AGENDA OF: July 17, 2002 Application complete date: October 1, 2001 Project Planner: Van Lynch Project Engineer: Frank Jimeno SUBJECT: SDP 97-07(AVC!UP 97-03rA)/SUP 97-03(A) - CARLSBAD GASOLINE FACILITY - Request for adoption of a Negative Declaration and Addendum and approval of amendments to Site Development Plan 97-07, Conditional Use Permit 97-03, and Special Use Permit 97-03 for a gas station, food-mart and car wash on property generally located on the northeast comer of El Camino Real and La Costa Avenue within Local Facilities Management Zone 6. I. RECOMMENDATION That the Plarming Commission ADOPT Planning Commission Resolution No. 5229 ADOPTING a Negative Declaration and Addendum and ADOPT Planning Commission Resolutions No. 5230, 5231 and 5232 APPROVING Site Development Plan amendment 97- 07(A), Conditional Use Permit amendment CUP 97-03(A), and Special Use Permit amendment 97-03(A) based on the findings and subject to the conditions contained therein. IL INTRODUCTION This project is for an amendment to the previously approved site development plan, conditional use permit, and special use permit for a gas station and mini-market located within the approved, but not built, La Costa Plaza shopping center located on the northeast comer of El Camino Real and La Costa Avenue. The amendment reconfigures the site plan to relocate the pump island canopy, revise the design of the food-mart, and accommodate an added automatic car wash facility. The project complies with the design of the approved shopping center, City standards, and all necessary findings can be made for approval ofthe project. III. PROJECT DESCRIPTION AND BACKGROUND The applicant proposes to revise the design of the previously approved gas station within the La Costa Plaza shopping center. The original site development plan, conditional use permit, and special use permit for the shopping center were approved by the Planning Commission on June 17,1998. The project is located within the La Costa Plaza shopping center. The proposed gas station is located on the east side of El Camino Real, 700 feet north of the intersection of El Camino Real and La Costa Avenue. Shopping center access roads are located on the north and south side of the gas station. Access to the gas station is off of these access roads; one driveway from the north access road and one driveway from the south access road. The access roads and driveways have not been modified from the original project. The food-mart is located in the northwesterly portion of the site as was the original food-mart. The new building has been set back an SDP 97-07(A)/CUP 97-03C?5/SUP 97-03(A) - CARLSBAD GASOONE FACILITY July 17, 2002 Page 2 additional 12 feet off El Camino Real, 47 feet total, to allow for the location of a driveway to access a new automatic car wash facility which is located on the north side of the project. The car wash is oriented whereby vehicles would drive between El Camino Real and the food-mart and enter the car wash from the west and exit to the east. The opening to the car wash is located 84 feet fi-om the El Camino Real right-of-way. The original fuel island of six fuel dispensers was located on the easterly portion of the site under a square canopy. The new fuel island will have eight fuel dispensers with a rectangular canopy that is oriented east to west and setback 50 feet firom the westerly property line. The trash enclosure and air/water facility has been relocated to the east side of the building fi-om the southwest comer of the site. Vehicle parking has been moved fi-om along the El Camino Real fi-ontage to the south side, and fi-ont, of the revised mini- mart building. Vacuum cleaners are provided for the two parking spaces on the east side of the building. The 30-foot building setback fi-om El Camino Real is landscaped per the original plan. The building height has been reduced fi-om 32 feet to 26 feet, two inches. The food-mart building size has increased in size by 142 square feet to 2,938 square feet. The building maintains similar architecture and colors as the rest ofthe shopping center. At the City Council meeting for the original project's approval, the developer voluntarily offered to dedicate a portion of the proposed AM/PM mini-market for law enforcement purposes. The City's police department has reviewed the development proposal and has determined that a facility would not be required at this location. The city would prefer a location that is more remote or outlying than this location. The developer also agreed to voluntary restrictions on the hours of deUvery to the gas station and that they may be restricted firom 12:00 p.m. to 6:00 a.m. or to such other reasonable and appropriate times upon notice and as determined by the City Manager. A condition has been added to the conditional use permit to reflect the above. A copy ofthe original site plan is attached to the project's full size exhibits. The proposed project is subject to the following regulations: A. Carlsbad General Plan designation of Local Commercial - (L) B. Neighborhood Commercial, QuaUfied development overlay (C-l-Q) Zone (Chapter 21.26 and 21.06 ofthe Carlsbad Municipal Code); and Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code, conditions found in C-1 zone, 21.26.015(5)); C. Special Use Permit - El Camino Real Corridor Development Standards D. Site Development Plan 97-03 - La Costa Lucky/Sav-On; and E. Growth Management Ordinance (Chapter 21.90 of the Carlsbad Municipal Code) and Local Facilities Management Zone 6. IV. ANALYSIS Staffs recommendation of approval for this conditional use was developed by analyzing the project's consistency with the applicable City regulations and policies. This analysis will present in text the project's consistency with the applicable regulations listed below: SDP 97-07(A)/CUP 97-03(A)/SUP 97-03(A) July 17, 2002 Page 3 Q CARLSBAD GASOONE FACILITY A. General Plan The project site is designated Local Shopping Center (L) on the General Plan Land Use Map. The gas station and car wash are part of a larger center and are recognized as a secondary tenant to the primary tenant, or anchor tenant, which is the proposed grocery store/pharmacy for the center. B. Zoning 1. Commercial Zone. The proposed gas station/car wash is permitted in the C-1 zone with the approval of a Conditional Use Permit. 2. Conditional Use Pennit. The proposed service station/car wash is associated with a local shopping center land use and would have vehicular access to El Camino Real. Landscaped perimeter planters and driveway aisles would buffer the faciUty fi-om the shopping center. The site is located away fi-om the intersection of El Camino Real and La Costa Avenue and adequate on-site circulation is provided for delivery of fuel and passenger vehicles. The car wash provides adequate vehicle queuing for at least five vehicles. The site provides 17 parking spaces where 15 are required. The original project required 10 parking spaces and 16 were proposed. The project contains conditions which restricts the delivery times of fuel to the site. The service station would comply with the required conditions of Chapter 21.42 as follows: STANDARD PROPOSED PLAN COMPLIES? Factual situation - Service Station must be part of a shopping center. El Camino Real Corridor Development Standards The El Camino Corridor is designated a scenic corridor and a special use pemiit amendment is required for the redesign of the project. There are no proposed signs with this project and the future signs would be required to comply with the previously approved sign program for the project. D. Site Development Plan 97-03 - La Costa Lucky/Sav-On The revised project will adhere to the original architectural design standards estabUshed for the shopping center. The food-mart and car wash both have architectural design and features to blend in with the architecture of the shopping center. The building materials, stucco and tile roofs, and building and accent colors are the same as the rest of the shopping center. The food-mart's building setback has been increased off El Camino Real fi-om 30 feet to 47 feet to accommodate the new driveway entrance to the carwash. The existing site plan requires earthen landscape berms that will screen the drive aisle entrance and vehicles going into the carwash. The physical entrance to the car wash is 83 feet fi-om the property line. Additional landscaping and tower feature at the entrance to the carwash will partially screen the opening into the car wash. The amended site plan does not affect the design or traffic circulation of the remainder of the approved site plan. E. Growth Management Ordinance The project is located in Local Facilities Management Zone 6 in the southeast quadrant of the city. The increase on public facilities is minor with the revised project. The table below summarizes compliance with the performance standards. ENVIRONMENTAL REVIEW Staff has conducted an environmental impact assessment to determine if the project could have a potentially significant effect on the environment pursuant to CEQA Guidelines and the Environmental Protection Ordinance (Title 19) of the Carlsbad Municipal Code. The project falls within the scope ofthe City's MEIR for the City ofCarlsbad General Plan update (EIR 93- 01) certified in September, 1994, in which a Statement of Overriding Considerations was adopted for cumulative impacts to air quality and traffic circulation. MEIRs may not be used to review projects if certified more than five years prior to the filing of an application for a later project except under certain circumstances. The City is currently reviewing the 1994 MEIR to detennine whether it is still adequate to review subsequent projects. Although the MEIR was certified more than five years ago, the City's preliminary review of its adequacy finds that no substantial changes have occurred with respect to the circumstances under which the MEIR was certified. Additionally, there is no new available information which was not known and could not have been known at the time the MEIR was certified. Therefore, the MEIR remains adequate to review later projects. All feasible mitigation measures identified by the MEIR which are appropriate to this project have been incorporated into the project. No significant envirorunental impacts were identified for the project. In consideration of the foregoing, the Planning Director issued a Negative Declaration for the project on April 4, 2002. That all yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted fiiture uses in the neighborhood will be 1 ^ provided and maintained, in that the 30 foot building setback area along El Camino Real area would be heavily landscaped and contain an earthen berm to screen the parking lot from the public roadways. The building perimeter of the market/drug 20 store would be screened by trees; the roof would be an earth tone color to reduce light reflection; and, the roof equipment would be screened to reduce visual impacts 21 on the homes located to the southeast of the property. The shopping cart storage areas at the front of the market/drug store would be screened with walls and the 22 truck loading well area would be screened by landscaping and a wall along the 2^ north side of the site. The shopping center would have covered pedestrian walkways in front of the shops and a landscaped pedestrian plaza area located at the corner of 24 the site next to the El Camino Real and La Costa Avenue intersection. The shopping center would have pedestrian connections to the public sidewalks along El 25 Camino Real and La Costa Avenue. The parking lot would have shopping cart storage areas and the driveways and parking spaces would meet City standards. In addition, the parking lot interior and perimeter would be landscaped with a 2y combination of trees and shrubs. The main entryways would have a landscaped median and texture/enhanced paving treatment. 28 PC RESO NO. 4313 1 4. That the street systems serving the proposed use is adequate to properlv- handle all traffic generated by the proposed use, in that the shopping center would have good internal ^ vehicular and pedestrian circulation and contain a wide central non-loaded 2 circulation driveway that would connect with a new signalized intersection at La Costa Avenue and two driveways leading to El Camino Real. 4 " 5 „ Staff is authorized and directed to make, or require Developer to make, all corrections 6 and modifications to the Site Development Plan document(s) necessary to make them intemally consistent and in conformity with final action on the project. Development shall occur substantially as shown in the approved Exhibits. Approval of SDP 97-07 is granted subject to the approval of GPA 97-02, ZC 97-02, CT 97-09, PUD 97-13, SUP 97-02, CUP 97-03 and SUP 97-03. SDP 97-07 is subject to all conditions and code reminders contained in Planning Commission Resolution No. 4311 for the Tentative Map. 12 3. This approval shall become null and void if building permits are not issued for this project within 24 months from the date of project approval. 13 If any of the foregoing conditions fail to occur; or if they are, by their terms, to be 14 implemented and maintained over time, if any of such conditiorts fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or further condition issuance of all 15 future building permits; deny, revoke or further condition all certificates of occupancy issued under the authority of approvals herein granted; institute and prosecute litigation to 17 compel their compliance with said conditions or seek damages for their violation.
