SECTION II - CONDITIONS FOR COMPLIANCE

1. A second dwelling unit is an attached or detached dwelling unit which is located on the same lot
as an existing owner-occupied single family detached dwelling unit and is:

c. Subordinate to the main dwelling unit.
2. The Property Owner@) listed above hereby certifies that he/she owns the above referenced property,
as of the date of this affidavit, and to hidher belief and knowledge, there are no conditions,
covenants or restrictions on the property prohibiting a second dwelling unit apartment.

3. The Property Owner(s) agrees to the following terms and conditions:
a. The property and residence referenced above must not contain a second residential dwelling unit
unless it is in compliance with the second dwelling unit administrative permit provisions of the
Zoning Ordinance of the City of Carlsbad.
b. The Property Owner(s) shall reside in either the main dwelling unit or second dwelling unit
described above, now, and for the life of this agreement. "Owner" shall include a lessee if the
leasehold includes both the main dwelling unit and the second dwelling unit.
c. The Second Dwelling Unit may only be rented and shall not be sold separately from the main
dwelling unit, unless the lot on which such units are located is subdivided.
d. The Property Owner(s) agree to rent the Second Dwelling Unit at a monthly rental rate which
shall not exceed an amount equal to 30% of the gross monthly income of a low-income
household, adjusted for household size, at 80% of the San Diego County median income.
e. A copy of this agreement and Aflidavit must be given by the Property Owner(s) to prospective
purchasers of the property prior to entering into a sales contract for said property.
SECTION I11 - AFFIRMATION AND AGREEMENT

Second Dwelling Unit Permit
This application is for construction of a new single family residence on an existing 0.67 acre
parcel, located in LFMP Zone 1. There is an existing house with garage on the property, which
will be partially removed. The remainder will be remodeled into a second dwelling unit under the
provisions of Zoning Ordinance Section 21.10.015.
The proposed new main house will have a total of 2,675 square feet with a 3-car garage. The
second dwelling unit will have 619 square feet with a 2car garage. The R-1-15,OOO development
standards for the property and the proposed project data are outlined below:

The grading concept is to site the building with minimal grade changes, maintaining the character
and continuity with adjacent properties. There will be approximately 530 cubic yards of balanced
cut and fill for the project. Access into the lot will remain at the existing driveway location. The
existing landscape includes ornamental plantings. There is no native vegetation on the property.
The existing house was constructed in 1954, and has had several additions since that time. The
existing structure has a legally nonconforming setback encroachment due to changes in the zoning
standards since the addition was built. This portion of the existing structure will be removed as
part of this project. The remodel into a second unit will have interior modifications to meet the
second dwelling unit standards, and exterior modifications to be consistent with architectural
features of the new main structure.
The use is consistent with the General Plan and LCP (Mello 11) Land Use designation for low
medium density residential development. The project meets all development standards of the R-1-
15,000 zone as well as criteria for a second unit, including setbacks, height limits, lot coverage
and parking requirements

Statement of Prospective Rental Rate
The second dwelling unit is planned for occupancy by a family member. If rented,
the rate will comply with the monthly rental rate limitations of the ordinance based
on household size and county median income (as specified in “Affidavit of
Compliance”).
