ray

flourescence and optical emission spectroscopy. Presumably
the available source of obsidian changed through time, Coso
Mountain to the north is the expected source during the
earlier occupation with an eastern shift of focus to Obsidian
Butte in the Late Prehistoric Period. In addition, the
approximate elapsed time between working of the rock and the
present can be calculated by measuring the rate of the hydra-
tion of the stone's surface. This can be correlated to the
absolute radiometric dates, giving us a more precise
chronologic placement of the prehistoric occupation of SDM-W-
143/146. These data can also be compared to inland occupa-
tion sites for a better understanding of the widespread
exploitation of this resource. Hydration rates for coastal
San Diego have not been previously correlated with a detailed
radiometric chronology. This data is also of great interest
to current workers in coastal prehistory and should be
published.
Report Preparation
Final report(s) detailing the research methods and results of
the data recovery program for SDM-W-143/146 will be prepared.
The above detailed analyses, artifact descriptions, excava-
tion results, and the interpretation of the data, and discus-
sion of the focused research questions will be included.
These reports will be professional documents and will allow
use of these important results in regional studies and as a
comparative data base. Future utilization of site reports by
either the public or professionals requires adequate artifact
descriptions and counts, a problem-oriented research focus
and a description of the site's environmental and prehistoric
cultural contexts. Discussions and conclusions of problem-
oriented research require in-depth analyses of various
excavation results.
Conclusion
In conclusion, RBR & Associates, Inc. will complete the data
recovery program at SDM-W-143/146 through the analyses of
recovered faunal and shellfish remains, stone tool and flake
analysis, radiocarbon dating, obsidian sourcing and hydra-
tion, and the preparation of final reports. These analyses
relate specifically to the three research questions being
addressed at this site. Any future archaeological work done
on those portions of the site that currently extend off-
property to the south should be guided by this program design
in order to most effectively utilize this important data base

Dear Ms. Landers:
Please find enclosed a resubmittal of the site plan for this project in the form
of ten copies as you requested.
To summarize some of our recent discussions, the resubmitted plan has the
following features and advantages over the existing approved site development
plan:
a. All of the buildings are architecturally more attractive than those
in the existing approved plan.
b. All of the buildings are completely surrounded by landscaping as
opposed to those in the old plan which typically had pavement along one of
the long dimensions of each building.
c. The closest buildings to the El Camino Real frontage are approximately
90-120 ft. away from it, in comparison to the required 40 ft. set-back for
meeting the requirements of the El Camino Real scenic corridor standards.
d. By virtue of the 24 townhouse type apartments arranged in a shallow
"u" along the eastern side of the property, a low density impression is obtained
for the entire project from El Camino Real.
e. The 24 townhouses along El Camino Real are particularly architecturally
interesting, avoid any appearance of bulkiness by limitation of four apartment
units per building, and :have one-story elements at each end to further add
interest and create a low impact visual impression.
f. The slope bank along El Camino Real is extensively landscaped so as
to obscure the visibility of the project from El Camino Real.
g. The entrance driveway to the project has been relocated to form a
cross-intersection with proposed Celinda Drive, thus eliminating a policy
conflict as to driveway location which exists in the currently approved plan.

h. The toe of the slope at the intersection of El Camino Real and Elm
Avenue has been "pushed" into the project site (as compared to our previous
submittal) to create an open flat area at this intersection. The geometry
and planting details of this slope bank have been carefully designed by our
landscape architect to give it a natural appearance.
i. As shown by Sheet 4A of the plans, the cross-sectional profile of the
project compares favorably with the cross-sectional profile of the currently
approved project.
j. The entrance driveway and interior circulation has been redesigned
(in comparison to a previously submitted plan) to maximize the lineal footage
of the circulating driveway which is not loaded with parking on either side,
or loaded only on one side. A large quantity of the parking for the project
is located in its interior and thus screened from view from Elm Avenue as well
as El Camino Real.
k. The interior circulation continues to be served by a primary loop
driveway, designed with turns which are less severe than 90° in most instances,
thus creating a positive capability for emergency vehicles.
1. That portion of the main driveway loop which has the heaviest traffic
load has been redesigned to be 28 ft. wide and completely unloaded or single-loaded
per the telephone message received from Dan Clark on May 1, 1985. It is noted
that the City's previous request for 40 ft. wide driveways for this section has
been withdrawn.
In view of the many positive aspects of the project, some of which evolved during
several redesigns in response to City Staff review, we believe that a positive
recommendation for approval from the City Staff to the Planning Commission is
fully justified, and we hope that it is forthcoming. We would like our application
to be considered at the next available Planning Commission hearing date, which we
understand to be June 26, 1985.
We look forward to completing the approval process with the City Staff and Planning
Commission in a fair and expedient manner.

1. No grading permits will be issued until the final
archaeological report has been submitted and deemed
acceptable by the City of Carlsbad Land Use Planning Office.
2. The material collected from the site will be curated at San
Diego State University, except for those selected artifacts
which may be on loan to the Carlsbad Historical Society, it
will be the responsibility of the Historcial Society to make
the necessary arrangements for obtaining the material before
everything is given to SDSU.

Dear Mike:
We are studying the possibility of doing the Rising Glen land
development work in several phases instead of all at once as
originally contemplated by the previous developer.
Phasing the project seems to be advantageous with respect to
decreasing the amount of financial commitment needed to get the
project started and reducing the potential carrying costs of the
completed single family house lots by not creating inventory in
excess of a normal sales rate. We are considering phases for the
project as follows:
Phase I: Apartment Site
25 Single Family Lots (Nos. 1-9 & 58-78)
Elm Avenue Extension Offsite
Phase II: 15 Single Family Lots (Nos. 10-14 & 48-57)
Phase III: 12 Single Family Lots (Nos. 15-18 & 40-47)
Phase IV: Remaining 21 Single Family Lots (Nos. 19-29 & 30-39)
These phasing increments may not all be used individually and may
be combined to create two or three actual phases for the project.
The phasing is not intended to change any of our commitments in
doing the project, and therefore will have no effect on the end
result. It will, however, ease the start of the first phase,
including the extension of Elm Avenue.

ADDENDUM NO. 1 TO SOIL AND GEOLOGIC INVESTIGATION
Gentlemen:
Following your request, we have reviewed the "Soil and Geologic Investiga-
tion" report for the subject project prepared by Geocon, Incorporated dated
December 20, 1984. We have also reviewed the Preliminary Grading Plans
for Carlsbad Tract 83-20 prepared by HCH and Associates.
As presently anticipated, grading will consist of creating several cut and
fill slopes up to approximately 30 feet in height on both north and south
sides of the future Elm Avenue. Several retaining walls and a cribwall up
to 22 feet in height are also anticipated. Slope ratios for both cut and
fill slopes will be 2.0 horizontal to 1.0 vertical.
Our soil and geologic investigation report indicates that mudflow and
landslide debris may exist in the vicinity of the easternmost end of Elm
Avenue extension. Therefore, stabilization measures in the form of a

buttress fill, as recommended in our report, will be necessary. The length
of the buttress should be approximately 150 feet. Beyond this point, the
road elevation increases gradually from approximately 215 feet MSL to
approximately 260 feet MSL at the western end of the extension. According
to the findings from our initial study and the findings from a more recent
geologic reconnaissance within the subject area, soils prevailing above 220
feet MSL in elevation along the proposed Elm Avenue extension consist of
massive sandstones belonging to the Santiago Formation and Marine Terrace
Deposits. It is our^expjer^ence that cut^slopes constructed at inclinations~=,____-^-^-
of 2.0 horizontal to 1.0 vertical wi-t-Kin these sandstones should possess'
good to excellent stability.We
In conclusion, since no significant unfavorable geologic conditions are
known to occur in the general area of the proposed Elm Avenue extension, it
is our opinion that the project can be developed as proposed.

Dear Mr. Grimm:
Glen Subdivision/Elm Avenue Extension.
This letter is an evaluation of potential impacts to cultural
resources identified within the Rising Glen Subdivision which
can be anticipated from construction of the Elm Avenue ex-
tension. The subject property was initially surveyed for
cultural resources by Polan (1983). Two archaeological sites
were identified at that time: SDM-W-143/146 and "Alanda 1".
^ Polan concluded that SDM-W-143/146 was an extremely significant
cultural resource, and that Alanda 1 was not significant.
A testing program was subsequently carried out at both sites
by WESTEC (1983) to assess the significance of these cultural
resources. This testing program revealed the presence of
—^.deep and rich midden deposits at SDM-W-143/146, while Alanda
1 contained only a shallow deposit. Based on these results,
WESTEC concluded that SDM-W-143/146 was a significant cultural
resource, and that Alanda 1 was not.
Alanda 1 is a small shell midden site located in the north-
feast corner of the property. The site is situated some 52
,«,• feet north of the Elm Avenue extension, as presently planned
(see Figure 1). The site is not significant or unique. There-
fore further consideration is not required.
SDM-W-143/146 is a large and deep shell midden site covering
almost the entire southern half of the project area. At its
closest point, the site is situated uphill and some 255 feet
south of the Elm Avenue extension (see Figure 1). This re-
^•source is unquestionably significant and unique, and is presen-
tly the focus of a separate data recovery program. Construc-
tion of the Elm Avenue extension should not adversely affect
this significant resource. To ensure that this is the case,
it is recommended that if construction of the Elm Avenue
extension begins before finalization of the data recovery
program and report on SDM-W-143/146, then a 100-foot buffer
zone must be maintained around Locus A. This can be achieved
in a number of ways, including, but not limited to, fencing
of the buffer zone, flagging of the buffer zone, on-site
monitoring by a qualified archaeologist, etc. If finaliza-
tion of the SDM-W-143/146 report occurs before construction

of the Elm Avenue extension, then there would be no require-
ment to limit construction activity.
r-In summary, construction of the Elm Avenue extension across
the Rising Glen Subdivision will not cause significant effects
to identified cultural resources once the SDM-W-143/146 data
recovery program and report are final. Should construction
begin prior to finalization of the above mentioned report,
|then it would be necessary to establish and maintain a 100-
foot buffer zone around Locus A of the site SDM-W-143/146.

Dear Ms. Landers:
We are confirming that subsequent to our meeting of March 14, 1984, we are
working on providing the following refinements and corrections to our pre-
vious submission.
a. Clearer drawings of the retaining walls in the site plan.
b. Correction to cross-section drawing so that it matches the
information on the site plan.
c. Cross-section showing comparison between newly proposed
slope and buildings vs. previously approved slope and
buildings.
d. Perspective view of project from El Camino Real, focusing
on the relationship of street right-of-way, slope bank and
appearance of buildings closest to El Camino Real. (We will
attempt to portray the project from a potential viewpoint in
roughly the middle of the El Camino Real right-of-way about
100 ft. south of the intersection with Elm Avenue, looking
at the project in the northerly direction, in obtaining a
perspective cross-sectional view at a 30-40 degree angle
from the face of the buildings set back from the top of the
slope.)
We continue to believe that the project we propose, when judged in its
entirety, is an excellent alternative to the originally approved project
and are hopeful that the City Planning Staff reaches the same conclusion.
We are very concerned about the time schedule for this project and would
appreciate your consideration of putting this item on the Planning Commission
Agenda so that the potential time lag is minimized.

Re: Elm Avenue Extension Status Report
Dear Mr. Aleshire:
Thanks for meeting with me on Wednesday to discuss the progress and ramifica-
tions of the Elm Avenue Extension Project which is associated with our Rising
Glen land development and apartment projects. I am following up our discussion
with this written progress report for your reference. The progress report
deals with the Elm Avenue extension directly and with all the related develop-
ment issues which impact its progress.
Elm Avenue Extension Design - The working drawings were initiated and completed
at a cost of $14S640.00 and submitted to the City for general information
purposes on November 14, 1984, and submitted for plan check at an additional
cost of $2,162.00 on December 19, 1984. The plan checking is not complete at
this time.
Subdivision Design - The plans for the entire subdivision have been completed
and submitted for expedited plan check on February 14, 1985, which is still
pending.
Land Development Economics - The Elm Avenue Extension Project generates
approximately 100,000 cu. yds. of "export" soil material. The cost of trans-
porting this material with earth-moving machinery is about one-third of the
cost of moving it in over-the-road trucks. As a result, the Elm Avenue Extension
Project is about $300,000 cheaper if this material can be moved to someplace
in our subdivision. The subdivision has been redesigned to accommodate this
material. We have found that it is workable to deposit this material in the
apartment site portion of the subdivision and very difficult to utilize this
material in the single family portion of the subdivision. One of the advantages
of depositing it in the apartment site is that it minimizes any potential intru-
sion on the scenic and open space characteristics of the El Camino Real frontage.
Excess Right of Way Acquisition - We have proposed to the City the two small
triangles of land which appear to be excess with respect to the City's roadway
requirements be vacated and the underlying fee interest sold to us. If this
is approved, the piece south of Elm Avenue would be incorporated into the open
space lot of the single family subdivision and the piece north of Elm Avenue

would be incorporated into the apartment site, but without any increase in
the number of apartments to be built. As a result of this inclusion, the
apartments can be built and spread out slightly more in what we believe to
be a highly improved site plan, and more area is created to accommodate the
fill to be deposited from the Elm Avenue extension. One slight disadvantage
is that the slope bank, although of about the same height as in the previously
approved apartment project, comes somewhat closer to El Camino Real. We
believe that this is a minor disadvantage in the context of the project's
relatively favorable effect on its entire .6 mile frontage on El Ccmino Real.
Apartment Project Site Plan Amendment - Although a 195-unit apartment site
plan was previously approved, we have undertaken a design process over about
4 months to propose an alternate to the original plan. In addition to meeting
our goals of improved project economics, improved project appearance and more
pleasing residential environment, the revised plan seems to offer the following
planning and engineering advantages:
1. Entrance driveway relocated to form cross-intersection with
proposed Celinda Drive.
2. The main complex of 171 apartments is located in a contiguous
landscaped area.
3. The closest buildings to the El Camino Real frontage are
located 90-120 ft. from it and are only two-story.
4. By virtue of the 24 townhouse type apartments arranged in
a shallow "U" along the eastern side of the property, a low-
density impression is obtained for the project from El Camino
Real.
These advantages are somewhat offset by two disadvantages which we believe to
be minor but which may be considered important by the Planning and Engineering
Departments:
1. The loop driveway and parking arrangement which results in apartment
residents driving by many other cars parked perpendicular to the
driveway.
2. The slope bank being a little closer to El Camino Real than before.
We believe that the overall project quality, the correction of previous
deficiencies (i.e., driveway entrance and lack of landscaping around previously
designed buildings) and the new advantages, clearly outweigh the minor disadvan-
tages acknowledged above. We have some honest disagreements with respect to

the importance of some advantages and disadvantages with the City Planning
and Engineering staff, which we will attempt to resolve by discussion and
minor redesign if possible.
Elm Avenue Extension Right-of-Way Acquisition - We are working on the following
preparation for the acquisition of this right-of-way through the City's condem-
nation process if necessary:
1. Right-of-way plats for Jandro and Sarkaria properties.
2. Legal descriptions.
3. Appraisals by David Westcott, M.A.I.
4. Litigation Guarantees.
5. Advice and opinions of condemnation attorney, Ron Endeman, of
Jennings, Engstrand and Henrikson.
Environmental Clearance for Elm Avenue Extension Project - Negative declaration
will probably be available after some additional information is furnished regarding
geologic conditions and an archeological clearance is obtained.
Subdivision Archeology Program - We have pursued an archeological mitigation
program at a cost of approximately $45,000, a portion of which has been completed
and a portion of which will be completed in the near future after a public review
period has run its course, and the planning staff approves the remaining program.
Overall Project Economics - Due to the extensive on-site land development costs
and the requirement to deal with many expensive civil requirements having to do
with the El Camino Real frontage and with storm drain water generated in the
subdivision to the west, this subdivision is generally a "tough piece of land"
from the economic standpoint of the developer. Although that's primarily
our problem, a favorable financial result must be ascertained up front by large
outside financing sources for the project of Elm Avenue to go forward.
Coordination - We believe that it is highly desirable that some effort be made
to coordinate the individual permit and discretionary processes which we are
pursuing. This coordination will permit the Planning Commission and City Councils
to make their judgments in the context of overall quality and results as opposed
to judging individual and possibly minor issues without the advantage of an
overall perspective of the development.
Future Agenda - We will be completing all of the preparation needed for a poten-
tial condemnation of the properties needed, working to resolve the remaining
planning and engineering issues and proposing a plan which sets forth the
financial responsibilities and the financing sources for the Elm Avenue Extension
Project.
