The Second Amended and Restated Affordable Housing Agreement Imposing
Restrictions on Real Property dated July 9, 1999 between the City of Carlsbad and
Continental Ranch, Inc. for the Rancho Carrillo Master Plan, Village Q-4 and R-3
requires that eight (three in Village Q-4, Lots 217, 227, and 234, and five in Village R-3,
Lots 166,187,190,197 and 204) Second Dwelling Units be constructed.
This application is for one Second Dwelling Unit at Lot 216. A application was
submitted previously for Lot 205. Separate applications will be made for the remaining
Second Dwelling Units as follows: Phase 2 - Lots 220 and 234*, Phase 3 - Lot 230,
Phase 4 - Lot 197*, Phase 5 - Lot 190* and Phase 6 - Lot 187*.
Our Plan 6 incorporates the Second Dwelling Unit into its design with access to the SDU
from the courtyard. The SDU includes an entry, combined dining/living area with full-
size kitchen sink, ovedrange, microwave/hood combo, refrigerator space, hookups for
washer and dryer, a separate bedroom and bath area. The single car garage is also
assigned to the SDU. Our SDU has a total of 597 square feet, which complies with the
size indicated in the Affordable Housing Agreement.

SECTION Jl - CONDITIONS FOR COMPLIANCE
PLEASE READ CAREFULLY
1. A second dwelling unit is an attached or detached dwelling unit which is located on the same lot
as an existing owner-occupied single family detached dwelling unit and is:
a. Suitable for use as a complete living facility with provisions within the facility for
cooking, eating, sanitation and sleeping;
b. Occupied by one or more persons; and
C. Subordinate to the main dwelling unit.
2. The Property Owner(s) listed above hereby certifies that he/she owns the above referenced
property, as of the date of this affidavit, and to hisher belief and knowledge, there are no
conditions, covenants or restrictions on the property prohibiting a second dwelling unit apartment.
3. The Property Owner(s) agrees to the following terms and conditions:

a. The property and residence referenced above must not contain a second residential
dwelling unit unless it is in compliance with the second dwelling unit administrative
permit provisions of the Zoning Ordinance of the City of Carlsbad.
b. The Property Owner(s) shall reside in either the main dwelling unit or second dwelling
unit described above, now, and for the life of this agreement. "Owner" shall include a
lessee if the leasehold includes both the main dwelling unit and the second dwelling unit.
C. The Second Dwelling Unit may only be rented and shall not be sold separately from the
main dwelling unit, unless the lot on which such units are located is subdivided.
d. The Property Owner(s) agree to rent the Second Dwelling Unit at a mo~nthly rental rate
which shall not exceed an amount equal to 30% of the gross monthly income of a low-
income household, adjusted for household size, at 80% of the San Diego County median
income.
e. A copy of this agreement and Affidavit must be given by the Property Owner@) to
prospective purchasers of the property prior to entering into a sales contract for said
property.
SECTION III - AFFIRMATION AND AGREEMENT
I HEREBY DECLARE AND AFFIRM, under penalty of perjury, that all matters and facts set forth in
